IMMIGRATION ACT

IN EXERCISE of the powers conferred by section 37 of the Immigration Act (Cap.
62) the Prime Minister with the consent of Cabinet hereby makes the
following Regulations:—

1.

(1) These Regulations may be cited as the Immigration (Amendment)
Regulations 2002.

(2) The Immigration Regulations (Cap. 62) are in these Regulations referred
to as the Principal Regulations.

(3) These Regulations shall come into force on 1 March 2002.

2. Regulation 11 of the Principal Regulations is deleted and replaced with
the following:

“11.
(1) The fees in the Schedule hereto shall be paid in respect of the

matters specified therein.

(2) The said fees are payable in respect of every person included on the
application.

(3) The entire fee is payable prior to lodgement of an application form
with the Immigration Division.

(4) Fees charged are for application and processing of a permit and are
not refundable, notwithstanding that the permit is later declined by
the Immigration Division.

(5) Where any permit held by an applicant has expired during the
application process of a permit, and the applicant has not allowed
the period of 4 weeks for the processing of his application during
the validity of his visa, the principal applicant shall be charged an
additional $500 in addition to the relevant visa application fee.

(6) Where any permit has expired before the principal applicant has
lodged his re-application for a valid permit for the Kingdom, the
principal shall be charged an additional $1,000 in addition to the
relevant permit application fee.

(7) Revenue receipts will be issued and should be obtained for all fees
paid.”

3. The Schedule to the Principal Regulations is deleted and replaced with the
following Schedule:

“SCHEDULE”
1. A Visitor's permit enabling a stay of 31 days in the

Kingdom of Tonga for those non citizens who require
permits for entry into the Kingdom.

$40 per person for 31
days only or less

2. Extension of a Visitor's permit for any period less than a
month (31 days) except for those persons under the age of
18.

$30.00 per person

3. Extension of a Visitor's permit per month except for those
persons under the age of 18.

$40.00 per person, per
month

4. Extension of a Visitor's permit for any person under the
age of 18 years old for any period less than a month (31
days).

$5 per child

5. Extension of a Visitors permit per month for any person
under the age of 18 years old.

$5 per child, per month

6. Issue of a Multiple Visitor's Visa. $40 per person, per year
7. Transfer if a Visitor's of a permit to and employment for

business permit.
$1,000

8. An Employment permit or extension of a business permit. $150
9. A Business permit or extension of a business permit. $200
10. A permit for Assured Income category. $150
11. A permit for study or extension of a study permit. $50
12. A permit for a resident dependent spouse or child (under

the age of 18).
$20 per person

13. Any other permit not stipulated above. $100
14. Transfer of any permit (other than a Visitor's permit) to $150

another category of permit.
15. Any letter or document allowing travel to the Kingdom on

a one way ticket for a child under the age of 18 years old.

16. A letter or document allowing travel to the Kingdom on a
one way ticket for any person 18 years old or over.

17. Any letter or document issued by the Immigration division
including items 15 and above.

18. The issue of any duplicate or replacement letter by the
Immigration Division

19. The issue of a duplicate or replacement permit. $30
20. The lodgement of an appeal to the Prime Minister. $500
21. Any application made under section 26 of the Principal

22. Application for consent to marry. $50
23. The endorsement of an exemption in any passport for an

applicant under section 7(1) (g), (h) and (i) of the Act.
