AN ACT TO AMEND THE ACT OF CONSTITUTION OF TONGA

I assent,
TAUFA'AHAU TUPOU IV,

21st November, 2003

[16th of October, 2003]

BE IT ENACTED by the King and the Legislative Assembly of Tonga in the
Legislature of the Kingdom as follows:

1.
(1) This Act may be cited as the Act of Constitution of Tonga

(Amendment) Act, 2003.
(2) The Act of Constitution of Tonga (Cap. 2) as amended, is in this

Act referred to as the Principal Act.

2. Clause 7 of the Principal Act is amended by renumbering the existing
clause as sub-clause (1) and inserting the following new sub-clauses -
“(2) It shall be lawful, in addition to the exceptions set out in sub-clause

(1), to enact such laws as are considered necessary or expedient in
the public interest, national security, public order, morality, cultural

traditions of the Kingdom, privileges of the Legislative Assembly
and to provide for contempt of Court and the commission of any
offence.

(3) It shall be lawful to enact laws to regulate the operation of any
media.”

3. The Principal Act is amended by adding a new clause 103A immediately
following clause 103 as follows:
“103A. The remedy for breach of any provisions of the Constitution

shall be declaratory relief and shall not affect any award of damages
under any other law.”
