Act 17 of 2005

AN ACT TO AMEND THE LEGISLATIVE ASSEMBLY RETIREMENT
BENEFITS SCHEME ACT 2004

I assent,

BE IT ENACTED by the King and the Legislative Assembly of Tonga in the
Legislature of the Kingdom as follows:

1.

(1) This Act may be cited as the Legislative Assembly Retirement Benefits
Scheme (Amendment) Act 2005.

(2) In this Act, Principal Act means the Legislative Assembly Benefits
Retirement Scheme Act, 2004.

2. Section 4 of the Principal Act is amended by inserting a new subsection (3) as
follows: —

“(3) Pursuant to subsection (2)(b), the Board may withhold or delay its
nomination of the Organisation, if the Legislative Assembly is

satisfied that the Board can carry out the responsibilities and other
legal requirements of the Organisation, as hereinafter stated in the
Act.”

3. Section 4(2)(c) of the Principal Act is amended by deleting the word “Board”
that appears in this section and substituting it with the words “Legislative
Assembly”.

4. Section 9(2) of the Principal Act is amended by deleting the word “All” and
substituting it with the number “3”.

5. Section 8 of the Principal Act is amended by inserting the words “from its Vote”
after the words “Legislative Assembly”.

6. Section 11(1) of the Principal Act is amended by deleting the word “shall” and
substituting it with the word “may”.
