AN ACT
TO AMEND THE SHIPPING ACT TO TRANSFER MINISTERIAL

AND ADMINISTRATIVE POWERS TO THE MINISTER OF
TRANSPORT AND THE MINISTRY OF TRANSPORT

BE IT ENACTED by the King and the Legislative Assembly of Tonga in
the Legislature of the Kingdom as follows:

1. (1) This Act may be cited as the Shipping (Amendment) Act 2008.

(2) The Shipping Act (Cap. 136), as amended, is in this Act referred
to as the Principal Act.

2. Section 2 of the Principal Act is amended by -

(a) deleting the definition of "Minister" and inserting the
following -

" 'Minister' means the Minister for Transport";

(b) deleting the definition of "Ministry" and inserting the
following:

" "Ministry" means the Ministry of Transport;"

(c) deleting the word "Secretary" and its definition.

3. The Principal Act is amended by deleting the words "Secretary for
Marine and Ports" and the word "Secretary" wherever they appear
and replaced with the words "Minister for Transport" and the word
"Minister" respectively.

4. The Principal Act is amended by deleting section 6 and replacing

with the following:

"6. Minister for Transport

The functions of the Minister for Transport with regard to
marine matters shall be responsible for the administration of
this Act."
