(AMENDMENT) REGULATIONS 2011

RETIREMENT FUND ACT 1998

IN EXERCISE of the powers conferred by section 12 of the Retirement Fund
Act 1998, Cabinet makes the following Regulations –

1 Short Title

(1) These Regulations may be cited as the Retirement Fu d (Administration)
(Amendment) Regulations 2011.

(2) The Retirement Fund (Administration) Regulations 1999, as amended, are
referred to in these Regulations as the Principal Regulations.

2 Regulation 5(3) amended

Regulation 5(3) of the Principal Regulations is amended, in the Tongan version
only, by repealing paragraphs (b) to (e) and replacing them with the following –

3 Regulation 9 amended

Regulations 9 of the Principal Regulations is amended by inserting a new sub-
regulation (6) as follows –


“(6) In the case of a former member who has been subsequently re-
admitted as a member, and the Fund Board still maintains the
preserved portion of his previous Leaving Service Benefit, such
preserved portion shall be added to the member’s late t Transfer
Preserved Account. The combined Transfer Preserved Account
shall be subject to the member’s most recent membership
status.”.
