TRAFFIC (AMENDMENT) REGULATIONS 2009
TRAFFIC ACT (CAP.156)
IN EXERCISE of the powers conferred by section 40 of the Traffic Act
(Cap.156), the Principal Licensing Authority with the consent of Cabinet,
makes the following Regulations and as amended by the Legislative Assembly
on the 19
th
October 2011 by virtue of section 9 of the Government Act
(Cap.3)-

1 Citation
(1) These Regulations may be cited as the Traffic (Amendment) Regulations
2009.
(2) The Traffic Regulations, as amended, are in these Regulations referred to as
the Principal Regulations.
2 Regulation 2 amended
Regulation 2 of the Principal Regulations is amended by inserting the following in
the appropriate place:
“company nominee” means an employee of a company designated as responsible
for company vehicles;

3 Regulation 4 amended
Regulation 4 of the Principal Regulations is amended by deleting sub-regulation (1)
and replacing it with the following:
“(1) All applications for the registration of a motor vehicle or trailer shall be made
to the Principal Licensing Authority on Form 1A (if the owner is an
individual) or Form 1B (if the owner is a company) of the First Schedule.”
4 Regulation 4(2) amended
Regulation 4(2) of the Principal Regulations is amended by deleting the words
“Form 1A” and replacing it with “Form 1C”.
5 Regulation 9(1) repealed and replaced
Regulation 9(1) of the Principal regulations is repealed and replaced with the
following:
“(1) All applications for a motor driver’s licence or the renewal thereof shall be
made on Form 5 of the First Schedule, and shall be accompanied by two
passport-size photographs showing the full-face view of the applicant.
Provided that such photographs may be taken by the licensing officer at the
place where the application is made.”
6 Regulation 9(3) amended
Regulation 9(3) of the Principal Regulations is amended by deleting the words
“and have a passport-size photograph affixed to the inside front cover”.
7 Regulation 10(3) amended
Regulation 10(3) of the Principal Regulations is amended by deleting the words
“Chief Police Officer” and replacing it with the words “Principal Licensing
Authority”.

8 Regulation 11(5)(d) amended
Regulation 11(5)(d) of the Principal Regulations is amended by inserting after the
words “Police Officer” the words “or any other person authorised by the Principal
Licensing Authority” .
9 Regulation 19(7)(b) amended
Regulation 19(7)(b) of the Principal Regulations is amended in the English version
only by deleting the word “the” before the words “Bus Depot” and replacing it with
the word “a”.
10 Regulation 19(7)(e) amended
Regulation 19(7)(e) of the Principal Regulations is amended by:
(i) inserting the words “or other bus stop” after the words “Bus Depot”; and
(ii) inserting the words “or other” before the word “Regulations”.
11 Regulation 20(2) amended
Regulation 20(2) of the Principal Regulations is amended by inserting after the
words “Police Officer” the words “or any other person authorised by the Principal
Licensing Authority”.
12 Regulation 20(4) amended
Regulation 20(4) of the Principal Regulations is amended by inserting after the
words “Police Officer” the words “, any person authorised by the Principal
Licensing Authority”.
13 Regulation 20(8)
Regulation 20(8) of the Principal Regulations is amended by inserting after the
words “Principal Licensing Authority” the words “or a Police Officer”.

14 Regulation 37 amended
Regulation 37 of the Principal Regulations is amended by deleting the words “Police
Officer” and replacing it with the words “licensing officer”.
15 Regulation 39(3) amended
Regulation 39(3) of the Principal Regulations is amended by deleting “$100” and
replacing it with “$500”.
14 Regulation 40 amended
Regulation 40 is amended by deleting the provision and replacing it with the
following:
“40. Notwithstanding any amendment made in these Regulations, the Principal
Licensing Authority may authorise the continued use of such forms for such
purposes as are being carried out immediately before the coming into effect of
the Traffic (Amendment) Regulations 2009, until such time as the traffic
computerisation process of the Ministry for Transport is completed for all
districts. Any such use shall continue to be lawful as if the relevant provisions
of the Traffic (Amendment) Regulations 2009 (except the amendment to this
Regulation) were not made.”.
15 First Schedule amended
The First Schedule of the Principal Regulations is amended by deleting FORM 1
and Form 1A and replacing it with the following new FORM 1A, FORM 1B and
FORM 1C.

18 Third Schedule repealed and replaced
The Third Schedule of the Principal Regulations is repealed and replaced with the
following:
“THIRD SCHEDULE
BUS STOP
(i) The areas on the northern side of Vuna Road –
(a) opposite the intersection with Fatafehi Road; and
(b) opposite Fa’onelua Park,
shall be reserved for the exclusive use of passenger buses for the purpose of
embarking and disembarking passengers and shall be marked BUS DEPOT.
(ii) Any other area designated and marked as a Bus Stop in accordance with the
Traffic (Signs) Regulations.”
21 Fourth Schedule repealed and replaced
The Fourth Schedule of the Principal Act is repealed and replaced by the following:
