AN ACT TO AMEND THE TONGA DEFENCE SERVICES ACT 1992 AND
FOR RELATED PURPOSES

BE IT ENACTED by the King and Legislative Assembly of Tonga in the
Legislature of the Kingdom as follows:
1 Short Title
(1) This Act may be cited as the Tonga Defence Services (Amendment) Act
2013.
(2) In this Act the Tonga Defence Services Act 1992, as amended, shall be
referred to as the Principal Act.
2 Short title amended and general amendment
The Principal Act is amended by deleting the words “Tonga Defence Services Act”
and replacing it with “His Majesty‟s Armed Forces Act” wherever appearing.
3 Reference to “Tonga Defence Services” amended
The Principal Act is amended –

(a) in the English version only, by deleting the words “the Tonga Defence
Services” and “The Tonga Defence Services”, wherever appearing, and
replacing them with the words “His Majesty‟s Armed Forces”;
(b) in the Tongan version only, by deleting the words “Kau Tau Malu‟i „a Tonga”
and replacing them with the words “Kau Tau „a „Ene „Afio”.
4 Reference to “Commander” amended
The Principal Act is amended, in the English version only, by deleting the word
“Commander” wherever appearing and replacing it with “Chief of the Defence
Staff”.
5 Reference to “Defence Services Judge” amended
The Principal Act is amended, in the English version only, by deleting the words
“Defence Services Judge” wherever appearing and replacing it with “Defence Force
Judge”.
6 Reference to “Defence Services Orders” amended
The Principal Act is amended by deleting the words “Defence Services Orders”
wherever appearing and replacing it with “Armed Forces Orders”.
7 Reference to “Services” amended
The Principal Act is amended, in the English version only, by deleting the word
“Services” wherever appearing and replacing it with “Force”.
8 Consequential Amendments to Acts
The various Acts listed in column 1 of Schedule 1 shall be amended as set out in the
relevant entry in column 2 of Schedule 1.
9 Consequential Amendments to Regulations and Rules
The various Regulations and Rules listed in column 1 of Schedule 2 shall be
amended as set out in the relevant entry in column 2 of Schedule 2.

deleted and replaced with “His Majesty‟s
Armed Forces”.
Pensions Act In section 19 –
(a) in the English version only, the words
“the Tonga Defence Services” and “Tonga
Defence Services” are deleted and replaced
with “His Majesty‟s Armed Forces”;
(b) in the Tongan version only, the words
“Kau Tau Malu‟i „a Tonga” is deleted and
replaced with “Kau Tau „a „Ene „Afio”.
Price and Wage Control Act In the definition of “employee” the words
“the Tonga Defence Services” is deleted
and replaced with “His Majesty‟s Armed
Forces”.
