ACT TO AMEND THE LEGISLATIVE ASSEMBLY RETIREMENT

BENEFITS SCHEME ACT

BE IT ENACTED by the King and Legislative Assembly of Tonga in the

Legislature of the Kingdom as follows:

1 Short title

(1) This Act may be cited as the Legislative Assembly Retirement Benefits

Scheme (Amendment) Act, 2013.

(2) In this Act, the Legislative Assembly Retirement Benefits Scheme Act, as

amended is referred to as the Principal Act.

2 Section 7 - Term of Appointment amended

Section 7 of the Principal Act is amended by deleting figure “3” and replacing it

with figure “4”.

3 Section 15 – End of Year Reports amended

Subsections (1) and (2) of section 15 are amended by deleting the figure and word

“2 months” wherever they appear and replacing them with the figure and words “3

months”.

4 Section 16 – Review of the Scheme amended

Section 16 of the Principal Act is amended by deleting the words “every 3 years”

and replacing them with the words “by the end of the third year of each

parliamentary term”.

5 Section 19 – Contributions of members and officers amended

Section 19 of the Principal Act is amended –

(a) in subsection (1) by deleting -

(i) the words and comma “in the month of July in the financial year that he

elected to become a contributing person and every year thereafter on

the same month,” ; and

(ii) the word “annually” and replacing it with the word “monthly”.

(b) in subsection (2) by deleting the word “annually” and replacing it with the

word “monthly”; and

(c) in subsection (3) by deleting the word “annually” and replacing it with the

word “monthly”.

6 Section 20 – Contributions of the Legislative Assembly amended

Section 20 of the Principal Act is amended by deleting –

(a) the words “on the month of July in the financial year that a member or officer

elects to become a contributing person and every year thereafter on the same

month”; and

(b) the word “annually” and replacing it with the word “monthly”.

7 Section 22A - amended

Section 22A of the Principal Act is amended by repealing subsection (2).

8 Schedule – amended

The title of the Schedule to the Principal Act is amended by replacing the word

“ANNUAL” with the word “MONTHLY”.
