AN ACT TO AMEND THE LEGISLATIVE ASSEMBLY RETIREMENT
BENEFITS SCHEME ACT

BE IT ENACTED by the King and Legislative Assembly of Tonga in the
Legislature of the Kingdom as follows:
1 Short Title
(1) This Act may be cited as the Legislative Assembly Retirement Benefits
Scheme (Amendment) Act 2014.
(2) In this Act, the Legislative Assembly Retirement Benefits Scheme Act, as
amended is referred to as the “Principal Act”.
2 Section 2 amended
Section 2 of the Principal Act is amended as follows -
(a) the definition of “discontinuance” is amended by deleting subsection (b) of
the definition and replacing it with -
“(b) in relation to an officer, occurs when that officer’s term of employment
ends whether by death, resignation, retirement on medical grounds,
disqualification or dismissal.”.

3 Section 21 amended
Section 21 of the Principal Act is amended by renumbering the current section as
subsection (1) and adding a new subsection (2) immediately thereafter as follows-
“(2) Notwithstanding subsection (1), any contributing person who is not a Member
of the Legislative Assembly may, when the Legislative Assembly dissolves in
accordance with clause 77(1) of the Constitution, upon application to and with
the approval of the Board, receive total benefits from the Fund, in respect of
that period during which he has been a contributing person.”.
