CHAPTER 264

HAWKSBILL CREEK, GRAND BAHAMA (DEEP WATER HARBOUR AND INDUSTRIAL AREA)

(INTERPRETATION OF AGREEMENT) An Act for the removal of doubts as to the

interpretation of certain provisions of an agreement made with the Grand Bahama Port Authority, Limited, dated the 4th day of August 1955, and subsequent amendments thereto.

[Commencement 30th September, 1965] 1. This Act may be cited as the Hawksbill Creek

Grand Bahama (Deep Water Harbour and Industrial Area) Interpretation of Agreement Act.

2. In this Act — “the Agreement” means the Agreement 1 dated the

Fourth day of August A.D. 1955 and made between His Excellency the Honourable An- thony Geoffrey Hopwood Gardner-Brown Act- ing Governor and Commander-in-Chief in and over the Bahama Islands acting for and on behalf of the Government of the Bahama Islands of the one part and The Grand Bahama Port Authority, Limited of the other part and now of record in the Registry of Records in the City of Nassau in Volume 8 at pages 447 to 479 as amended by an Agreement 2 dated the Eleventh day of July A.D. 1960 and made between His Excellency Sir Robert de Stapledon Stapledon Governor and Commander-in-Chief in and over the said Bahama Islands acting for and on behalf of the said Government of the one part and the Port Authority of the other part and now of record in the said Registry of Records in Volume 353 at pages 186 to 350;

“the Port Authority” means the said The Grand Bahama Port Authority, Limited;

“the Government” has the same meaning as in the Agreement.

3. For the avoidance of doubt, it is hereby declared that, for the purposes of any Declaration by the Government made (whether heretofore or hereafter) in accordance with clause 2(19) of the Agreement, such Declaration shall take effect in accordance with the Agreement (and shall be deemed always so to have taken effect) if the land the subject thereof is at the time of such Declaration owned in fee simple by the Port Authority, or, although not then so owned, has at any time prior thereto been so owned.
