INTERNATIONAL PROPERTIES LIMITED (VALIDATION OF CONVEYANCE) Act No. 22 of 1966

INTERNATIONAL PROPERTIES LIMITED (VALIDATION OF CONVEYANCE)

An Act to validate and confirm a conveyance to international properties limited of certain lands situate at Delaport Point in the Western District of the Island of New Providence, one of The Bahama Islands.

[Commencement 12th July, 1966] 1. This Act may be cited as the International Proper-

ties Limited (Validation of Conveyance) Act. 2. In this Act the expression “the Conveyance”

means the conveyance short particulars of which are set out in the First Schedule hereto; “the property” means the property described in the Second Schedule hereto; and “the Company” means International Properties Limited, a Company incorporated under the laws of the Bahama Islands, which has been struck off the Register of Companies under The Removal of Defunct Companies Act.

3. For the avoidance of doubts, it is hereby declared that, notwithstanding the consideration stated in the Conveyance, or the provisions of the Companies Act, or any other matters or objections:

(a) The Conveyance shall for all purposes be deemed to be and always to have been good, valid and effective; and

(b) The property shall for all purposes (whether before or after the passing of this Act) be deemed to have been conveyed to the Company, the Purchaser named in the Conveyance, for an estate in unincumbered fee simple in possession on the date of the Conveyance and accordingly the title of the Company to the said property by virtue of the Conveyance is hereby confirmed and validated.

4. All claims (if any) to the property adverse to the Company or to its successors in title that may heretofore have arisen or become vested in any person or persons (whether the Treasurer of The Bahamas or any other person) as a result of any lack or inadequacy of consideration for the Conveyance, or as a result of the provisions of the Companies Act, are hereby extinguished.

5. Nothing in this Act shall prejudice or affect the rights —

(a) of Her Majesty The Queen, Her Heirs and Successors; or

(b) of any bodies, politic and corporate or any other persons except such as are mentioned in this Act and those claiming by, from and under them.

ALL THAT piece parcel or lot of land situate in the Western District of the Island of New Providence aforesaid being part of a tract of land known as “Delaport Point Plantation” of Delaport Yard” bounded on the Southeast by the land described in paragraph 3 of this Schedule on the East partly by land formerly the property of Charles E. L. Porteous, deceased, and subsequently the property of Anthony J. Drexel and partly by the sea on the Southwest partly by the land described in paragraph 3 of this Schedule and partly by land formerly the property of Enoch Johnson and subsequently the property of the Munroe Fibre Company Limited and subsequently the property of Delaport Point Company Limited and immediately hereafter described and on all other sides by the sea, the said piece parcel or lot of land being delineated and shown coloured pink on the plan attached to an Indenture of Conveyance dated the 17th day of January, 1922 and made between Francis Abraham William Holmes (commonly

known as Frank Holmes) of the first part Una Beatrix Holmes of the second part and Berta Ulrica Holmes of the third part and Adelaide Stewart Robinson of the fourth part and now recorded in the Registry of Records in the City of Nassau in the Island of New Providence aforesaid in Book 0.11 at pages 571 to 573.

2. ALL THAT piece parcel or lot of land situate in the Western District of the Island of New Providence aforesaid and being a part of the tract of land known as “Delaport” or “Delaport Point Plantation” or “Delaport Yard” and bounded on the “ South by land immediately hereafter described and running thereon One hundred and Twenty-five (125) feet on the West by another portion of the said tract of land formerly the property of Frank Huyler on the North by the sea and running thereon One hundred and Twenty-five (125) feet and on the East or Northeast by another portion of the said tract of land immediately hereinbefore described.

3. ALL THAT piece parcel or lot of land situate in the Western District of the Island of New Providence aforesaid being delineated on that part which is coloured red on a plan attached to an Indenture of Conveyance dated the 20th day of November, 1935 and made between the Public Board of Works for the Island of New Providence of the one part and the said Adelaide Stewart Robinson of the other part and now recorded in the said Registry of Records in Book W. 13 at pages 181 to 183.
