IMMIGRATION (FEES) REGULATIONS

(SECTION 45) [Commencement 1st January, 1976]

1. These regulations may be cited as the Immigration (Fees) Regulations.

2. In these Regulations — “the Act” means the Immigration Act, and “section”

means section of the Act; “dependant” means the wife or child of a person who

is not a citizen of The Bahamas, where such wife or child is not engaging, or is not proposing to engage, in gainful occupation in The Bahamas;

“passenger” means any person carried on a passenger ship other than a person employed or engaged in any capacity on board the ship on the business of the ship;

“passenger ship” means any ship or boat or any other description of vessel used only for carrying from and to any port or place in The Bahamas not less than two hundred passengers.

“permanent residence certificate” means a certificate granted under section 13(1);

“residence permit” means a permit granted under section 30(1)(a);

“work permit” means a permit granted under section 30(1)(b) or (c).

3. (1) Subject to paragraphs (2), (3) and (4), there shall be charged, collected and paid into the Treasury for the credit of the Consolidated Fund in respect of each of the matters set forth in the first column of the Schedule, the respective fees set forth opposite thereto in the second column of the Schedule.

(2) Fifty per centum of the fees paid into the Consolidated Fund pursuant to paragraph (1) in respect of fees collected in any Family Island shall be paid out of the Consolidated Fund and applied to meet expenditure for public works in any Family Island.

(3) Where a person to whom a work permit was granted under the Act was employed for a period not exceeding one-third of the duration of the permit, the Board may, on the grant of a new permit to another person to replace that person and on the payment of the fee therefor, credit such person with that portion of the fee paid in respect of the permit for the person whom he replaced which was outstanding at the date of the grant of the new permit.

(4) Where by reason of the variation of a condition of a permit under section 32 a change occurs in the occupation of the holder of the permit, such holder shall pay in respect of the remainder of the duration of the permit the difference, if any, between the amount of the fee payable for the permit in his former occupation and that in his new occupation, in accordance with the scales specified in the Schedule.

FEES

1. For a Permanent Residence Certificate for a person other than a person specified in paragraphs 2 to 6 $10,000

2. The Permanent Residence certificate for a person who resided in the country for at least 10 and less than 20 years and who (other than a teacher, including a teacher engaged by a religious or charitable organization or by the Government of the Bahamas, or a permit in any of the scales 9 to 11 hereunder, or who is employed by the Government of The Bahamas as a nurse, policeman or prison overseer) holds a work permit in any of the scales 5 to 8 hereunder $5,000

3. For a Permanent Residence certificate for a person who has resided in the country for at least 10 and less than 20 years and who holds or previously held a work permit as a teacher in scale 7 hereunder, including a teacher engaged by a religious or charitable organization or by the Government of the Bahamas, or a permit

in any of the scales 9 to 11 hereunder, or who is employed or was previously employed by the Government of The Bahamas as a nurse, policeman or prison overseer $1,000

4. For a Permanent Residence certificate for a person who has resided in the country for at least 20 years and who holds or previously held a work permit— (a) in any of the scales 5 to 8 hereunder (other than as a

teacher) $1,000 (b) in any of the scales 9 to 11 hereunder $500 (c) as a teacher in scale 7, including a teacher engaged by a

religious or charitable organization $500 5A. For a Permanent Residence certificate for a person

who resided in the country for at least 20 years and who is employed or was previously employed by the Government of The Bahamas as a teacher, nurse, policeman or prison overseer $500

5B. For a Permanent Residence certificate for a person to whom section 7 of the Bahamas Nationality Act applies (not including a person referred to in the Proviso to that section) $50

6. For a Permanent Residence certificate for a person who resided in the country for at least 20 years and who works as a priest, minister of religion, missionary or a member of a cloistered order $500

7. For a Permanent Residence certificate for the spouse of a Bahamian Citizen — (a) to whom section 14 of the Act applies $250 (b) in any other case $5000

8. For a Permanent Residence certificate for a person who was born outside The Bahamas whose mother is a Bahamian citizen $250

9. For each endorsement under section 16 of a permanent residence certificate $25

10. For a duplicate of any certificate $25 11. For a duplicate of a permit $25 12. For processing application for permits and certificates $100 13. Subject to paragraphs 11, 12, 13 and 14, for a

residence permit for any person for each year or any part thereof $1,000

14. For a residence permit for a dependant for each year or part thereof $25

15. For a residence permit for the spouse of a Bahamian citizen for each year or any part thereof $25

16. For a residence permit for a child of the spouse of a Bahamian citizen for each year or any part thereof $25

17. For a residence permit for a person attending an institution of higher learning in The Bahamas on a full-time basis or as a trainee, on the certification to that effect of the Minister responsible for education for each year or any part thereof $25

18. Subject to paragraphs 16, 17 and 18, for a work permit for any person holding an occupation specified in the scales hereunder — (a) for each period of one year or any part thereof exceeding

eleven months the fees set forth in respect of that occupation in such scale;

(b) for a period not exceeding one month one fifty-second of such fees per week or part thereof

(c) for a period exceeding one month but not exceeding eleven months one-twelfth of such fees per month or part thereof. 19. For a work permit for a person employed by any

religious or educational or charitable organization or engaged in a short term film production approved by the Minister of Tourism such organization or film production being designated by the Board in writing for the purpose of this paragraph, in respect of an occupation so designated Nil

21. For a permit granted pursuant to section 30(2) and (3) of the Act for the spouse of a Bahamian citizen $250

IMMIGRATION (VESSELS RESTRICTION) REGULATIONS

(SECTION 45) [Commencement 12th November, 1980]

1. These Regulations may be cited as the Immigration (Vessels Restriction) Regulations.

2. In these Regulations — “Bahamian” in relation to a specified vessel means a

vessel wholly owned by persons or authorities who are — (a) citizens of The Bahamas; or (b) bodies corporate established under the laws

of The Bahamas, and having their principal place of business in The Bahamas, of which the beneficial ownership belongs wholly to citizens of The Bahamas;

“from any port or place in Haiti”, in relation to any vessel entering or arriving in The Bahamas, means any vessel which enters or arrives in The Bahamas from a port or place in Haiti whether that vessel has come from Haiti directly or indirectly;
