CHAPTER 15

INTERNATIONAL ORGANISATIONS (IMMUNITIES AND PRIVILEGES OF CERTAIN

OFFICERS) An Act to extend certain immunities and privileges to

officers provided by international organisations for service in The Bahamas.

[Assent 6th March, 1965] [Commencement 1st January, 1963]

1. (1) This Act may be cited as the International Organisations (Immunities and Privileges of Certain Officers) Act.

(2) This Act shall be deemed to have had effect as from the first day of January, 1963.

2. In this Act, unless the context otherwise requires — “International organization” means The United Nations

Organization, The United Nations Educational, Scientific and Cultural Organization and any other organization declared by Order of the Governor- General to be an Organization of which the United Kingdom or Her Majesty’s Government therein and one or more foreign sovereign powers or the government or governments thereof are members;

“Minister” means the Minister responsible for For- eign Affairs.

3. (1) Whenever any person is provided for appointment to the public service of The Bahamas in pursuance of an agreement entered into between an international organization and the Government of The Bahamas, it shall be lawful for the Governor-General by Order to confer upon any such person, to such extent as may be specified therein, the immunities and privileges set out in the Schedule to this Act.

(2) The immunities and privileges specified in para- graph 2 of the Schedule to this Act, when conferred upon any such person by Order of the Governor-General under the provisions of this section, may also be conferred to the extent specified in such Order upon a husband or wife of such person and upon any relative named therein who appears to the Governor-General to be dependent upon such person for support.

(3) Every Order made by the Governor-General under the provisions of this section shall be published by the Minister in the Gazette and shall state the date from which the immunities and privileges thereby conferred shall take effect.

(4) Whenever any person ceases to be entitled to the immunities and privileges conferred by an Order of the Governor-General made under the provisions of this section the Minister shall cause a notice to that effect to be published in the Gazette.

4. The fact that any person is or was entitled or not entitled to any of the immunities or privileges set out in the Schedule to this Act may be conclusively proved by producing the Gazette containing the relevant Order made by the Governor-General or the notice published under subsection (4) of section 3 of this Act, as the case may be.

SCHEDULE (Section 3)

IMMUNITIES AND PRIVILEGES 1. Immunity from legal process in respect of all words

spoken or written and all acts performed by the officer in his official capacity.

2. The privilege of importing furniture and effects free of all duties of customs levied under the Tariff Act, the Stamp Act or any other Act amending or replacing any of the same, at the time of the officer first taking up his post in the public service of The Bahamas.
