CHAPTER 17

CARIBBEAN COMMUNITY An Act to enable The Bahamas to fulfil certain

obligations arising under the Treaty of Chaguaramas. [Commencement 31st December, 1986]

1. This Act may be cited as the Caribbean Commu- nity Act.

2. In this Act — “the Community” means the Caribbean Community

established under the Treaty; “the Secretariat” means the Secretariat of the

Community; “the Treaty” means the Treaty signed on the 4th July,

1973 at Chaguaramas, Trinidad, by the representatives of the respective Governments of Barbados, Guyana, Jamaica and Trinidad and Tobago and to which the Government of The Bahamas acceded by instrument dated the 4th July, 1983.

3. (1) The Community shall possess full juridical personality and in particular, the capacity — (i) to contract; (ii) to acquire and dispose of immovable and

movable property; (iii) in its own name to institute or otherwise

be a party to legal proceedings and to be represented therein by the Secretary-Gen- eral to the Secretariat.

(2) Without prejudice to subsection (1), the Community shall be deemed an Organisation within the meaning of the International Organisations (Immunities and Privileges) Act and any Order that may be made under section 3(2) of that Act may contain such provisions as are requisite for the purpose of enabling The Bahamas to carry out any of its obligations relating to the immunities and privileges to be enjoyed by the Community under the provisions of the Treaty or any Protocol thereto.
