DEFENCE (EVIDENCE) REGULATIONS

(SECTIONS 174, 184 and 205) [Commencement 20th September, 1984]

1. These Regulations may be cited as the Defence (Evidence) Regulations.

2. In these Regulations unless the context otherwise requires —

“Provost officer” includes a Regulating Officer. 3. Where under section 173 of the Defence Act a

magistrate’s court has dealt with a person as illegally absent, the certificate which is required by subsection (1) of section 175 of the Defence Act shall be in the form specified in Part I of the First Schedule and shall contain the particulars there set out of his arrest or surrender and of the proceedings before the court.

4. Where under section 174 of the Defence Act a person is delivered into custody without being brought before a magistrate’s court, the certificate which is required by subsection (2) of section 175 of the Defence Act shall be in the form specified in Part II of the First Schedule and shall contain the particulars there set out relating to his surrender.

5. Where a person has been taken into custody on arrest or surrender, the certificate which is required by paragraph (b) of subsection (3) of section 175 of the Defence Act shall be in the from specified in Part III of the First Schedule and shall contain the particulars there set out relating to his arrest or surrender.

6. The service books or other documents in which records may be made for the purposes of subsection (5) of section 184 of the Defence Act, which deals with admissibility of records in evidence, shall be those listed in the Second Schedule.
