THE BAR ARTICLES (PERIOD OF SERVICE) REGULATIONS, 1994

(SECTION 43) [Commencement 16th December, 1994]

1. These regulations may be cited as the Bar Articles (Period of Service) Regulations, 1994.

2. (1) The period to be served under articles for the purpose of qualifying for admission to practice shall be —

(a) in the case of a person mentioned in paragraph (a) of Part C of the First Schedule to the Act, eighteen months;

(b) in the case of any other person, five years. (2) Notwithstanding paragraph (1), the Bar Council,

on an application in respect of an articled clerk who has passed all examinations qualifying him for admission to practice and has otherwise satisfied all other requirements imposed on his articles, may waive any period of that clerk’s articles upon such terms and conditions as the Bar Council may impose.

3. An application for waiver pursuant to paragraph (2) of regulation 3 shall be made by the counsel and attorney whom the articled clerk is serving and the application shall, in addition to any other information that the counsel and attorney may wish the Bar Council to consider, include a brief summary of the articled clerk’s experience in the law.
