Regulations on Satellite Broadcasting Program Supplier Broadcasting Domestically-Produced Programs

Article 1


These Regulations are formulated pursuant to Paragraph 4, Article 8 of Satellite Broadcasting Act (hereinafter referred to as the Act).


Article 2


While undertaking program planning, satellite broadcasting program supplier businesses (referred to hereinafter as "program supplier") shall consider content diversity, protect human dignity, fulfill social responsibilities, and safeguard national culture.


Article 3


In order to safeguard national culture, the programs broadcasted by program suppliers shall conform to the ratio of domestically-produced (Republic of China) programs stipulated by the competent authority.


Article 4


The domestically-produced programs mentioned in the preceding article refer to the programs produced by domestic producers and shall be identified according to the standards in the following order:
1.The country of such program shall be identified based on the main actors (leading actor and supporting actor) of the same nationality exceeding one third of the total number of main actors, or the producer, director and screenwriter of the same nationality or region exceeding one third of the total number of aforesaid positions.
2.The original country of such program shall be identified based on the highest number of main actors (leading actor and supporting actor) of the same nationality.
3.The original country of such program shall be identified based on the total highest number of producers, director, screenwriters and main actors (leading actor and supporting actor) being of the same nationality.
4.The original country of such program shall be identified based on the total highest number of producers and director being of the same nationality.
5.The original country of such program shall be identified based on the original country of the business people, juridical persons, organization or other institution of program production.
6.The original country or region of such program shall be identified based on the original nationality of the investor with the largest capital contribution.
For sports programs, should the presenters or commentators be nationals of the Republic of China, they shall be deemed as domestically-produced programs and shall not be restricted by the identification standards aforementioned in preceding paragraphs.
For music video programs, should the presenters or commentators be nationals of the Republic of China and the program falls under any one of the following circumstances, they will be deemed as domestically-produced program:
1.Nationals of the Republic of China sing the main music or lyrics.
2.Nationals of the Republic of China participate in the arrangement of the music.
3.Nationals of the Republic of China participate as lyricists.
4.A live concert recorded within the territory of the Republic of China.


Article 5


If the individual channel operated by a program supplier broadcasts the following types of programs at the designated broadcasting time, the ratio of domestically-produced programs shall not be lower than twenty-five percent; the ratio of new broadcasts thereof shall not be lower than forty percent. For broadcasts of movies (including documentaries) at designated time only, the ratio of domestically-produced programs shall not be lower than twenty-five percent; the ratio of new broadcast thereof shall not be lower than twenty percent.
1.Drama.
2.Movie (including documentary).
3.Variety.
4.Children.
If the licensed operation plan has already specified that the channel provides foreign programs as its operation objective, it shall not be restricted by the preceding paragraph.
The designated broadcasting time for the programs listed in Subparagraph 1 and Subparagraph 3 of Paragraph 1 shall be from eight to ten pm each evening; the designated broadcasting time for the programs listed in Subparagraph 2 shall be from nine to eleven pm each evening; the designated broadcasting time for the programs listed in Subparagraph 4 shall be from five to seven pm each evening.
The new broadcast aforementioned in Paragraph 1 refers to programs broadcasted for the first time by domestic cable broadcasting and television system operators (including the cable TV program broadcasting system), direct satellite broadcasting service business or other audiovisual broadcasting platform businesses for the public.
When a program is co-produced by different program suppliers that invest over thirty percent capital, the program broadcast for the first time in the suppliers’ own channel will be deemed as new broadcast respectively.
The ratio specified in Paragraph 1 shall be calculated according to the broadcasting hours in each channel every half year.
For the ratio restriction aforementioned in Paragraph 1, the competent authority may adjust it according to the production situation of domestically-produced programs, audience demand or other circumstances.


Article 6


During the calculation period aforementioned in the preceding article, program suppliers shall report the actual broadcasting situations to the competent authority periodically.


Article 7


These Regulations shall be effective from January 8, 2017.
