AN ACT TO AMEND THE JUDICATURE ACT , No. 2 OF 1978

BE it enacted by the Parliament of the Democratic Socialist Republic of Sri Lanka as follows :-

[30th August , 1999 ]
Short title.

1. This Act may be cited as the Judicature (Amendment) Act, No. 27 of 1999.

Amendment of section 48 of Act No. 2 of 1978.

2. Section 48 of the Judicature Act, No. 2 of 1978, is hereby amended, by the repeal of the proviso to that section and the substitution therefor, of the following proviso :-

"Provided that where any criminal prosecution, proceeding or matter (except on an inquiry preliminary to committal for trial) is continued before the successor of any such judge, the accused may demand that the witnesses be resummoned and reheard.".

Sinhala text to prevail in case of inconsistency.

3. In the event of any inconsistency between the Sinhala and Tamil texts of this Act, the Sinhala Text shall prevail.
