AN ACT TO AMEND THE SRI LANKA NURSES COUNCIL.Act, NO. 19 OF 1988

BE it enacted by the Parliament of the Democratic Socialist Republic of Sri Lanka as follows :

Short title.

1. This Act may be cited as the Sri Lanka Nurses Council (Amendment) Act, No. 35 of 2005.

Amendment of section 3 of Act, No. 19 of 1988.

2. Section 3 of the Sri Lanka Nurses Council Act, No. 19 of 1988 is hereby amended as follows :

(1) in paragraph (ii) of that section, by the substitution for the words "Ministry of Health and the Ministry of Teaching Hospitals", of the words "Ministry of Health and the Provincial Public Service,";

(2) in paragraph (iii) of that section, by the substitution for the words "Ministry of Health ;" of the words "Ministry of Health and the Provincial Public Service;";

(3) in paragraph (iv) of that section, by the substitution for the words "Ministry of Health ;" of the words "Ministry of Health and the Provincial Public Service;";

(4) by the repeal of paragraph (v) of that section, and by the substitution therefor of the following :

"(v) a registered practicing nurse

(a) who is employed in the Provincial Public Service;

(b) who has experience in the practice of nursing for a period of not less than twelve years ; and

(c) who has obtained a prescribed postgraduate qualification,

elected by the nursing officers in the Provincial Public Services ;";

(5) by the repeal of paragraph (vii) of that section, and by the substitution therefor of the following :

"(vii) five registered practicing nurses elected by the staff nursing officers in the Department of Health and in the Provincial Public Service, from among the staff nurses in the Department of Health and in the Provincial Public Service, having at least five years experience in the practice of nursing.

(6) by the repeal of paragraph (x) of that section ;

(7) by the repeal of paragraph (x v), of that section ; and

(8) in paragraph (xvi) of that section, by the substitution for the words "Department of Ayurveda", of the words "Department of Ayurveda and the nursing officers belonging to the Provincial Public Service who are serving in Ayurvedic Hospitals of the Provincial Councils".

Sinhala text to prevail in case of inconsistency.

3. In the event of any inconsistency between the Sinhala and Tamil texts of this Act, the Sinhala text shall prevail.
