AN ACT TO AMEND THE CODE OF CRIMINAL PROCEDURE. Act,NO.15 OF 1979

BE it enacted by the Parliament of the Democratic Socialist Republic of Sri Lanka as follows :-

Short title.

1.This Act may be cited as the Code of Criminal Procedure (Amendment) Act, No. 21 of 2005.

Amendment of section 14 of the principal enactment

2. Section 14 of the Code of Criminal Procedure Act, No. 15 of 1979 (hereinafter referred to as the " principal enactment") is hereby amended as follows :-

(a) by the repeal of paragraph (c) of that section; and

(b) in paragraph (d) of that section by the substitution for the words "any two of the sentences" of the words "any of the sentences".

Repeal of sections 285 (2), 294, 295, 296. 297, and 298 of the principal enactment.

3. Subsection (2) of section 285, sections 294, 295, 296, 297 and 298, of the principal enactment are hereby repealed.

Amendment of section 299 of the principal enactment

4. Section 299 of the principal enactment is hereby amended in subsection (3) of that section by the substitution for the words " when a sentence of death or of fine or whipping with or without imprisonment is passed on an escaped convict, such sentence, if of death, fine or whipping shall subject to the provisions hereinbefore contained take effect immediately;" of the words "when a sentence of death or of fine with or without imprisonment is passed on an escaped convict, such sentence, if of death or fine shall subject to the provisions hereinbefore contained take effect immediately ;"

Amendment of section 317 of the principal enactment

5. Section 317 of the principal enactment is hereby amended as follows :-

(1) by the repeal of paragraph (a) of subsection (1) of that section ; and

(2) in subsection (2) of that section, by the substitution for of the words "all cases except in the case referred to in paragraph (a) of subsection (1)." of the words "all cases".

Sinhala text to prevail in case of inconsistency

6. In the event of any inconsistency between the Sinhala and Tamil texts of this Act, the Sinhala text shall prevail.
