GENERAL EXPLANATORY NOTE:

ACT To amend the Road Accident Fund Act, 1996, so as to render the representation of the national Department of ‘lkansport on the Board of the Road Accident Fund more flexible; to decrease the minimum number of appointed members of the Board from 11 to eight; to facilitate the filling of an occasional vacancy on the Board; and to provide for matters connected therewith.
BE IT ENACTED by the Parliament of the Republic of South Africa, asfollows:— Amendment of section 10 of Act 56 of 1996
1. Section 10 of the Road Accident Fund Act, 1996 (Act No. 56 of 1996), is hereby amended by—
(a) the substitution for paragraph (a) of subsection(1) of the following paragraph: “(a) The Director-General: Transport or any other senior officer in the
Department of Transport, desismated by him or her for a particular purpose; and”;
(b) the substitution for paragraph (b) of subsection(1) of the following paragraph: “(b) at least [11] ~, but not more than 12, members appointed by the Minister,
taking into account the recommendations referred to in subsection (9), ~ applicable, who may not be in the full-time employment of any government, and who shall each command extensive experience in one or more of the fields of insurance, finance, medical service provision, law, accounting and actuarial science, or in matters relating to disabled persons, road users, commuters’ or consumers’ interests.”;
(c) the substitution for the words preceding paragraph (a) of subsection (9) of the following words:
“(9) Whenever it is necessary to appoint a member referred to in subsection (1)(b) to the Board, but subject to subsection ( 10)—”; and
(d,) the addition of the following subsection:

“(10) Whenever a position on the Board becomes vacant before the expiry of the term of office referred to in subsection (2)(c), the Minister may appoint any other competent person, as contemplated in subsection 25 (l)(b), to serve for the unexpired portion of the term of office of the previous member irrespective of when the vacancy occurs.”.
Short title
2. This Act is called the Road Accident Fund Amendment Act, 2002.
