PURSUANT to section 45(1) of the Road Traffic Ordinance
1960, I, TUI ATUA TUPUA TAMASESE EFI, Head of
State, acting by and with the advice of Cabinet, MAKE the
following Regulations:-

REGULATIONS

1. Title and commencement-(1) These Regulations may be
cited as the Road Traffic (Breathalyser) Regulations 2009.

(2) These Regulations commence on the commencement of
the Road Traffic (Breathalyser) Amendment Act 2009.

2. Interpretation – For the purposes of Part II of the Road
Traffic Ordinance 1960, unless the context otherwise requires:
“approved analyst” means:
(a) a person who is the analyst in charge of an approved
laboratory; or
(b) a person who works in an approved laboratory and
who is authorised, by the analyst in charge of
that laboratory, to act as an approved analyst,
either generally or in a particular case; and
“approved laboratory” means a laboratory approved by the
Minister of Health, by notice in the Savali, for the
purposes of analysing blood specimens taken for the
purposes of this Act.

Date of Commencement: These Regulations commence on
the commencement of the Road Traffic (Breathalyser)
Amendment Act 2009.
