AN ACT to amend the Road Traffic Ordinance 1960
concerning the Transport Control Board, the validity of
certain traffic orders and to provide for consequential
amendment of the Road Transport and Traffic Control
Act 1990. [28 January 2003]

BE IT ENACTED by the Legislative Assembly of Samoa in
Parliament assembled as follows:-

1. Short title and commencement-(1) This Act may be
cited as the Road Traffic Amendment Act 2003 and save for
section 5 shall be read with and form part of the Road Traffic
Ordinance 1960 (the principal Act).
(2) This Act shall come into force on the day it is assented
to by the Head of State.

(3) Notice of commencement of this Act shall be published
in Samoan and English in the Savali and one other newspaper
circulating in Samoa.

2. Accountability of the Transport Control Board –
Section 51 of the principal Act is amended by inserting the
following after subsection (3):
“(4) The Board shall report to and be accountable to the
Minister in accordance with the provisions of this
Ordinance.”

3. Functions and Annual Report of the Board – Section
53 of the principal Act is amended:
(1) By inserting the expression “(1)” before the words “The
Board shall”.
(2) By replacing the full stop at the end of paragraph (d)
with a semi-colon.
(3) By inserting the following after paragraph (d):
“(e) With the consent of the Minister, make traffic
regulations, orders and rules in accordance with
the provisions of this Ordinance; and
(f) By September 30th
of each year prepare and provide
to the Minister an Annual Report of the work of
the Board for the 12 months ending on June 30th
.
(2) The Minister shall table the Annual Report of the Board
in Parliament within 14 days of the Minister receiving the
Annual Report the Annual Report and, where Parliament is not
sitting, within seven days of the commencement of the next
sitting.”

4. Power to make traffic orders – Section 73(1) of the
principal Act is amended by inserting the following after
paragraph (k):
“(l) Such other purposes concerning any area of traffic
regulation, traffic management and road usage
not provided for under paragraphs (a) to (k) of
this subsection.”

5. Validity of certain traffic orders – The Road Traffic
Orders 1994 SR 1993/9 shall be taken for all purposes to have
been validly made and to have full force and effect.

6. Consequential amendment – Section 4 of the Road
Transport and Traffic Control Act 1990 is amended by deleting
all words after the words “Ministry of Transport Act 1978 is
repealed”.
