BY THE PRESIDENT OF THE PHILIPPINES

EXECUTIVE ORDER NO. 70

TRANSFERRING CERTAIN FUNCTIONS OF THE OFFICE OF THE PRESIDENT TO HEADS OF DEPARTMENTS, OFFICES AND ENTITIES.

In order to streamline the functions of the Office of the President and in accordance with the policy of decentralization, I, FERDINAND E. MARCOS, President of the Philippines, do hereby order the transfer of the following functions now being undertaken by the Office of the President to the heads of departments, offices or entities as indicated hereunder:

Function

Office to Handle

1.
Request for issuance of allocated motor vehicles plate numbers.
Delegated to Land Transportation Commissioner.

2.
Matters relative to the issuance of permits to national government officials to possess firearms, and to dealers in firearms, ammunition and explosives.
The Chief of Constabulary shall act for the President.

3.
Matters relative to the issuance of permits to local government officials to possess firearms and to dealers in firearms, ammunition and explosives.
The Chief of Constabulary shall act for the President.

4.
Matters relative to forfeiture of certificate of deposit issued as security for licensed firearms under Section 901 of the Revised Administrative Code, and surrender of bond or certificate of deposit issued as security for a licensed firearm under Section 904 of the Revised Administrative Code.
The Chief of Constabulary shall act for the President.

5.
Claims for benefits under Section 699 of the Revised Administrative Code and on applications for permission to teach, exercise profession, or engage in business outside of office hours or acquire public lands, of personnel of offices and entities under the Office of the President the heads of which have been conferred the rank of Department Head or Secretary.
Delegated to heads of such offices or entities.

6.
Requests for authority for local travel not exceeding three months of personnel of offices and entities under the Office of the President whose heads have been conferred the rank of Department Head or Secretary.
Delegated to heads of such offices or entities.

7.
Requests for the transfer of property between different offices or agencies under the Office of the President pursuant to Section 641 of the Revised Administrative Code, the heads of which have the rank of Department Head or Secretary.
Delegated to heads of such offices or entities.

8.
Requisitions of offices or entities under the Office of the President, the heads of which have the rank of Department Head or Secretary.
Delegated to heads of such offices or entities.

9.
Requests for authority to grant meal allowance for overtime services rendered in offices or entities under the Office of the President the heads of which have the rank of Department Head or Secretary.
Delegated to heads of such offices or entities.

10.
Matters relative to the payment of prior year’s obligations as provided under Section 7-I (27) of C.A. No. 246 for offices or entities under the Office of the President the heads of which have the rank of Department Head or Secretary.
Delegated to heads of such offices or entities.

11.
Requests of local government officials for authority to grant local personnel meal allowances in lieu of additional compensation while rendering overtime service.
Transfered to Provincial Governors and City Mayors.

12.
Requests for use of the AFP band.
Delegated to the Secretary of National Defense.

13.
Prison matters, including the confinement of provincial and municipal prisoners in the National Prison and vice-versa, reports and inspection of local jails, recommitment of pardoned prisoners for violation of conditions of pardons, classification of prisoners, and requests of prisoners to go out of prison under guard to view remains of deceased relatives.
Delegated to the Secretary of Justice who shall sign “By authority of the President.”

14.
Matters relative to franchises for public utilities granted by the municipal councils and submitted for the approval of the President.
Delegated to the Secretary of Justice.

15.
Requests for authority appoint special policemen by private firms or semi-government institutions.
Transferred to Police Commission.

16.
Matters relative to negotiated contracts for services or for furnishing supplies, materials and equipment to the government involving an amount of P50,000 or less for National Government agencies and P100,000 or loss for government-owned or controlled corporations.
Delegated to the Secretary of General Services for National Government agencies and to Administrator of Economic Coordination for government-owned or controlled corporation.

17.
Matters relative to negotiated contracts wherein the government is required to make advance payment for services not yet rendered and/or supplies and materials not yet delivered involving an amount of P50,000 or less for National Government agencies and P100,000 or less for government-owned or controlled corporations.
Delegated to the Secretary of General Services for National Government agencies and to the Administrator of Economic Coordination for government-owned or controlled corporations.

18.
Contracts for the lease of private buildings, rooms, lots or spaces for use by National Government agencies and government-owned or controlled corporations.
Delegated to the Secretary of General Services for National Government agencies and to the Administrator of Economic Coordination for government-owned or controlled corporations

The provisions of Executive Order No. 298 dated August 12, 1940, as amended, Executive Order No. 201 dated January 14, 1949, and Executive Order No. 175 dated November 11, 1930, and rules and regulations as are in conflict herewith are hereby modified or repealed accordingly.
