PRESIDENTIAL DECREE No. 680

RECLASSIFYING PORTIONS OF THE FORESHORE LAND IN (1) LO-OC, LAPU-LAPU CITY ISLAND OF MACTAN, (2) BARRIO SASA, CITY OF DAVAO, PROVINCE OF DAVAO, (3) BARRIO PUNTA, MUNICIPALITY OF APPARI, PROVINCE OF CAGAYAN (4) BARRIO BANAGO, BACOLOD CITY, PROVINCE OF NEGROS OCCIDENTAL AND (5) SITIO OF MIPUTAK POBLACION, CITY OF DIPOLOG, ZAMBOANGA DEL NORTE, AS LAND FOR COMMERCIAL OR INDUSTRIAL PURPOSES AND CONVEYING THE SAME AND THE IMPROVEMENTS THEREON TO NATIONAL DEVELOPMENT COMPANY AND FOR OTHER PURPOSES.

WHEREAS, the Secretary of Natural Resources has recommended a re-classification of portions of the foreshore land in (1) Lo-oc, Lapu-Lapu Island of Mactan, (2) Barrio Sasa, City of Davao, (3) Barrio Punta, Municipality of Appari, Province of Cagayan, (4) Barrio Banago, Bacolod City, Province of Negros Occidental and (5) Sitio of Miputak Poblacion, City of Dipolog, Zamboanga del Norte, as land for commercial and industrial purposes under Chapter IX, Title III of Commonwealth Act No. 141 as amended, otherwise known as the Public Land Act, as the same have ceased to be foreshore land;

WHEREAS, Section 9 of the Public Land Act empowers the President, upon recommendation of the Secretary of Natural Resources, to classify or reclassify from time to time or at any time all alienable or disposable lands of public domain;

WHEREAS, the National Development Company, under Presidential Decree No. 668, dated March 7 1975 is authorized to acquire, hold, develop and dispose all lands acquired by citizens of theUnited Statesunder the Laurel-Langley Agreement before its expiration on July 3, 1974;

NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by the Constitution, do hereby order and decree:

Section 1. The following portions of the foreshore lands in:

(1) A parcel of land, Lot 1, potion of Lot 463 P.S. Cad-11, situated in the Barrio of Lo-oc, Lapu-Lapu City Island of Mactan. Bounded on the north, Lot 2 of this survey; on the east by Lot 464-P.S. Cad-11; on the south byLot463-P.S. Cad-11; and on the west by Lot 463 P.S. Cad-11. Section 2. The lands hereinabove described and delineated shall be surveyed by the Bureau of Lands to ascertain their accurate location boundaries and areas and whether in fact the same are reclaimed areas and covered by foreshore leases. Thereafter the reclaimed lands so verified shall be conveyed in absolute ownership to the National Development Company for the nominal sum of One Peso (P1.00) for each parcel of land conveyed under the proper Register of Deeds shall register the same and issue the corresponding certificate of title to the National Development Company.

Section 3. Any provision of law, proclamation, ordinance, rules and regulations to the contrary notwithstanding, the National Development Company may transfer absolute ownership of any portion or portions of lands herein above described and convey the same to persons or corporations qualified to acquire land under the Constitution, or lease the same or any portion or portions thereof to any person or corporation for commercial or industrial purposes only.

Section 4. All laws, executive orders, proclamations, rules and regulations or part thereof inconsistent with this Decree are hereby repealed and/or modified accordingly.

Section 5. This Decree shall take effect immediately.
