MEMORANDUM ORDER NO. 292

DIRECTING THE BUREAU OF CUSTOMS TO SUPPORT MANDATORY NIGHT TIME CARGO HAULING OPERATIONS TO AND FROM THE PORT OF MANILA

WHEREAS, under National Emergency Memorandum Order (NEMO) No. 15, the Secretary of Transportation and Communications was designated as the Cabinet official primarily responsible for traffic management and traffic law enforcement on all national roads in Metropolitan Manila;

WHEREAS, pursuant to NEMO No. 15, the Secretary of Transportation and Communications has issued DOTC Memorandum Circular No. 90-359 providing for mandatory night time cargo hauling and delivery operations to and from the Port of Manila;

WHEREAS, there is an imperative need to provide adequate service to enable port users and cargo handlers to fully comply with DOTC Memorandum Circular No. 90-359;

WHEREAS, the Bureau of Customs is the government agency authorized to provide such services;

WHEREAS, there is an urgent need to clear and decongest the Port of Manila of overstaying, seized and abandoned cargoes;

NOW, THEREFORE, I, CORAZON C. AQUINO, President of the Republic of the Philippines, by virtue of the powers vested in me by law, do hereby order the Commissioner of Customs:

SECTION 1. To require authorized personnel in his bureau to provide needed services to port users and cargo handlers in the Port of Manila on a 24-hour basis daily, including Saturdays, Sundays and holidays, such as:

a. processing of import and export documents;

b. collection of payments for customs duties land taxes; and

c. all other measures required to facilitate movement of cargoes to and from the customs area.

SECTION 2. To implement appropriate measures aimed at clearing and decongesting the Port of Manila of overstaying, seized and abandoned cargoes, by:

a. adjudicating all pending contested cases; and

b. effecting the disposition of all seized cargoes.

SECTION 3. To formulate rules and regulations to implement this memorandum order.

SECTION 4. To coordinate with, and submit to the Secretary of Transportation and Communications periodic reports on the implementation of this Memorandum Order.

SECTION 5. This Memorandum Order shall take effect immediately.
