PROCLAMATION NO. 560

AMENDING PROCLAMATION NO. 120, S. 1955, WHICH RESERVED FOR MARKET AND ABATOIR SITE, AND PROCLAMATION NO. 574, S. 1959, WHICH RESERVED FOR PARKING SITE PURPOSES, CERTAIN PARCELS OF LAND SITUATED IN THE MUNICIPALITY OF MIDSAYAP, PROVINCE OF COTABATO, AND GRANTING OWNERSHIP THEREOF TO THE AFORESAID MUNICIPALITY

Upon recommendation of the Secretary of Environment and Natural Resources and by virtue of the powers vested in me by law, I, FIDEL V. RAMOS, President of the Philippines, do hereby amend Proclamation No. 120, s. 1955, and Proclamation No. 574, s. 1959, which reserved for purposes of Market, Abattoir or Slaughter House and Parking sites, respectively, both under the administration of the Municipality of Midsayap, Cotabato, by granting ownership to the said municipality and to be followed by an issuance of a special patent, which parcels of lands are more particularly described as follows:

Lot No. 1, Mr-1061

(Midsayap Public Market Site)

“A PARCEL OF LAND (Lot 1, Mr-1061, identical to Lot 10938 being a portion of Lot 2517, Cad-107, Dulauan Cadastre), situated in the Barrio of Poblacion, Municipality of Midsayap, Province of Cotabato, Island of Mindanao. Bounded on the SW., NW., and SE., points 1-2-3-4-1 by Municipal Roads.

Beginning at a point marked “1” on plan, being S. 8 deg. 30’E., 45.64 m. from B.L.L.M. No. 65, Cad-107, Dulauan Cadastre;

Thence N. 60 deg. 48’W., 163.70 m. to point 2;

Thence N. 31 deg. 05’E., 106.04 m. to point 3;

Thence S. 60 deg. 33’E., 161.88 m. to point 4;

Thence S. 30 deg. 05’W., 105.32 m. to point 1;

point of beginning. Containing an area of SEVENTEEN THOUSAND ONE HUNDRED NINETY NINE (17,199) SQUARE METERS, more or less. All points referred to are indicated on the plan and are marked on the ground by PLS Cyl. Conc. Mons. Bearings True. Date of Original Survey on October, 1920 to July, 1923, and that of the subdivision survey executed by Jose M. Romero, Public Land Surveyor on July 21, 1954. Approved by the Director of Lands on October 28, 1954.

“A PARCEL OF LAND (Lot 2, MR-1061, identical to Lot No. 10939 being a portion of Lot 2517, Cad. 107, Dulauan Cadastre), situated in the Barrio of Poblacion, Municipality of Midsayap, Province of Cotabato, Island of Mindanao. Bounded on the NE., and EAST, points 1-2-3 by Salunayan Creek, (Legal easement of 3.00 m. wide along lines 1-2-3 by Salunayan Creek shall be preserved), on the SW., points 3 to 4 by Municipal Road; and the NW., points 4 to 1 by Alley.

Beginning at a point marked “1” on plan, being N. 25 deg. 18’E., 109.71 m. from B.L.L.M. No. 65, Cad. 107, Dulauan Cad.;

Thence S. 51 deg. 59’E., 14.50 m. to point 2;

Thence S. 20 deg. 00’E., 36.00 m. to point 3;

Thence N. 60 deg. 59’W., 40.87 m. to point 4;

Thence N. 27 deg. 38’E., 25.89 m. to point 1;

RESTRICTION:

That the 5.00 m. wide bank protection/public easement which is excluded from the river shall be always kept open to the public and free from future claim, per R.A. 1273 and Sec. 51 P.D. 1067.

“A PARCEL OF LAND (Lot 2 of the subdivision plan, Bsd-11551, being a portion of Lot 2517, Cad. 107, Dulauan Cadastre), situated in the Bo. of Poblacion, Municipality of Midsayap, Province of Cotabato, Island of Mindanao. Bounded on the SE., along line 1 to 2 by Lot 1, Bsd-11551; on the SW., points 2 to 3 by Gen. Antonio Luna St., on the NW., points 3 to 4 and points 7 to 8 by Sto. Niño St.; points 4-5-6-7 by Lot 329, Bsd-11551 (Property claimed by Serafin and Felicidad V. Elizondo, MSA Patent No. V-1174, O.C.T. No. V-544); on the NE., points 8 to 1 by Pioneer Street.

Beginning at a point marked “1” on plan AP-124709-000744, being N. 32 deg. 58′ W., 149.62 m. from B.L.L.M. No. 65 Cad-107, Dulauan Cadastre;

Thence S. 31 deg. 05’W., 106.04 m. to point 2;

Thence N. 60 deg. 48’W., 44.61 m. to point 3;

Thence N. 29 deg. 38’E., 60.79 m. to point 4;

Date of Original Survey on October, 1920 to July, 1923 and that of the subdivision Survey executed by Jose M. Romero, Public Land Surveyor on June 28-August 1955. Approved by the Director of Lands on July 18, 1956.
