PROCLAMATION NO. 427
DECLARING FIFTY TWO (52) HECTARES OF THE SIXTY TWO (62) HECTARES OF LAND UNDER THE ADMINISTRATION OF THE AIR TRANSPORTATION OFFICE (ATO) SITUATED IN THE CITY OF LAS PIÑAS AS ALIENABLE AND DISPOSABLE AND OPEN FOR DISPOSITION TO THE ACTUAL OCCUPANTS THEREON BY THE NATIONAL HOUSING AUTHORITY UNDER THE PROVISIONS OF REPUBLIC ACT NO. 7279 KNOWN AS THE URBAN DEVELOPMENT AND HOUSING ACT OF 1992 AND OTHER PERTINENT LAWS
WHEREAS, Article 13, Section 9 of the Philippine Constitution provides that, “the State, shall by law, and for the common good, undertake, in cooperation with the private sector, a continuing program of urban land reform and housing which will make available at affordable cost decent housing and basic services to underprivileged and homeless citizens in urban centers and resettlement areas”;
WHEREAS, Sections 8 and 9 of Republic Act No. 7279, otherwise known as the Urban Development and Housing Act of 1992 (UDHA), provide that government-owned lands which have not been used for the purpose for which they have been reserved or set aside for the past ten years from the effectivity of the UDHA and identified as suitable for socialized housing, shall immediately be transferred to the National Housing Authority subject to the approval of the President of the Republic of the Philippines for proper disposition;
WHEREAS, the UDHA further provides that the National Housing Authority, with respect to lands belonging to the National Government, and the local government units with respect to other lands within their localities shall coordinate with each other to formulate and make available alternative schemes for the disposition of lands to the beneficiaries thereof;
WHEREAS, housing has been declared as the centerpiece program of the Administration in line with its “Erap Para sa Mahirap” vision, as embodied in Executive Order No. 159 dated 12 October 1999;
WHEREAS, in accordance with this policy, the government has made the provision of housing and housing assistance to the underprivileged and homeless a priority concern;
WHEREAS, there is an urgent need to resolve the long-standing land tenure problem of more than 10,000 that families occupy certain parcels of land under the administration of the Air Transportation Office situated in the City of Las Piñas;
WHEREAS, the current residents, have lived on the area for more than two decades have petitioned the government to dispose in their favor the land they occupy;
WHEREAS, it is in the public interest and in line with government policy that these occupied areas be declared alienable and disposable and devoted to housing.
NOW, THEREFORE, I, JOSEPH EJERCITO ESTRADA, President of the Republic of the Philippines, by virtue of the powers vested in me by law, do hereby declare as follows:
1. Fifty two (52) of the sixty two (62) hectares of land in Las Piñas under the administration of the Air Transportation Office are declared as alienable and disposable and shall be open for disposition to the actual occupants thereat.
2. The National Housing Authority (NHA), in coordination with the Air Transportation Office (ATO), is hereby designated as the agency primarily responsible and authorized to dispose and administer the lots to bona-fide and qualified residents pursuant to the provisions of Sections 8, 9 and 12 of Republic Act 7279 otherwise known as the Urban Development and Housing Act of 1992 and other pertinent laws.
3. An Awards and Arbitration Committee chaired by a representative from the NHA and composed of representatives from ATO, the Presidential Commission for the Urban Poor, the City Government of Las Piñas, a duly accredited community organization of CAA Phase III residents and a non-government organization involved with the urban poor, chosen according to guidelines issued by NHA, is hereby created to conduct beneficiary identification and award.
4. The City Government of Las Piñas, in cooperation with other agencies, shall provide technical, financial and personnel resources for the formulation and implementation of a comprehensive housing plan for the project.
