PROCLAMATION NO. 531

DECLARING CERTAIN PARCELS OF LAND OF THE PUBLIC DOMAIN LOCATED IN SAN JOSE GUSU, ZAMBOANGA CITY AS SOCIALIZED HOUSING SITE, PROVIDING FOR THEIR DISPOSITION TO THEIR ACTUAL BONAFIDE OCCUPANTS, AND PLACING THEM UNDER THE ADMINISTRATION OF THE NATIONAL HOUSING AUTHORITY, IN ACCORDANCE WITH THE PROVISIONS OF REPUBLIC ACT NO. 7279, AND EXECUTIVE ORDER NO. 131, SERIES OF 2002

WHEREAS, it is the priority concern of the Government to provide housing to homeless Filipinos in line with the constitutional mandate for the State to protect and advance the right of the people to a balanced and healthful ecology, decent living conditions and social justice;

WHEREAS, Executive Order No. 131, s. 2002, established the mechanism implementing the provisions of Republic Act No. 7279, otherwise known as the Urban Development and Housing Act of 1992, to dispose of as socialized housing sites/lots government-owned lands that have not been used for the purposes for which they have been set aside for the “past ten (10) years” (reckoned from March 1992, when RA 7279 took effect) and are suitable for socialized housing;

WHEREAS, pursuant to Section 2 of E.O. No. 131, s. 2002, the Housing and Urban Development Coordinating Council (HUDCC) is mandated to conduct an inventory of all idle government lands and recommend to the President which of these lands are suitable for housing purposes.

NOW, THEREFORE, I, GLORIA MACAPAGAL-ARROYO, President of the Philippines, do hereby declare certain parcels of land of the public domain located in San Jose Gusu, Zamboanga City as socialized housing site under the administration of the National Housing Authority (NHA) for disposition to their actual bona fide occupants in accordance with the provisions of RA 7279 and EO No. 131, s. 2002, subject to private rights, if any there be, and to final survey, which portions of land are more particularly described as follows:

Portion of Lots 1555, 1557, 1599-C, 368, 371, 372, 374-A, 375, 376 (Cad-14), Lot 1 (Pcs-09-000439) and Lot 7 (Pcs-09-000151)

Beginning at a point marked “1” on plan being N. 06 deg. 33’ W., 462.89 m. from Mon. 112. Cad. 14, thence:

beginning, containing an area of EIGHTY ONE THOUSAND FIVE HUNDRED THIRTEEN (81,513) SQUARE METERS, more or less.

Except in favor of the Government or any of its branches or agencies, all lands disposed of under this Proclamation shall not be subject to alienation and encumbrance for a term of ten (10) years from the issuance of the title in case of sale, or execution of contract in case of lease, nor shall they become liable to the satisfaction of any debt contracted prior to the expiration of said period; but the improvements on the land may be mortgaged to qualified persons, associations or corporations.

Pursuant to Memorandum Order No. 74, s. 2002, a Local Inter-Agency Committee (LIAC) is hereby created to formulate the guidelines for the disposition of the area. The LIAC shall be chaired by HUDCC and co-chaired by the Air Transportation Office (ATO) with the following agencies/entity as members:

1. City Government of Zamboanga;

2. Department of Environment and Natural Resources;

3. National Housing Authority;

4. Presidential Commission for the Urban Poor and

5. A representative from the federation of the people’s organizations (POs) and/or a representative from non-government organization (NGO) operating in the proclaimed area.

In the event that there are vacant lots generated during the implementation of this Proclamation, the LIAC is hereby directed to formulate a comprehensive housing plan and dispose of the residual units to those beneficiaries residing within the buffer zones of the airport and to other low-salaried government employees, subject to the pre-qualification guidelines it may hereafter adopt.
