PROCLAMATION NO. 1049
AMENDING PROCLAMATION NO. 1084 DATED NOVEMBER 23, 1978, WHICH ESTABLISHED THE CAMP ROBERT EDWARD LUCERO MILITARY RESERVATION LOCATED IN BARANGAYS POBLACION AND NASAPIAN, MUNICIPALITY OF CARMEN, PROVINCE OF COTABATO, ISLAND OF MINDANAO, BY SEGREGATING PORTIONS OF THE LAND EMBRACED THEREIN AND RESERVING THE SAME FOR SOCIALIZED HOUSING SITE PURPOSES
Upon the recommendation of the Secretary of Environment and Natural Resources and by virtue of the powers vested in me by law, I, GLORIA MACAPAGAL-ARROYO, President of the Republic of the Philippines, do hereby amend Proclamation No. 1804 dated November 23, 1978, which established the Camp Robert Edward Lucero Military Reservation located in Barangays Poblacion and Nasapian, Municipality of Carmen, Province of Cotabato, Island of Mindanao by segregating portions of the land embraced therein containing a total area of Two Hundred Thousand and Two (200,002) square meters and reserving the same for socialized housing site purposes open for disposition in favor of qualified beneficiaries, subject to private rights, if any there be and to actual survey, which portions are more particularly described as follows:
LOT NO. 3179-A, PLS-217
A PARCEL OF LAND (Lot No. 3179-A, Pls-217), being a portion of Lot 3179, Pls-217 situated in Barangay Poblacion, Municipality of Carmen, Province of Cotabato, Island of Mindanao. Bounded on the NE. and SW., along lines 1-2-3 by Road; on the SE. and SW., along lines 3-4-5-6-7-8 by Lot 3179-B, of the Subdivision Plan; on the SW., along line 8-1 by Road. Beginning at a point marked “1” on the plan being N. 68° 42′, W., 1,797.24 m. BLLM No. 2, Pls-217, Carmen Public Land Subdivision. Thence:

beginning, containing an area of TWO HUNDRED THOUSAND AND TWO (200,002) square meters, more or less. All points referred to are indicated on the plan and are marked on the ground by Old PLS and B.L. Cyl. Con. Mons. 15 x 60 cm. Bearings true. Date of original survey, June 18, 1947 to August 31, 1949 and that of the subdivision survey executed by Ma. Rosario M. Robante, Geodetic Engineer on February 28, 2004.
The area herein reserved for socialized housing purposes shall be disposed of in accordance with the provisions of RA 7279 known as the Urban Development and Housing Act and shall be under the administration of the Housing and Urban Development Coordinating Council (HUDCC)/National Housing Authority (NHA).
Thirteen (13) hectares of the area herein reserved for socialized housing purposes shall be used as an AFP Off-Base housing site for active and retired military personnel particularly those residing in Mindanao.
The area herein reserved shall be co-located with the Productivity Area with an area of approximate 7.6 has. and portions of the Community Defense Center Area with an approximate area of 12.4 hectares in accordance with the Site Development Plan of the military reservation.
The DENR shall conduct a resurvey of the military reservation excluding the area herein reserved for eventual title in favor of the Philippine Army.
A selective fence along the segregated are shall be constructed to maintain camp integrity and security.
For this purpose, an Inter-Agency Committee with HUDCC as Chair, the Local Government Unit (LGU) as Vice-Chairman, with representatives from the NHA, DND/AFP and DENR as members is hereby created to formulate implementing rules and regulations of the proclamation.
Such part or parts of the area herein declared as housing site, which are being used or earmarked for public or quasi-public purposes shall be excluded from such disposition. Except in favor of the Government or any of its branches or agencies, all lands disposed of pursuant to this proclamation shall not be subject to alienation and encumbrance for a period of ten (10) years from the issuance of the title, in case of sale or execution of contract in case of usufruct, nor shall they become liable to the satisfaction of any debt contracted prior to the expiration of the said project; but the improvements on the land may be mortgaged to qualified persons, associations, partnerships or corporations.
The DENR is hereby authorized to issue Special Patent in favor of the NHA covering the area herein reserved for socialized housing purposes.
