CREATING A DFA WORKING GROUP FOR POLICIES AND PROGRAMS FOR THE DISABLED

Section 1: Legal Basis and Justification.

The creation of a DFA Working Group for Policies and Programs for the Disabled is based on the following legal prescriptions and administrative imperatives:

1.Item (e), Section 2 of Republic Act No. 7277 or otherwise known as the “Magna Carta for Disabled Persons” calls on the state to “To facilitate integration of disabled persons into the mainstream of society” and “exert all efforts to remove all social, cultural, economic, environmental and attitudinal barriers that are prejudicial to disabled persons;”

2.Section 11, Article XIII, of the 1987 Constitution provides: “The State shall give priority to the needs of the underprivileged, sick, elderly, disabled, women and children…”

3.The Department of Foreign Affairs supports the call for policies and programs for the integration, rehabilitation, development and self-reliance of persons with disabilities.

4.The Department recognizes the invaluable contribution of its disabled personnel to the Foreign Service;

5.Section 83 of the Foreign Service Act provides that the Secretary is authorized to effect the organization of the Department and the Foreign Service and allot the funds provided for the Department in the General Appropriations Act;

6.Section 87 of the Foreign Service Act empowers the Secretary to issue such rules and regulations as maybe necessary to implement the provisions of the Act as well as the provisions of acts, decrees, and orders which are not inconsistent with it;

Section 2. Establishment of a Working Group. A Working Group is hereby established that will serve as the focal point in the planning, monitoring and review of the Department’s policies, programs and services for disabled persons.

Section 3. Composition. The Working Group shall be composed of representatives from the following:

1.Office of Personnel and Administrative Services (OPAS)

2.The Office of Consular Affairs (OCA)

3.An elected representative from a disabled member of the rank and file

4.DFA Medical Clinic

5.Office of the Undersecretary for Migrant Workers Affairs (OUMWA)

6.Foreign Service Institute Library

7.United Nations and International Organizations (UNIO)

Section 4. Functions. The Working Group shall have the following functions:

1.Review, plan recommend, implement and monitor the current and prospective policies, programs and services of the Department for disabled persons; and

2.Submit to the Secretary an annual progress report on the Department’s compliance with the applicable provisions of R.A. 7277 covering the following areas:

a.Recruitment and Human Resources Development

b.Auxiliary Aid (i.e. facilities, equipment and physical fixtures) for the Disabled

c.Frontline Services for Disabled Clients

d.Advocacy, Volunteer or Charity Work for the Disabled

3.Coordinate with the National Council on Disability Affairs (NCDA)

Section 5. Funding. The funding requirement to enact polices, programs and services for the disabled of the Department shall be appropriated and incorporated in the General Appropriations Act.

Section 6. Repealing Clause. All Department Orders, circular and regulations, or parts thereof, which are inconsistent with any provisions of this Order are hereby repealed or amended accordingly.

Section 7. Effectivity Clause

This order shall take effect fifteen (15) days from the date of its filing with the University of the Philippines Law Center.
