DEPARTMENT ORDER NO. 12-12

ESTABLISHMENT OF AN EMPLOYEE CLAIMS AND BENEFITS SETTLEMENT GROUP (ECBSG)

Revision of D.O. 22-11

WHEREAS, Republic Act 10154, signed 15 July 2011, mandates all state agencies to process and release pensions, gratuities and other retirement benefits to government workers within one (1) month after they relinquish their post.

WHEREAS, Republic Act 8291 (Establishment of GSIS), Republic Act 7875 (Establishment of Philippine Health Insurance Corporation (PhilHealth) and Republic Act 9679 (Establishment of the Home Development Mutual Fund (Pag-IBIG) requires all Government agencies to ensure timely remittances of the personnel’s and government shares to these funding institutions.

WHEREAS, the Philippines is a signatory to Article 9, Public Procurement and Management of Public Finances, Chapter II, Preventive Measures, of the United Nations Convention against Corruption (UNACC), which states that:

“2. Each State Party shall, in accordance with the fundamental principles of its legal system, take appropriate measures to promote transparency and accountability in the management of public finances. Such measures shall encompass, inter alia:

■ Procedures for the adoption of the national budget;

■ Timely reporting on revenue and expenditure;

■ A system of accounting and auditing standards and related oversight;

■ Effective and efficient systems of risk management and internal control; and

■ Where appropriate, corrective action in the case of failure to comply with the requirements established in this paragraph.”

WHEREAS, the Department gives due recognition to the urgency to address the grievances of its retired and current personnel with regards to the settlement of their claims and benefits

WHEREAS, Section 9 of the Foreign Service Act authorizes the Secretary to review and align periodically the principal offices of the Department in order to effectively meet the requirements of the service;

WHEREAS, Section 83 of the Foreign Service Act provides that the Secretary is authorized to effect the organization of the Department and the Foreign Service and allot the funds provided for the Department in the General Appropriations Act;

WHEREAS, Section 87 of the Foreign Service Act empowers the Secretary to issue such rules and regulations as may be necessary to implement the provisions of the Act as well as the provisions of acts, decrees, and orders which are not inconsistent with it;

NOW, THEREFORE, the following are hereby adopted:

SECTION 1. Establishment of ECBSG. The Employee Claims and Benefits Settlement Group (ECBSG) is hereby established to be made up of a composite nodal team between the Office of Fiscal Management (OFM) and Office of Personnel and Administrative Services (OPAS) and coordinated by a Special Assistant in the Office of the Undersecretary for Administration (OUA).

SECTION 2. Composition.

The ECBSG will liaise with the following on their work assignments:

■ Head, Records and Information Unit (OPAS)

■ Head, Payroll Section (OFM)

■ GSIS and Pag-IBIG Liaison Officer (OPAS)

■ Representative, Communications and Management Information

Systems Division (CMISD)

The ECBSG shall obtain the services of the following independent contractors:

■
One (1) Legal Assistant/ Officer (Contract of Service)

■
Twenty Eight (28) Accounting Clerks (Contract of Service)

■
Two (2) Administrative Aides (Contract of Service)

■
Two (2) Data Encoder (Contract of Service)

■
Two (2) Scanning Aide (Contract of Service)

The independent contractors of the ECBSG are to have the requisite qualifications to be determined by OPAS in performing their assigned tasks.

SECTION 3. Functions. The ECBSG will perform the following functions:

1) Reconcile, Update, Scan and Encode DFA and Corresponding Institutional Records

Government Service Insurance System (GSIS)

Philippine Health Insurance Corporation (Phil-Health)

Home Development Mutual Fund (Pag-IBIG)

Terminal Leave Benefit (TLB)

Vacation Credit

Sick Leave Credit

Service/ Attendance Record

2) Study Remedies for Penalties imposed on Retirees and Members

Administrative Remedies

Negotiations with Institutions

Appeals to the Office of the President or Appropriate Authorities

Investigate and coordinate with corresponding institutions on members who have arrearages, surcharges or penalties

3) Recommend, Study, Establish Compliance Mechanisms with Administrative Protocols:

– Manuals

– Department Orders

– COA Circulars

– Legislation

– Executive Orders

– CSC Circulars

– Foreign Service Circulars

– Institutional Rules and Regulations

– R.A. 10154

– Foreign Labor Laws

4) Assist Complainants and Retirees with submission, processing, disbursement and settlement of claims and benefits

SECTION 4. Priorities. The ECBSG shall give priority to those who have pending cases, complaints and past retirees not covered under the current workload of OPAS and OFM.

SECTION 5. Operating Requirements. All necessary supplies, equipment, office space and staff shall be prepared by OPAS.

SECTION 6. Reportorial Requirements. The ECBSG shall submit a monthly written progress report documenting its operations, recommendations, performance and progress. The ECBSG shall also prepare an accomplishment report at the end of its operations.

SECTION 7. Funding. The funding requirements of the ECBSG shall be sourced from the General Funds of the Department.

SECTION 8. Operational Duration. The ECBSG shall exist for a period of six months to a year.

SECTION 9. Repealing Clause. All Department Orders, circular and regulations, or parts thereof, which are inconsistent with any provisions of this Order are hereby repealed or amended accordingly.

This order shall take effect immediately.
