EXPLANATORY MEMORANDUM
This Act, among other things, expands the membership of representations of the communities affected by the activities of hydro-electric power producers and replaces the 30% revenue derived from the total revenue accruing to the companies or authorities operating in the host communities with 10% revenue derived from concessioning of the hydro plants and royalties paid to the Federal Government.

A Bill
For
An Act to amend the Hydro-Electric Power Producing Areas Development Commission (Establishment, Etc) Act, No. 7, 2013 to, among other things, expand the membership of representations of the communities affected by the activities of hydro-electric power producers; and for related matters.
[ ] Commencement
ENACTED by the National Assembly of the Federal Republic of Nigeria -
1. The Hydro-Electric Power Producing Areas Development Commission (Establishment, Etc) Act No. 7, 2010 (in this Act referred to as the "Principal Act") is amended as set out in this Act.
Amendment of Act No. 7. 2010
2. Section 3 of the Principal Act is amended- Amendment of section 3
(a) in subsection (1) by substituting for paragraph (b), a new paragraph "(b)" -
"(b) one person each who shall be from the affected communities to represent-
(i) Benue, (ii) Kebbi, (iii) Kogi, (iv) Kwara, (v) Niger,
(vi) Plateau, and (vii) any other State where hydro-electric power is
generated" ; and
(b) by substituting for subsection (3), a new subsection "(3)" -
"(3) The office of the Chairman shall rotate among the member States of the Commission in the following alphabetical order-
(a) Benue; (b)Kebbi; (c) Kogi; (d) Kwara; (e) Niger; (f) Plateau; and (g) any other State where hydro-electric power IS
generated."
3. Section 14 (2) of the Principal Act IS amended by substituting for paragraph (a), a new paragraph "(a)"-
Amendment of section 14 (2)
"(a) 10 percent of the total Federal Government's revenue derived from concessioning of the hydro plants and royalties paid to the Federal Government".
4. This Act may be cited as the Hydro-Electric Power Producing Areas Citation Development Commission (Amendment) Act, 2013.

SUMMARY OF THE CONTENTS OF THE BILL
