These regulations are administered by the Ministry of Justice.

Pursuant to section 64 of the Marriage Act 1955 and (in relation only to regulation 3(d) and form 4) section 88(1)(b) of the Births, Deaths, and Marriages Registration Act 1995, Her Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following regulations.

Regulations

1 Title and commencement

(1) These regulations may be cited as the Marriage (Forms) Regulations 1995.
(2) These regulations shall come into force on the day after the date of their notification in the Gazette.

2 Interpretation

In these regulations, unless the context otherwise requires,—
(a) the Act means the Marriage Act 1955:
(b) reference to a form of a particular number is a reference to the form bearing that number set out in the Schedule.

3 Forms

There are hereby prescribed—
(a) subject to paragraphs (ab) and (b), for a notice of intended marriage under section 23(1) of the Act, form 1:
(ab) for a notice of intended marriage under section 23(1) of the Act where the parties are currently in a civil union with each other and wish to change the form of their relationship into marriage under section 18 of the Civil Union Act 2004, form 1A:
(b) for a notice of intended marriage under section 23(1) where the parties to the marriage (whether bride, bridegroom, or partner) are ordinarily resident outside New Zealand, form 2:
(c) for a marriage licence under section 24(1) of the Act, form 3:
(d) subject to paragraph (da), for a form to be issued under section 24(1)(b) of the Act by a Registrar for the purpose of returning (under section 56(1)(a) of the Births, Deaths, Marriages, and Relationships Registration Act 1995) information relating to marriages solemnised by marriage celebrants, exempt religious bodies, or under section 32 of the Act, form 4:
(da) for a form to be issued under section 24(1)(b) of the Act by a Registrar for the purpose of returning (under section 56(1)(a) of the Births, Deaths, Marriages, and Relationships Registration Act 1995) information relating to marriages solemnised by marriage celebrants, exempt religious bodies, or under section 32 of the Act, which are a change in the form of relationship from civil union, form 4A:
(e) for an application under section 41 by a person who intends to marry outside New Zealand for a certificate of no impediment, form 5:
(f) [Revoked]
(g) for a notice to a Registrar under section 42(1) of the Act from a citizen of a Commonwealth country or the Republic of Ireland resident in New Zealand who desires to marry outside New Zealand, form 7:
(h) for a certificate issued by a Registrar under subsection (5) of section 42 of the Act that notice of an intended marriage has been given under subsection (1) of that section, form 8:
(i) for a certificate from a New Zealand representative under section 43(1) of the Act that the representative has attended the marriage of a New Zealand citizen in a country other than New Zealand and is satisfied that the marriage has been solemnised in accordance with the formalities of the law of that other country, form 9.
