PROMULGATION OF ACT OF PARLIAMENT

The following Act which has been passed by the Parliament and signed by the President in terms of the Namibian Constitution is hereby published in terms of Article 56 of that Consti tuti on.

EXPLANATORY NOTE:

ACT

To amend the Namibia Press Agency Act, 1992, so as to enable the Agency to provide Information Technology services; to provide for the substitution for the expression" executive officer" of the expression" chief executive officer"; and to provide for related matters.

BE IT ENACTED by the Parliament of the Republic of Namibia, as follows: -

Amendment of section 4 of Act No.3 of 1992

1. Section 4 of the Namibia Press Agency Act, 1992 (hereinafter referred to as the principal Act) is amended by the substitution for section 4 ofthe following section:

"4. The objects of the Agency shall be to carry on a news agency service and Information Technology (IT) service for the production, collection and dissemination of media, information and IT products and services and the provision of such products and services to subscribers of the Agency and other persons, bodies and organizations.".

Amendment of section 5 of Act No.3 of 1992

2. Section 5 of the principal Act is amended -

(a) by the insertion of "(1)" immediately after section 5;

(b) by the substitution for paragraph (a) of subsection (1) of section 5 of the following paragraph -

"(a) establish and control facilities for the collection and distribution of information and news as well as the provision of IT products and services;

(c) by substitution for paragraph (b) of subsection (1) of section 5 of the following paragraph -

"(b) enter into agreements for the supply of information or news to the Agency or for the distribution of information or news and the provision of IT products and services by the Agency;";

(d) by the substitution for subsection (2) of section 5 of the following subsection:

"(2) The agency may further [do anything which is conducive to the attainment of its objects] engage in any lawful income generating activity even though it is not expressly mentioned in subsection (1), and the generality of this provision shall not be limited by the paragraphs of subsection (1).".

Amendment of section 6 of Act No.3 of 1992 as amended by section 3 of Act No. 18 of 2000

3. Section 6 of the principal Act is amended by the substitution for subsection (1) of the following subsection:

"(1) There shall be a board of directors of not more than five and not less than three members appointed by the Minister, which shall be responsible for the policy and control of the Agency.".

Amendment of sections 11 and 14 of Act No.3 of 1992

4. Sections 11 and 14 of the principal Act are amended by the substitution for "executive officer" where it occurs of "chief executive officer".

Short title

5. This Act is called the Namibia Press Agency Amendment Act, 2004.
