CHAPTER 3.10
OFFICIAL OATHS ACT
(Acts 5 of 1876, 2 of 1956, S.R.O. 15/1956 and Act 24 of 1982)
Commencement
[25 April 1876]
Short title
1. This Act may be cited as the Official Oaths Act.
Forms of oaths to be taken by certain officials
2. The oaths in the forms prescribed in the Schedule shall be taken by the undermentioned officers and persons.
Oaths of superior executive officer
3. Administrators and officers administering Governments, and other superior executive officers, shall take the oath of allegiance and the official oath merely.

LAWS OF MONTSERRAT
Oaths of judicial officer
4. Judges and other judicial officers shall take the oath of allegiance and the judicial oath.
Oath of legislative councillor
5. Legislative councillors shall take the oath of allegiance only.
Oaths of executive councillor
6. Executive councillors shall take the oath of allegiance and the oath of fidelity in the discharge of their duties.
Oath on naturalization
7. On naturalization a person shall only be required to take the oath of allegiance. (Amended by Act 24 of 1982)
Penalty for not taking oath
8. If any officer or other person, when any oath required to be taken by him under this Act is duly tendered, declines or neglects to take such oath, he shall, if he has already entered on his office, vacate the same, and, if he has not entered on the same, be disqualified from entering on the same, but no person shall be compelled, in respect of the same appointment to the same office, to take such oath more than once.
The name of the Sovereign for the time being to be used in oath
9. Where, in any oath under this Act, the name of Her present Majesty is expressed, the name of the Sovereign of the United Kingdom of Great Britain and Northern Ireland for the time being shall be substituted from time to time.

allegiance to Her Majesty Queen Elizabeth the Second, Her Heirs and Successors,
according to law.

OFFICIAL OATH

Majesty Queen Elizabeth the Second in the office of .........................................… .

JUDICIAL OATH
I, .........…….........................., do swear that I will well and truly serve our
Sovereign Lady, Queen Elizabeth the Second, in the office of ......................................,
and I will do right to all manner of people after the laws and usages of Montserrat,
without fear, favour, affection, or ill-will.
So Help Me God.

OATH OF EXECUTIVE COUNCILLOR
I, .......….…….........................., being chosen and admitted to Her Majesty’s
Executive Council in Montserrat, do swear that except with the authority of His
Honour the Governor, I .......................…....................... will not directly or indirectly
reveal the business or proceedings of the Executive Council or the nature or contents
of any document communicated to me as a Member of the Council or any matter
coming to my knowledge in my capacity as a Member of the Council, and that in all
things I will be a true and faithful Councillor.
