PUBLIC HOLIDAYS ACT

1. Short title

This Act may be cited as the Public Holidays Act.

2. Interpretation

In this Act—

“cyclone warning of Class III” means a cyclone warning of that class issued by or on behalf of the Meteorological Services;

“Minister” means the Minister to whom responsibility for the subject of internal affairs is assigned.

3. Public holidays

The days specified in the Schedule shall be observed as public holidays.

4. Negotiable instruments

(1) All bills of exchange, promissory notes and other negotiable instru- ments which are due and payable on a public holiday shall be payable, and in cases of non-payment may be noted and protested on the following day and any such noting and protest shall be as valid as if made on the day on which the bill or note was made due and payable.

(2) Where the day on which a bill of exchange or other negotiable instru- ment is to be presented, or any notice relating the instrument is to be given is a public holiday, the bill shall be presented, or the notice given, on the fol- lowing day.

5. Official acts

Any act required to be done by or before— (a) a Judge or officer of any Court; or (b) a Government official, on a day which is a public holiday may be lawfully done on the following day.

6. Cyclone days

(1) Subject to subsection (2), sections 4 and 5 shall apply to a day on which a cyclone warning of Class III is in force.

(2) Nothing in this section shall invalidate an act done on a day on which a cyclone warning of Class III is in force.

7. Special public holiday

(1) Subject to subsection (2), the President may, by Proclamation, ap- point a special day to be observed as a public holiday and a day so appointed shall be a public holiday for the purposes of this Act.

(2) A special holiday shall be of a non-religious character. [S. 6 amended by Act 48 of 1991.]
