ON iMPLEMENTATION OF THE REGULATION (EC) No 1223/2009 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 30 November 2009 on cosmetic products

For the implementation of Regulation (EC) No 1223/2009 of the European Parliament and of the Council of 30 November 2009 on cosmetic products (OJ 2009 L 342/59) (hereinafter referred to as ‘Regulation (EC) No 1223/2009’), the Government of the Republic of Lithuania has resolved:
1. to appoint the Ministry of Health as the coordinating competent authority of the Republic of Lithuania to coordinate the activities of other public authorities related to the implementation of the tasks assigned to the national competent authorities under Regulation (EC) No 1223/2009, and within their competencies submit information to the European Commission (hereinafter ‘the Commission’), as stated in Regulation (EC) No 1223/2009.
2. Confer on:
2.1. National Public Health Centre under the Ministry of Health:
2.1.1. to exercise the supervision of entities in order to monitor the compliance with good manufacturing practice of cosmetic products pursuant to Article 8, Article (11)(3) and Article 22(2) of Regulation (EC) No 1223/2009;
2.3. the State Consumer Rights Protection Authority to perform the functions of competent national authority under Article 5(2), (3), Article 6(3), (5), Article 7, Article 11(3), Article 12, Article 13(5), Article 20, Article 22 paragraph 1 within its respective competence laid down in Article 24, Article 25(1)(b to 1), and (2 to 7), Article 26, 27, 28, 29, 30, and 37 of Regulation (EC) No 1223/2009;
2.5. the Ministry of Health to exercise the obligation laid down in Article 22(4) of Regulation (EC) No 1223/2009 to review and assess the functioning of supervision of cosmetic products by competent national authorities under the requirements of Regulation (EC) No 1223/2009. Such reviews and assessments shall be carried out at least every four years and the results thereof shall be communicated to the other Member States and the Commission and be made available to the public.
