AMENDING RESOLUTION NO 115 OF THE GOVERNMENT OF THE REPUBLIC OF LITHUANIA OF 28 JANUARY 2003 ON THE APPROVAL OF THE MODEL FORM FOR AN EMPLOYMENT CONTRACT

The Government of the Republic of Lithuania has resolved:
To amend Resolution No 115 of the Government of the Republic of Lithuania of 28 January 2003 on the approval of the Model Form for an employment contract (Official Gazette 2003, No 11-412):
1. The heading shall read as follows:
‘ON THE APPROVAL OF THE MODEL FORMS FOR AN EMPLOYMENT CONTRACT AND A SEAFARER EMPLOYMENT CONTRACT’.
2. The preamble shall read as follows:
‘Pursuant to Article 99(2) of the Labour Code of the Republic of Lithuania (Official Gazette 2002, No 64-2569) and Article 84(1) of the Law on Merchant Shipping of the Republic of Lithuania (Official Gazette 1996, No 101-2300; 2013, No 75-3764), the Government of the Republic of Lithuania has resolved:
3. To change the former second paragraph into paragraph 1.
4. To add paragraph 2 as follows:
‘2. To approve the Model Form for a seafarer employment contract (as appended).’

12. Where this Employment Contract is terminated at the Employer’s initiative without the Employee’s fault (Article 129 of the Labour Code of the Republic of Lithuania), the period of notice shall be determined in line with the provisions of Article 130 of the Labour Code of the Republic of Lithuania. Where the Employment Contract is terminated at the seafarer’s request, the period of notice shall be determined based on the provisions of Article 127 of the Labour Code of the Republic of Lithuania. In the event the Employment Contract is terminated on other grounds, the periods of notice shall be established based on the provisions of Articles 107, 125, 128 and 137 of the Labour Code of the Republic of Lithuania.

Note. Using the Model for a Seafarer Employment Contract, the Employer may include additional subparagraphs “The Employment Contract is amended” so that all amendments to the Employment Contract can be recorded. When the terms of the Employment Contract are modified, the amendments shall be recorded in both copies of the Employment Contract.
