The Government of the Republic of Lithuania  has resolved:

 

To amend the Resolution No 239 of the Republic of Lithuania of 3 March 2005 “On Implementation of Regulation (EC) No 850/2004 of the European Parliament and of the Council of 29 April 2004 on persistent organic pollutants and amending Directive 79/117/EEC” and to recast it as follows:

 

 

 

GOVERNMENT OF THE REPUBLIC OF LITHUANIA

 

 

 

RESOLUTION

 

ON 

 

IMPLEMENTATION OF Regulation (EC) No 850/2004 of the European Parliament and of the Council of 29 April 2004 on persistent organic pollutants and amending Directive 79/117/EEC

 

 

 

With the aim of implementing Regulation (EC) No 850/2004 of the European Parliament and of the Council of 29 April 2004 on persistent organic pollutants and amending Directive 79/117/EEC (Special edition in Lithuanian: OJ 2004, Chapter 15 Volume 008 P. 465), as last amended by Commission Regulation (EU) No 519/2012 of 19 June 2012 (OJ L 159, 2012, p. 1) (hereinafter referred to as ‘Regulation (EC) No 850/2004’), the Government of the Republic of Lithuania  has resolved:

 

1. To designate the Environmental Protection Agency as the competent authority of the Republic of Lithuania to carry out tasks assigned to national competent authorities under Regulation (EC) No 850/2004.

 

2. To delegate:

 

2.1. the Ministry of Environment of the Republic of Lithuania (hereinafter referred ‘the Ministry of Environment):

 

2.1.1. to represent the Republic of Lithuania in the meetings of the Parties of the Stockholm Convention of 22 May 2001 on Persistent Organic Pollutants (hereinafter referred to as ‘the Stockholm Convention’), in working groups of the Council of the European Union, Committee for General Affairs and Waste Affairs committee in all matters related to Regulation (EC) No 850/2004;

 

2.1.2. within the area of its competence to cooperate with the European Commission, competent authorities of the Member States of the European Union and third parties as well as the Stockholm Convention Secretariat, provide information to the European Commission, the Secretariat of the Stockholm Convention and other Parties in accordance with the procedures set out in Regulation (EC) No 850/2004 and the Stockholm Convention;

 

2.1.3. to coordinate the activities of the Ministries of the Republic of Lithuania and other authorities relating to the implementation of provisions of Regulation (EC) No 850/2004 and the Stockholm Convention, to coordinate and prepare programs and plans, draft national legislation on the management of persistent organic pollutants (chemical substances) for the implementation of Regulation (EC) No 850/2004 and the Stockholm Convention;

 

2.1.4. to determine the competence and operational mechanism of the administrative units and subsidiary bodies of the Ministry of Environment for carrying out the tasks referred to in points 2.1.1, 2.1.2, 2.2.1 and 2.3.1 of this Resolution by 31 March 2015;

 

2.2. the Environmental Protection Agency:

 

2.2.1to represent the Republic of Lithuania in the meetings of the competent authorities responsible for the implementation of Regulation (EC) No 850/2004;

 

2.2.2within the area of its competence to cooperate with the European Commission, and competent authorities of the Member States of the European Union, submit information to the European Commission and other  institutions in accordance with the rules of procedure for the meetings of competent authorities and the procedures laid down in Regulation (EC) No 850/2004;

 

2.2.3. to collect, process and submit data to the Secretariat of the Stockholm Convention, the Persistent Organic Pollutants Review Committee and other technical subsidiary bodies of the Stockholm Convention on production, use and placing on the market of persistent organic pollutants (substances), mixtures and articles containing them, sources of pollution from persistent organic pollutants, stockpile and waste containing persistent organic pollutants, their management and disposal, areas polluted with persistent organic pollutants (pollution of surface water, groundwater, soil and subsoil) and their sound management, monitoring data on persistent organic pollutants in the environmental compartments;

 

2.2.4. to carry out environmental risk assessment of persistent organic pollutants;

 

2.3. the Environmental Protection Agency and the Lithuanian Geological Survey under the Ministry of Environment:

 

2.3.1. to participate in technical expert meetings on management of persistent organic pollutants;

 

2.3.2. within the area of its competence to perform monitoring of persistent organic pollutants and manage data bases of persistent organic pollutants;

 

2.4. the State Environmental Protection  Service to organize and carry out controls of placing on the market and use of persistent organic pollutants, mixtures and articles containing them, emissions and releases of persistent organic pollutants, management of persistent organic pollutants waste, sites contaminated by persistent organic pollutants and by  waste containing  persistent organic pollutants;

 

2.5. the Ministry of Health of the Republic of Lithuania or its authorised institution to make proposals on restriction of use and placing on the market of persistent organic pollutants, mixtures and articles containing them, conduct the assessment of the risks of persistent organic pollutants to human health and the expertise of public health safety, participate in national, regional and international programs or projects investigating effects of persistent organic pollutants to human health in particular to the most vulnerable groups.

 

2.6. the State Plant Service under the Ministry of Agriculture to carry out controls of use and placing on the market of the plant protection products containing persistent organic pollutants taking into account the requirements of Regulation (EC) No 850/2004;

 

2.7. the State Non Food Products Inspectorate under the Ministry of Economy within the area of its competence to carry out controls of placing on the market of persistent organic pollutants, mixtures and articles containing them;

 

2.8. the Customs Department under the Ministry of Finance of the Republic of Lithuania:

 

2.8.1. to carry out controls of import and export of persistent organic pollutants under Regulation (EC) No 850/2004 and in accordance with the requirements of Regulation (EU) No 649/2012 of the European Parliament and of the Council of 4 July 2012 concerning the export and import of hazardous chemicals (OJ L 201, 2012, p. 60);

 

2.8.2. to carry out controls of import and export of waste containing persistent organic pollutants in accordance with Regulation (EC) No 850/2004 and taking into account the requirements of Regulation (EC) No 1013/2006 of the European Parliament and of the Council of 14 June 2006 on shipments of waste (OJ L 190, 2006, p. 1), as last amended by Regulation (EU) No 1257/2013 of the European Parliament and of the Council (OL L 2013 330, p. 1);

 

2.9. the State Food and Veterinary Service to carry out the monitoring programs, collect and process data on persistent organic pollutants detected in foodstuff and animals.

 

3. To assign the authorities of the Republic of Lithuania referred to in points 2.2 –2.9  of this Resolution which within the area of their competence carry out management and control of persistent organic pollutants (chemical substances), to provide data to the Ministry of Environment the mandatory data and information to be submitted to the European Commission and Secretariat of the Stockholm Convention on activities carried out for the implementation of Regulation (EC) No 850/2004, as well as other data and information required for the implementation of Regulation (EC) No 850/2004 and the Stockholm Convention, for reports for the European Commission and the Stockholm Convention Secretariat.”
