ON THE  PROTOCOL OF 1996 TO AMEND THE CONVENTION ON LIMITATION OF LIABILITY FOR MARITIME CLAIMS, 1976

Article 1. Ratification of the Protocol

Invoking subparagraph 16 of Article 67 and subparagraph 6 of paragraph 1 of Article 138 of the Constitution of the Republic of Lithuania, and having regard to Decree No 615 of the President of the Republic of 16 May 2006, the Seimas of the Republic of Lithuania shall ratify with a reservation the Protocol of 1996 to Amend the Convention on Limitation of Liability for Maritime Claims, 1976, done at London on 2 May 1996.

 

Article 2. Reservation of the Republic of Lithuania

The Seimas of the Republic of Lithuania declares that, invoking Article 7 of this Protocol, the Republic of Lithuania reserves the right:

1) not to apply subparagraphs d) and e) of paragraph 1 of Article 2 of the Convention on Limitation of Liability for Maritime Claims, 1976;

2) to reject claims for compensation for damage as defined in InternationalConvention on Liability and Compensation for Damage in Connection with the Carriage of Hazardous and Noxious Substances by Sea, 1996 or in any of amendments or Protocols to it.

 

Article 3. Proposal to the Government of the Republic of Lithuania

The Government of the Republic of Lithuania shall, before 1 September 2007, lay down a procedure for implementing this Protocol.

 

Article 4. Entry into Force of this Law

This Law, with the exception of Article 3, shall enter into force on 1 September 2007.

 

I promulgate this Law passed by the Seimas of theRepublic of Lithuania.
