AMENDING RESOLUTION NO 359 OF 12 APRIL 2006 OF THE GOVERNMENT OF THE REPUBLIC OF LITHUANIA ON THE APPROVAL OF THE 2006-2009 ACTION PLAN FOR THE PREPARATION FOR LITHUANIA'S PRESIDENCY IN THE EUROPEAN UNION

The Government of the Republic of Lithuania has resolved:

Resolution No 359 of the Government of the Republic of Lithuania of 12 April 2006 on the Approval of the 2006-2009 Action Plan for the Preparation for Lithuania's Presidency in the European Union (Valstybės žinios (Official Gazette) No 42-1522, 2006) shall be amended and shall read as follows:

on the approval of the action plan for LithuaniaN presidency OF the COuncil of the European Union in 2013

 

The Government of the Republic of Lithuania has resolved:

1. To approve the Action Plan for Lithuania's Presidency of the Council of the European Union in 2003 (as appended).

2. Annually before January 31, ministries and other public authorities, responsible for the implementation of the measures of the plan approved by this resolution shall submit information on the implementation of the plan's measures in the previous year to the Office of the Government of the Republic of Lithuania and to the Ministry of Foreign Affairs, which, after the information is discussed by the workgroup for the Examination and Coordination of the Process of the Preparation for Lithuania's EU presidency, formed by Ordnance No 247 of the Prime Minister of 11 July 2007, shall, annually before March 1, present to the Government of the Republic of Lithuania a summarized report on the plan implementation and, when necessary, proposals regarding further Lithuanian preparation for the Presidency of the Council of the European Union, and shall present a draft amended plan until 1 July 2010.

3. To recommend that Vilnius City Municipality should take part in the implementation of the measures specified in paragraphs 16.2 and 16.3 of the plan approved by this resolution.

1. 1.4. To prepare a digest of the workgroups and committees chaired or represented by a representative of the EU Presidency (hereinafter referred to as "working bodies operating within international organizations").

To prepare a digest of the working bodies operating within international organizations that enumerates all the working bodies operating within international organizations, specifies the ministries and other public authorities responsible for participation in the meetings of these working bodies, presents information on a preliminary number of Lithuanian representatives to be involved in the activities of the said bodies during Lithuanian EU presidency, their planned location (capital, Lithuanian diplomatic mission) and the need for additional staff etc., to perform the analysis of the digest and to present it to the Presidency Workgroup.

2. To accumulate and analyze information on the participation of Lithuanian representatives in the activities of EU Council working bodies, workgroups and committees of the Commission of the European Communities, and the working bodies of other EU institutions (hereinafter referred to as "working bodies of EU institutions").

2.1. To draw up and, when necessary, to update the lists of Lithuanian institutions representing the position of the Republic of Lithuania at the working bodies of EU institutions

 

When determining the number of persons per working body, to take account of the principle requiring the appointment of at least two persons (the main and the alternate representatives); in order to properly prepare for EU presidency, it is necessary to observe the rule "one person per working body of EU institutions". In exceptional cases, a person appointed main representative at a working body may also perform the functions of an alternate representative at another working body

2.2. On the basis of the lists of Lithuanian institutions representing the position of the Republic of Lithuania at the working bodies of EU institutions, to draw up and, when necessary, to update the nominal lists of representatives. 

On the basis of the lists of Lithuanian institutions representing the position of the Republic of Lithuania at the working bodies of EU institutions as well as the respective orders or other legislative acts regarding the appointment of specific representatives to the working bodies of EU institutions, to compile nominal lists of representatives that would be presented in the information system for Lithuania's EU membership (hereinafter referred to as "LINESIS"). When assigning representatives, to take account of the list of special requirements applicable to persons carrying out the activities related to representation in the EU, which are regulated by Chapters II-IV of the Rules of EU Affairs Coordination (hereinafter referred to as "activities and functions related to representation in the EU"), also of the principle according to which, at the time of Lithuanian presidency of the EU, the current or future (main) representatives will become the chairpersons of the EU Council working bodies, because representation experience is a prerequisite for successful presidency of the EU.

2.3. At least once a year, to summarize the information on the implementation of the provisions of paragraphs 2.1 and 2.2, also information on the participation of the representatives of ministries and other public authorities in the activities of the working bodies of EU institutions; when necessary, to submit proposals to the Government of the Republic of Lithuania.

3.1. To establish the groups of persons that will carry out the key functions of EU presidency, to specify a preliminary number of persons required by presidency and to summarize the need for personnel expansion

On the basis of the digest of the descriptions of EU Council working bodies and other EU working bodies as well as the digest of the working bodies functioning within international organizations (hereinafter referred to as "the digest of the descriptions of presidency working bodies), to identify the staff groups (workgroup chairpersons, their assistants, coordinators etc) that will perform the specific functions in order to ensure effective operation of the presidency working bodies and to complete other presidency tasks, also to specify the number of persons necessary for efficient presidency as well as the need for personnel expansion

3.2. To draw up a preliminary list of future chairpersons of the presidency working bodies

On the basis of the nominal lists of representatives drawn up in accordance with paragraph 2.2, the digests specified in paragraphs 1.3 and 1.4 and with respect to the provisional structure of the staff of the Permanent Representation of Lithuania to the EU in 2008-2013, which was approved at the 13 June 2008 meeting of the Presidency Workgroup (minutes No 6), to draw up a preliminary list of the chairpersons of the presidency working bodies specifying the location of the chairpersons during Lithuanian presidency of the EU, and to present it to the Presidency Workgroup

3.3. To draw up the lists of new job titles necessary to perform the presidency functions

 

With regard to the information received when implementing paragraphs 1.3, 1.4, 3.1 and 4.1 and in accordance with the competence of each ministry or another public authority, to carry out an analysis of new job titles that must be established no later than in 2012-2013 for the performance of horizontal presidency (coordination) and other presidency-related functions.

II. Strengthening of Administrative Capacities (System Improvement)

5. To ensure that the activities related to representation in the EU are seen as a typical function ascribed to a certain job title for the performance of which a specific subject area competence is required

5.1. To draft a legislative act on special requirements applicable to civil servants performing the activities related to representation in the EU, which defines the key competence of such persons

In order to establish uniform special requirements for persons performing the activities related to representation in the EU, to draw up a list of special requirements (competencies) that could be used as a basis for the elaboration of the descriptions of the job titles related to Lithuania's representation in the EU, for the appointment of a civil servant to represent Lithuania in the activities of a certain working body of EU institutions during the annual job performance evaluation, and for updating or preparing qualification improvement programmes

5.2. To review and, if necessary, to update the lists of requirements for civil servants appointed to take part the activities of the working bodies of EU institutions

To verify that the requirements for the civil servants who are drawn into the lists mentioned in paragraph 2.2 specify participation in the activities of the working bodies of EU institutions as a separate function of a civil servant and that the special requirements, referred to in paragraph 5.1, are laid down; when necessary, to correct the levels and/or categories of the mentioned civil servants

6. To increase civil service attractiveness and civil servant motivation

 

6.1. To examine proposals regarding the development of motivational tools in civil service that have been presented to the Commission on the Improvement of the Public Administration System and, if needed, to submit additional proposals to the said commission

Based on the decision of the Commission on the Improvement of the Public Administration System of 14 January 2008 (minutes No 73-01(20)), the Ministry of the Interior and other competent public authorities have been instructed to prepare proposals regarding the development of motivational tools in civil service by 1 September 2008. Since the motivational measures would really help to ensure effective performance of the functions related to the preparation for EU presidency, it is reasonable to examine the said proposals at the Presidency Workgroup and, if necessary, to present additional proposals

6.2. To draft a legislative act(s) on motivational tools in civil service and to submit it (them) to the Government of the Republic of Lithuania

7. To improve LINESIS with regard to the information technology novelties and future EU presidency

7.1. To prepare an application for EU structural assistance under measure VP1-4.2-VRM-05-V, "Better implementation of the European Union policies" under the Supplement to the Operational Programme for Human Resources Development approved by Resolution No 789 of the Government of the Republic of Lithuania of 23 July 2008 (Valstybės žinios (Official Gazette) No 95-3722) (hereinafter referred to as "Supplement to the Operational Programme for Human Resources Development"), with the aim to improve LINESIS with regard to the latest information technologies and future EU presidency

To prepare an application for EU structural assistance to modernize and expand the LINESIS information system with regard to the latest IT developments and the changing institutional needs; to provide for the linkage of the database of Lithuanian representatives at the working bodies of EU institutions within the LINESIS system with the Register of Civil Servants

7.2. To organize the LINESIS system modernization and development work

III. Strengthening of Administrative Capacities (QUALIFICATION Improvement)

8. To analyze the need for qualification improvement of the persons included into the lists mentioned in paragraph 2.2

8.1. To evaluate the competence of persons included into the lists of representatives mentioned in paragraph 2.2, to determine the need for qualification improvement and to present summarized information to the Office of the Government of the Republic of Lithuania and to the Ministry of Foreign Affairs.

After reviewing and, when necessary, updating the descriptions of the civil servant posts, as required by paragraph 5.2, during a regular civil servant performance assessment, to verify compliance of the civil servants included into the lists of representatives mentioned in paragraph 2.2 with the special requirements indicated in paragraph 5.2, to estimate the need for competence and qualification improvement, and to present summarized information to the Office of the Government of the Republic of Lithuania and to the Ministry of Foreign Affairs.

9. To create a system for checking the level of foreign languages proficiency of civil servants and to prepare for targeted foreign languages learning

9.1 To prepare proposals on centralized foreign (working EU) languages proficiency checking system and on an institution (agency) capable of organizing centralized foreign (working EU) languages knowledge checking

 

The determination of the foreign languages proficiency level for civil servants is based on a self-assessment system. For this reason and due to the fact that in the Register of Civil Servants data on foreign languages proficiency level is not linked with competence improvement in this area for civil servants, it is impossible to objectively check the foreign languages proficiency level of the persons performing the functions related to representation in the EU and to adequately prepare targeted instruction programmes and organize learning. Thus, it would be reasonable to prepare proposals regarding a centralized foreign (working EU) languages proficiency checking system and to provide them to the Presidency Workgroup.

In a centralized fashion, to organize general representation training, i.e. to provide knowledge and build skills irrespective of the specific work area of a civil servant with the aim to participate in the processes of EU decision making and enforcement of the decisions; when preparing the application, to take account of the training need of certain groups of persons (the ones without representation experience, the ones with representation experience, the ones employed at the Permanent Representation of Lithuania to the EU, high-ranking officers etc)

In a centralized fashion, to organize general representation training, i.e. to provide knowledge and build skills irrespective of the specific work area of a civil servant with the aim to prepare for EU presidency in 2013 (EU decision-making procedures, the role of the General Secretariat of the EU Council, chairing meetings of the working bodies, the principles of international and intercultural cooperation, protocol etc.); the application shall be prepared in compliance with the Presidency Training Concept referred to in paragraph 10)

11.3. To organize centralized training in relation to representation and presidency

In accordance with Article 45(2) of the Law on Public Service of the Republic of Lithuania, general programmes for qualification improvement in the area of EU integration shall be developed and used for civil servant training by the Lithuanian Institute of Public Administration. In order to take advantage of the experience gained by the civil servants of other public institutions in the area of qualification improvement for EU integration, there are plans to involve them into centralized presidency-related training

11.4. To organize French language learning in line with the provisions of the multilateral Memorandum on a Multiannual French Language Training Programme for the Civil Servants of the Republic of Lithuania signed on 20 February 2006 by the Government of the Republic of Lithuania, the Belgian French Community Government, the Government of the Grand Duchy of Luxembourg, the Government of the French Republic and the International Organization of La Francophonie (hereinafter referred to as "the Francophonie Programme") (Valstybės žinios (Official Gazette) No 24-810, 2006)

To assess the effectiveness of training under the Francophonie Programme conducted since 2006; if necessary, to improve the training organization and to organize French language learning for persons who are performing the functions of representation or who will perform the presidency-related functions.

12. To ensure that the qualification of all the persons who are performing the representation functions or who will perform the presidency-related functions is improved in the areas that are directly dependent on a person's specialization in a specific area

12.1. To prepare applications for EU structural assistance under measure VP1-4.1-VRM-03-V, "Improvement of the qualification of the employees of public authorities and agencies", under the Supplement to the Operational Programme for Human Resources Development in order to ensure that the employees of ministries and other public authorities and agencies receive training in the working EU languages as well as qualification improvement in concrete areas with the aim to effectively carry out the representation functions and to prepare for EU presidency

To organize decentralized training according to projects prepared by the institutions:

training in the working EU languages;

special training in order to take part in EU the processes of EU decision making and decision enforcement and to prepare for EU presidency in 2013;

improvement of the capacities related to the implementation of the strategic objectives of public and local authorities;

computer literacy advancement.

Applications shall be drafted with regard to the Presidency Training Concept worked out under paragraph 10 and with respect to the information received in implementing paragraph 8.1

12.2. To prepare applications for EU structural assistance under measure VP1-4.1-VRM-05-K, "Interinstitutional cooperation and mobility of civil servants" under  the Supplement to the Operational Programme for Human Resources Development with a view to exchanging good practice with related institutions from other EU states

To improve interinstitutional cooperation and to enhance activities efficiency with the aim to ensure achievement of the strategic objectives as well as better public administration services provision of public institutions and agencies.

12.3. To organize training of working EU languages as well as specific qualification advancement for civil servants in order to perform the representation functions and to prepare for EU presidency effectively

To purposefully enhance the qualification of all persons who are performing the representation functions or who will perform the presidency-related functions in the areas that are directly dependent on a person's qualification in a certain area, with regard to the results of the implementation of the measures indicated in paragraphs 8.1, 9.2 and 9.3

13. To organize qualification improvement for civil servants at the Permanent Representation of Lithuania to the EU

13.1 To prepare proposals regarding the criteria for determining the need for the qualification improvement of public authorities at the Permanent Representation of Lithuania to the EU while preparing for EU presidency, also proposals regarding the provisional 2009-2013 plan for civil servant qualification improvement at the Permanent Representation of Lithuania to the EU, specifying the number of persons, the concrete institutions as well as the time when their civil servants could take qualification improvement training at the Permanent Representation of Lithuania to the EU

As qualification improvement training at the Permanent Representation of Lithuania to the EU stands out as one of the most effective qualification improvement tools, to enable as many civil servants performing the representation functions as possible to take advantage of this opportunity; for successful preparation for EU presidency, to prepare proposals regarding the criteria for determining the need for the qualification improvement of public authorities at the Permanent Representation of Lithuania to the EU while preparing for EU presidency, also proposals regarding the provisional 2009-2013 plan for civil servant qualification improvement at the Permanent Representation of Lithuania to the EU, and to present them to the Presidency Workgroup.

Qualification improvement training shall be taken at the Permanent Representation of Lithuania to the EU in compliance with provisions of Regulation 525 of the Government of the Republic of Lithuania of 16 May 2008 Amending Resolution No 780 of the Government of the Republic of Lithuania of 4 August 2006 on the Approval of the Rules of Sending Civil Servants to Qualification Improvement Training at Other Public or Local Authorities or Agencies, International Institutions or Foreign Institutions and on the Reimbursement of their Training Expenses

On the basis of the experience of former Presidencies, to conduct an analysis on delegation accommodation based on separate types of events as well as rank of participants (luxury suites, standard rooms) and to specify:

total number of hotel nights throughout the presidency period;

average number of hotel nights per event;

hotel choice criteria;

total number of hotels;

average distances between hotels and between hotels and venues;

delegation accommodation costs.

To conduct and present to the Presidency Workgroup a preliminary analysis of Lithuanian hotels capable of receiving a certain number of delegations of a respective level, along with proposals on hotel selection organization (centralized or decentralized model) as well as an analysis of the legal procedures (public procurement, informal negotiation) and conclusion of preliminary agreements (reservations) (how early in advance they should be made, advance payment terms, negotiations on room prices, arrangements concerning advertising etc)

VI. ACCUMULATING (adopting) Experience

21. To strengthen relationships with the representatives of EU institutions and EU Member States’ institutions and to accumulate experience

21.1. To organize secondment of the representatives of ministries and other public authorities (delegated with the national expert status) to work at the EU institutions as well as sending of the representatives of ministries and other public authorities to EU institutions for internships

Based on Resolution No 120 of the Government of the Republic of Lithuania of 6 February 2008 on the Establishment of Delegation Priorities as well as Preliminary Proportions of the Distribution of Funds, the institutions whose representatives are involved in the activities of the working bodies of the Council of the EU should, during the period of preparation for presidency (2008-2013), make efforts to:

within their competence, each delegate at least one representative to the respective EU institutions ;

delegate Lithuanian representatives to the institutions of the EU Presidency or other EU Member State institutions engaged in the presidency-related activities

In effort to adopt the experience of EU presidency and preparation for EU presidency accumulated by other EU countries, to mediate in initiating and strengthening relationships with the representatives of EU and EU Member State institutions by organizing events on various issues regarding the preparation for presidency in Lithuania. Relationships with EU institutions as well as with those of Ireland and Greece, which will preside over the EU together with Lithuania in the period 2013-2014, should be prioritized.
