AMENDMENT

TO THE COOPERATING STATE AGREEMENT

BETWEEN

THE EUROPEAN ORGANISATION FOR THE EXPLOITATION OF

METEOROLOGICAL SATELLITES (EUMETSAT)

AND

THE REPUBLIC OF LITHUANIA

 

 

 

 

 

 

 

 

 

 

 

The European Organisation for the Exploitation of Meteorological Satellites, established by the Convention opened for signature in Geneva on 24 May 1983 and entered into force on 19 June 1986, as amended by the Amending Protocol attached to Council Resolution EUM/C/Res. XXXVI, which entered into force on 19 November 2000 (hereinafter referred to as “EUMETSAT”), represented by the Director-General,

 

and

 

The Republic of Lithuania, represented by the Minister of Environment,

 

RECALLING the Cooperating State Agreement between EUMETSAT and the Republic of Lithuania, signed on 17 December 2004 and entered into force on 7 November 2005 following completion of its national ratification process (hereinafter referred to as “the Agreement”),

 

RECALLING that Article 7 of the above mentioned Agreement establishes that the Agreement shall remain in force until 31 December 2009, and that it requires, during the third year following the entry into force of the Agreement, a formal review of the cooperation in view of a possible accession by the Republic of Lithuania to EUMETSAT as a full Member State,

 

TAKING INTO ACCOUNT the very fruitful cooperation between EUMETSAT and the Republic of Lithuania during the period covered by the Agreement,

 

BEARING IN MIND that the required steps for the accession of the Republic of Lithuania to EUMETSAT as a full Member State are being followed and that the process is expected to be finalised by 1 January 2012,

 

RECALLING that the Agreement will expire on 31 December 2009,

 

TAKING INTO ACCOUNT that Article 8 of the abovementioned Agreement establishes that the Agreement may be amended by written agreement between the Parties,

 

WISHING to provide for coverage of the period between expiry of the Agreement and the full accession of Republic of Lithuania as a EUMETSAT Member State,

 

 

Have agreed to amend the Agreement as follows:

 

 

Article 1

 

Article 7, paragraph 1 of the Agreement shall read as follows:

 

“1. This Agreement is subject to ratification by the Republic of Lithuania according to its national legislation and shall enter into force on the day of receipt by EUMETSAT of the formal notification of ratification. This Agreement shall remain in force until 31 December 2011, unless the Republic of Lithuania becomes a full Member State of EUMETSAT earlier.”

 

Article 2

 

All other provisions of the Agreement remain valid and in force.

 

Article 3

 

This amendment to the Agreement (hereinafter referred to as “the Amendment”) is subject to ratification by the Republic of Lithuania according to its national legislation and shall enter into force on the day of receipt by EUMETSAT of the formal notification of ratification.

 

 

IN WITNESS WHEREOF, the undersigned being duly authorised, have signed this Agreement.

 

Done and signed in two originals in the English and Lithuanian languages, one for each Party to this Amendment, both texts being equally authentic.
