 Article 1 (Purpose)   print
The purpose of this Act is to contribute to the facilitation of provision of social welfare services by prescribing the matters necessary for the registration and support for foreign nongovernmental aid organizations providing social welfare services in Korea.

 Article 2 (Definition)   print
The term "foreign nongovernmental aid organization" in this Act means a nonprofit social services organization which has headquarters abroad and provides social welfare services, such as health services, education services, services for protection of livelihood, disaster relief services, local community development services, etc. in Korea by the aid of its headquarters and whose sources of revenue required for such services are provided from abroad and whose substantial operation main body is a foreigner.

 Article 3 (Object of Application)   print
This Act shall apply to foreign nongovernmental aid organizations, except in cases where there are specific provisions in other Acts, treaties and other international agreements.

 Article 4 (Registration)   print
(1) In order to receive support under Article 5, a foreign nongovernmental aid organization shall register with the Minister for Health and Welfare. <Amended by Act No. 9932, Jan. 18, 2010>
(2) The Minister for Health and Welfare may issue a certificate of registration to the foreign nongovernment aid organization registered under paragraph (1). <Amended by Act No. 9932, Jan. 18, 2010>
(3) Where a foreign nongovernmental aid organization modifies important matters, prescribed by Presidential Decree, of the matters registered under paragraph (1), it shall report the modification thereof to the Min ister for Health and Welfare. <Amended by Act No. 9932, Jan. 18, 2010>
(4) Matters necessary with respect to the procedure and method of registration and reporting, and the issuance of certificate of registration under the provisions of paragraphs (1) through (3) shall be prescribed by Presi dential Decree.

 Article 5 (Support to Registered Organizations)   print
(1) Goods prescribed by Presidential Decree, imported by a registered foreign nongovernmental aid organization shall be regarded as goods pursuant to subparagraph 2 of Article 91 of the Customs Act.
(2) Where a registered foreign nongovernmental aid organization makes a request for the issuance of documents necessary for the reduction of or exemption from customs duties and other taxes on the goods pursuant to paragraph (1), the Minister for Health and Welfare shall issue such documents without delay when the relevant request conforms to the related provisions. <Amended by Act No. 9932, Jan. 18, 2010>

 Article 7 (Cancellation of Registration)   print
When a foreign nongovernmental aid organization registered pursuant to Article 4 falls under any of the following subparagraphs, the Minister for Health and Welfare may cancel the registration: <Amended by Act No. 9932, Jan. 18, 2010>
1. When it performs any service other than its purposes;
2. When it has already accomplished the purposes of services or it becomes impossible to accomplish its purposes;
3. When it does not attain actual results of services for at least one year without justifiable reasons;
4. When it has been registered by deceit and other wrongful means or does not report the modification under Article 4 (3) without justifiable reasons.

 Article 8 (Hearing)   print

ADDENDA
(1) (Enforcement Date) This Act shall enter into force on April 1, 1999.
(2) (Transitional Measures for Registration of Foreign Nongovernmental Aid Organization) A foreign nongovernmental aid organization registered under the former provisions at the time this Act enters into force shall be deemed to be registered under this Act.
