CHAPTER I GENERAL PROVISIONS

 Article 1 (Purpose)   print
The purpose of this Act is to contribute to national development through the promotion of physical exercise of the people and solidifying the Olympic legacy by supporting the 23rd Olympic Winter Games and the 13th Paralympic Winter Games to be held in 2018.

 Article 2 (Definitions)   print
The terms used in this Act shall be defined as follows:
1. The term "Games-related facilities" means facilities directly related to the Games and facilities for creating an environment for the Games;
2. The term "facilities directly related to the Games" means any of the following facilities:
(a) Stadiums and convenience facilities annexed to stadiums;
(b) Training facilities for athletes, athlete villages, media villages and access roads to stadiums;
(c) Dope-testing facilities;
(d) Facilities for the international broadcasting center and the main press center;
(e) Electric and telecommunications facilities;
(f) Other facilities directly related to the Games and prescribed by Presidential Decree;
3. The term "facilities for creating an environment for the Games" means any of the following facilities;
(a) Transportation facilities, such as main arterial roads, railroads, and airports, that need to be established or maintained for the operation of the Games and for the construction of access networks;
(b) Direction boards for stadiums, training camps and athlete villages and publicity information facilities;
(c) Development of reservoirs exclusively for drinking water, for the supply of water and water supply facilities;
(d) Other facilities necessary for creating an environment for the Games and prescribed by Presidential Decree.
4. The term "Olympic Winter Games Special Zone" (hereinafter referred to as "Special Zone") means an area designated and notified as prescribed by this Act to successfully hold the Games and to solidify the legacy thereof;
5. The term "foreigner" means a person as defined in Article 2 (1) 1 of the Foreign Investment Promotion Act;
6. The term "foreign-invested enterprise" means an enterprise as defined in Article 2 (1) 6 of the Foreign Investment Promotion Act.

 Article 3 (Relationship to other Acts)   print
Special exceptions prescribed by this Act to alleviate control of projects to establish and use Games-related facilities, and of projects for the post-Games use thereof shall apply in preference to other Acts: Provided, That if the provisions of other Acts are more alleviating than those of this Act, such provisions of other Acts shall apply.

 Article 4 (Responsibilities of State and Local Governments)   print
(1) The State and local governments shall establish and implement comprehensive policies and prepare a support plan so that the Games are held as the cultural and environmental Olympics.
(2) The State and local governments shall take necessary measures so that the Games are operated safely and conveniently without any discrimination against persons with disabilities.
CHAPTER II ORGANIZING COMMITTEE

 Article 5 (Establishment of Organizing Committee)   print
(1) In order to conduct the following projects and activities for the preparation and success of the Games, the PyeongChang Organizing Committee for the 2018 Olympic and Paralympic Winter Games (hereinafter referred to as the "Organizing Committee") shall be established upon obtaining authorization from the Minister of Culture, Sports and Tourism:
1. Establishment of a comprehensive plan for the Games, and establishment and implementation of detailed operational plans;
2. Establishment and implementation of a plan to establish and use Games-related facilities;
3. Cooperation with international sports organizations promoting the Games;
4. Other projects necessary for the swift preparation and operation of the Games.
(2) The Organizing Committee shall be a corporation.
(3) The Organizing Committee shall have a president, a vice president, executive members and auditors as its executives, a plenary meeting as its supreme decision-making organ and an executive board for the efficient performance of its duties.
(4) Matters concerning the number and terms of office of executives prescribed in paragraph (3), method of selecting executives, and organization, functions, etc. of the plenary meeting and the executive board shall be prescribed by the articles of association.
(5) Except as otherwise expressly prescribed by this Act, the provisions concerning incorporated foundations in the Civil Act shall apply mutatis mutandis to the Organizing Committee.

 Article 6 (Support of State, etc.)   print
(1) The Organizing Committee may request the State, local governments, public institutions (referring to public institutions prescribed in Article 4 of the Act on the Management of Public Institutions; hereinafter the same shall apply), corporations, organizations, etc. to provide administrative and financial cooperation and support and other necessary convenience, and relevant institutions shall comply with such request in the absence of justifiable reasons to the contrary.
(2) The State and local governments may grant subsidies necessary for the establishment and operation of the Organizing Committee and for the preparation and operation of the Games.
(3) For the success of the Games, the State, local governments and Organizing Committee may support private promotional campaigns to inspire participation of the people, attitude of civilized people, etc.
(4) In order to continuously and systematically promote the private promotional campaigns prescribed in paragraph (3), the State, local governments and Organizing Committee may provide administrative and financial support necessary for the establishment and operation of relevant organizations.

 Article 7 (Counter-Terrorism and Security Measures)   print
(1) In preparation for terrorism and safety threats against Games-related facilities, athletes, executives, journalists, employees, spectators, etc., the Organizing Committee may request the State to take supportive measures.
(2) In order to take supportive measures requested by the Organizing Committee prescribed in paragraph (1), the State may establish and operate an organization for counter-terrorism and security measures consisting of counter-terrorism security-related institutions.
(3) Matters necessary for the detailed division of duties among the Organizing Committee and relevant administrative agencies and for the establishment, operation, etc. of the organization for counter-terrorism and security measures referred to in paragraphs (1) and (2) shall be prescribed by Presidential Decree.

 Article 8 (Establishment, etc. of Fund)   print
(1) In order to appropriate money necessary for the establishment and operation of the Organizing Committee and to meet expenses incurred in preparing and operating the Games, the Organizing Committee shall establish an Olympic Games Fund (hereinafter referred to as the "Fund").
(2) The Fund shall be raised from the following finances:
1. Contributions, subsidies and donations from the Government and entities other than the Government;
2. Money borrowed under Article 10;
3. Earnings from profit-making business prescribed in Article 12;
4. Profits from sports promotion betting tickets allocated to the Organizing Committee as prescribed in Article 13;
5. Profits from the issuance of commemorative coins prescribed in Article 14;
6. Earnings from outdoor advertising business subsidized to the Organizing Committee as prescribed in Article 6 (5) of the Outdoor Advertisements, etc. Control Act;
7. Profits from the operation of the Fund;
8. Other profits.
(3) The fiscal year of the Fund shall coincide with the fiscal year of the Government.
(4) Other matters necessary for the operation and management of the Fund shall be prescribed by Presidential Decree.

 Article 9 (Lending, etc. of State or Public Property)   print
(1) Where the State or local governments deem it necessary for supporting the Organizing Committee, they may gratuitously lend the Organizing Committee any State or public property, permit the Organizing Committee to use or profit from any State or public property, or gratuitously transfer office supplies or other articles to the Organizing Committee.
(2) Where the State or local governments gratuitously lend the Organizing Committee State or public property, permit the Organizing Committee to use or profit from any State or public property, or gratuitously transfer office supplies or other articles as prescribed in paragraph (1), the terms and conditions of, procedures for such lending, etc. shall be prescribed by a contract between the managing agency of the relevant property or article and the Organizing Committee.

 Article 10 (Borrowing, etc. of Money)   print
(1) If it is necessary for the preparation and operation of the Games, the Organizing Committee may borrow money or bring in materials (including borrowing money and bringing in materials from international organizations, foreign countries, foreigners, etc.) with the approval of the Minister of Culture, Sports and Tourism.
(2) Where the Organizing Committee borrows money or brings in materials from overseas, the Introduction and Management of Public Loans Act and the Foreign Exchange Transactions Act shall apply.

 Article 11 (Exemption from Duty to Purchase Bonds, etc.)   print
Where the Organizing Committee acquires movable property, immovable property, etc. for its operation and activities, it is exempt from its duty to purchase various bonds, etc. pursuant to relevant Acts and subordinate statutes in the same manner as such exemption is applied to State agencies.

 Article 12 (Profit-Making Business)   print
(1) In order to meet expenses to be incurred in preparing and operating the Games, the Organizing Committee may carry on the following profit-making business with the approval of the Minister of Culture, Sports and Tourism:
1. Insignia business;
2. Official commemorative medal business;
3. Broadcasting rights business;
4. Business of selling housing sites, etc.;
5. Other Games-related business prescribed by Presidential Decree.
(2) The Organizing Committee may grant some of the funds raised from profit-making business to other Games-related institutions, corporations or organizations, as prescribed by Presidential Decree.

 Article 13 (Issuance of Sports Promotion Betting Tickets in Increased Quantity)   print
(1) In order to meet expenses to be incurred in preparing and operating the Games, the Organizing Committee may request the president of the Korea Sports Promotion Foundation (hereinafter referred to as "president") to issue sports promotion betting tickets pursuant to Article 24 of the National Sports Promotion Act in increased quantity. In such cases, the total quantity of sales adjusted or recommended by the National Gaming Control Commission prescribed in Article 5 of the National Gaming Control Commission Act shall not apply to the sales from issuing tickets in increased quantity.
(2) The president shall allocate profits from sports promotion betting tickets issued in increased quantity under paragraph (1) to the Organizing Committee in each quarter.
(3) Matters necessary for the issuance of sports promotion betting tickets in increased quantity, allocation of profits, etc. prescribed in paragraphs (1) and (2) shall be prescribed by Presidential Decree.

 Article 14 (Sale of Commemorative Coins)   print
(1) In order to meet expenses to be incurred in preparing and operating the Games, the Organizing Committee may request the Bank of Korea to issue commemorative coins.
(2) The Organizing Committee may exclusively acquire commemorative coins issued under paragraph (1).

 Article 15 (Issuance of Commemorative Stamps, etc.)   print

 Article 16 (Business of Selling Housing Sites, etc.)   print
In order to use housing sites for lodgings of athletes, executives and press corps for the Games, the Organizing Committee may request the implementers of housing site development projects prescribed in Article 7 of the Housing Site Development Promotion Act to implement necessary projects.

 Article 17 (Service Charges, etc.)   print
In performing duties for the Games and other Games-relate projects, the Organizing Committee may collect service charges or usage fees, as prescribed by Presidential Decree, in any of the following cases:
1. Where it permits the use of Games-related facilities or articles managed by it;
2. Where it provides services to individuals, corporations or organizations;
3. Other cases prescribed by Presidential Decree.

 Article 18 (Profit-Making Business Department)   print

 Article 19 (Request, etc. for Dispatch of Public Officials, etc.)   print
(1) Where the Organizing Committee deems it necessary for performing its duties, it may request relevant administrative agencies, local governments, Games-related corporations or organizations to dispatch public officials prescribed in Article 2 (2) of the State Public Officials Act and Article 2 of the Local Public Officials Act, or their executives and employees with the approval of the Minister of Culture, Sports and Tourism.
(2) Where the Organizing Committee requests the dispatch of public officials or executives and employees of corporations or organizations as prescribed in paragraph (1), the heads of the relevant administrative agencies, corporations or organizations shall select and dispatch persons appropriate for performing their duties in the absence of justifiable reasons to the contrary, and where they intend to recall such dispatch during the period of dispatch, they shall consult in advance with the Organizing Committee.
(3) The heads of the relevant administrative agencies, corporations or organizations that dispatch public officials, or their executives and employees as prescribed in paragraph (2) shall not treat dispatched persons unfavorably in relation to their advancement, change of position, education, rewards, welfare, etc.
(4) Where dispatched public officials, or executives and employees of corporations or organizations are found inappropriate to perform their duties, the Organizing Committee may request the relevant administrative agencies, corporations or organizations that have dispatched such public officials, or executives and employees to recall dispatch.

 Article 20 (Requests for Provision of Data)   print
(1) The Organizing Committee may request relevant administrative agencies, public institutions, educational institutions, research organizations, etc. to provide data, such as Games-related investigation reports and research papers.
(2) The heads of agencies, institutions or organizations upon receipt of requests prescribed in paragraph (1) shall comply with such requests in the absence of justifiable reasons to the contrary.

 Article 21 (Approval of Budget Bills, etc.)   print
The Organizing Committee shall prepare a business plan and a budget bill for the following year and obtain approval from the Minister of Culture, Sports and Tourism by not later than one month before the beginning of the following year. The same shall apply to any modification thereto.

 Article 22 (Statements of Accounts, etc.)   print
The Organizing Committee shall submit a statement of revenue and expenditure for each fiscal year to the Minister of Culture, Sports and Tourism, along with the business track record for the relevant year by not later than the end of March of the following year.

 Article 23 (Devolvement of Residual Property)   print

 Article 25 (Use of Games Insignias, etc.)   print
Those who intend to use Games-related symbols, etc. prescribed by Presidential Decree, such as insignias and mascots designated by the Organizing Committee shall obtain approval from the Organizing Committee in advance: Provided, That this shall not apply if they use such symbols, as prescribed by Presidential Decree.

CHAPTER III GAMES SUPPORT COMMITTEE

 Article 26 (Games Support Committee)   print
(1) A Support Committee for the 2018 PyeongChang Olympic and Paralympic Winter Games (hereinafter referred to as the "Support Committee") shall be established under the Prime Minister in order to deliberate on and coordinate major policies relating to the Games.
(2) The Support Committee shall consist of not more than 30 members, including one chairperson. The Prime Minister shall serve as chairperson, and the Minister of Strategy and Finance and the Minister of Culture, Sports and Tourism shall serve as vice chairpersons, and each of the following persons shall become a member: <Amended by Act No. 11690, Mar. 23, 2013>
1. The Minister of Science, ICT and Future Planning;
1-2. The Minister of Education;
2. The Minister of Foreign Affairs;
3. The Minister of Unification;
4. The Minister of Justice;
5. The Minister of National Defense;
6. The Minister of Security and Public Administration;
7. The Minister for Agriculture, Food and Rural Affairs;
8. The Minister of Trade, Industry and Energy;
9. The Minister of Health and Welfare;
10. The Minister of Environment;
11. The Minister of Land, Infrastructure and Transport;

13. The Minister of the Office for Government Policy Coordination;
14. The Governor of Gangwon Do;
15. The President of the Korean Olympic Committee;
16. The President of the Korea Sports Association for the Disabled;
17. The President of the Organizing Committee;
18. Persons appointed or commissioned by the chairperson from among those who possess expert knowledge and experience in preparing and holding the Games;
19. Heads of other institutions deemed necessary by the chairperson.
(3) The Support Committee shall have one executive secretary who shall be appointed by the chairperson from among high-ranking public officials of the Ministry of Culture, Sports and Tourism.
(4) A support working committee for the 2018 PyeongChang Olympic and Paralympic Winter Games (hereinafter referred to as the "Support Working Committee") shall be established under the Support Committee to examine agenda items which will be subject to deliberations and resolution and to deal with matters entrusted upon to it by the Support Committee. In such cases, the Vice Minister of Culture, Sports and Tourism shall serve as chairperson of the Support Working Committee.
(5) Other matters necessary for the composition and operation of the Support Committee and the Support Working Committee shall be prescribed by Presidential Decree.

CHAPTER IV GAMES-RELATED FACILITIES, ETC.

 Article 27 (Establishment and Implementation of Project Plans)   print
(1) For the success of the Games, the Governor of Gangwon Do (hereinafter referred to as the "Governor") shall establish a plan to establish and use Games-related facilities (hereinafter referred to as "project plan") and obtain approval from the Minister of Culture, Sports and Tourism. When the Governor establishes a project plan, the standards for establishing an Urban/Gun management plan prescribed in Article 25 (4) of the National Land Planning and Utilization Act shall apply mutatis mutandis to such project plan.
(2) When the Minister of Culture, Sports and Tourism approves a project plan, he/she shall consult in advance with the head of the relevant central administrative agency and undergo deliberation thereon by the Support Committee.
(3) The head of the relevant central administrative agency in receipt of a request for consultation as prescribed in paragraph (2) shall present his/her opinion to the Minister of Culture, Sports and Tourism within 20 days after receipt of such request for consultation in the absence of justifiable reasons to the contrary.
(4) When the Minister of Culture, Sports and Tourism approves a project plan, he/she shall send documents to the head of the relevant administrative agency and the competent Governor, and the Governor in receipt of such documents shall publicly announce the details thereof.
(5) Matters necessary for the establishment, public announcement, etc. of project plans shall be prescribed by Presidential Decree.
(6) Where a project plan approved under paragraph (1) is modified, paragraphs (2) through (5) shall apply mutatis mutandis: Provided, That this shall not applyto any modification to insignificant matters prescribed by Presidential Decree.

 Article 28 (Subsidization, etc. for Games-Related Facilities)   print
(1) The State or local governments may subsidize all or some of project funds necessary for the new construction, remodeling or repair of Games-related facilities.
(2) Where all or some of project funds are to be subsidized under paragraph (1), matters necessary for the objects eligible for subsidization, details and rate of subsidization and other matters shall be prescribed by Presidential Decree.
(3) Where the State or local governments are requested by the Governor to transfer any State or public property for the establishment of Games-related facilities, they may preferentially transfer such property, notwithstanding the State Property Act and the Public Property and Commodity Management Act. In such cases, any State or public property to be transferred is deemed disused without taking separate procedures for disuse.
(4) Where a project for establishing Games-related facilities, etc. is implemented in a wide area over the boundaries of other local governments, the local governments involved shall cooperate therewith.
(5) The State or local governments may preferentially implement Games-related projects that are being implemented or scheduled to be implemented in the venue cities or in the vicinity thereof, by adjusting their schedule to the period during which the Games are held, as prescribed by Presidential Decree.
(6) Local governments may issue local bonds to subsidize project funds for Games-related facilities. In such cases, they may issue local bonds in excess of the ceiling for issuance of local bonds, notwithstanding Article 11 of the Local Finance Act.
(7) Where athlete villages and media villages constructed as Games-related facilities are to be provided to the public, no restrictions may be imposed on the price of a unit of multi-unit housing with an area exceeding 85 square meters for exclusive use, notwithstanding Article 38-2 of the Housing Act.

 Article 29 (Special Exceptions to Approval of Project Plans)   print
When a project plan is approved, the following activities shall be deemed to have been completed:
1. Establishment of a reclamation master plan prescribed in Article 22 of the Public Waters Management and Reclamation Act;
2. Establishment of and reporting on a medium-term local financial plan prescribed in Article 33 of the Local Finance Act and an examination of financial investment and loan projects prescribed in Article 37 of the same Act.

 Article 30 (Implementers of Projects to Establish and Use Games-Related Facilities)   print
(1) The Governor may directly implement projects to establish and use Games-related facilities (hereinafter referred to as "Games-related facility project") excluding the facilities prescribed in subparagraph 3 (a) of Article 2, or implement such project upon designating one of the following persons as an implementer:
1. The heads of Sis/Guns;
2. Public institutions prescribed by Presidential Decree;
3. Local government-invested public corporations prescribed by the Local Public Enterprises Act;
4. Where such project is implemented in a public-private partnership pursuant to the Act on Public-Private Partnerships in Infrastructure, an implementer prescribed by the same Act;
5. Other implementers prescribed by Presidential Decree.
(2) Anyone who intends to be designated as an implementer pursuant to paragraph (1) (hereinafter referred to as "implementer") shall prepare documents prescribed by Presidential Decree and submit them to the Governor.

 Article 31 (Approval of Implementers' Project Plans)   print
(1) Where approval prescribed in Article 27 is granted, the relevant implementer shall prepare a project plan stating matters prescribed by Presidential Decree, etc., such as the scale and details of the Games-related facility project, period of the project and financing plan and obtain approval from the Governor. The same shall apply to any modification (excluding any modification to insignificant matters prescribed by Presidential Decree) to the approved matters.
(2) Where the Governor approves an implementer's project plan or approves modification thereto, he/she shall, without delay, publish it in the official report and send a copy of related documents to the heads of the relevant local governments. In such cases, Article 8 of the Framework Act on the Regulation of Land Use shall apply to hearing of residents' opinions and notification of the topographical map of the area in which Games-related facilities are to be established and used, which is stated in the project plan.
(3) The heads of local governments in receipt of a copy of relevant documents as prescribed in paragraph (2) shall make the details thereof available for public perusal for at least 14 days.

 Article 32 (Restrictions on Acts, etc.)   print
No permit to engage in development acts prescribed in Article 56 of the National Land Planning and Utilization Act, no permit to construct buildings and temporary buildings or reporting thereon, and no reporting on the building of structures prescribed by the Building Act shall be granted or filed in any area in which Games-related facilities are to be established and used from the date on which approval of an implementer's project plan is published under Article 31: Provided, That this shall not apply if the head of the competent Si/Gun deems that such acts do not hinder the establishment and use of Games-related facilities and grant a permit or receive reports, accordingly.

 Article 33 (Authorization, Permits, etc. Deemed Granted under other Acts)   print
(1) Where an implementer obtains approval of his/her project plan or modification thereto as prescribed in Article 31, the following permits, licenses, authorization, determination, revocation, designation, approval, consultation, deliberation, reporting, etc. (hereinafter referred to as "authorization, permits, etc.") shall be deemed granted, performed or made and where approval is publicly announced, public notification or public announcement of authorization, permits, etc. pursuant to the following Acts shall be deemed granted or made:
1. Permits to change, etc. the form and quality of land under Article 21-2 of the Grassland Act and permits to convert grassland under Article 23 of the same Act;
2. Permits to convert a mountainous district under Article 14 of the Management of Mountainous Districts Act, reporting on the conversion of a mountainous district under Article 15 of the same Act, permits to temporarily use a mountainous district and reporting thereon under Article 15-2 of the same Act;
3. Permits to convert or farmland, and reporting thereon under Article 34 of the Farmland Act;
4. Approval to use agricultural infrastructure under Article 23 of the Rearrangement of Agricultural and Fishing Villages Act for purposes other than its original purpose and approval of a development project plan for a rural tourism and resort complex under Article 82 (2) of the same Act;
5. Permits to implement river works under Article 30 of the River Act, permits to occupy and use a river under Article 33 of the same Act and permits to use river water under Article 50 of the same Act;
6. Permits to occupy and use public waters under Article 8 of the Public Waters Management and Reclamation Act, approval of implementation plans under Article 17 of the same Act, a license to reclaim public waters under Article 28 of the same Act, public notice of licenses under Article 33 of the same Act, consultations or approval under Articles 35 and 36 of the same Act and approval and public notice of an implementation plan for the reclamation of public waters under Article 38 of the same Act;
7. Authorization to install public sewage systems under Article 11 of the Sewerage Act, permits to implement construction works for public sewage systems under Article 16 of the same Act and permits to occupy and use public sewage systems under Article 24 of the same Act;
8. Reporting on a commercial waste producer under Article 17 (2) of the Wastes Control Act and approval for or reporting on the installation of waste disposal facilities under Article 29 (2) of the same Act;
9. Authorization of or reporting on a plan of works to install electric installations for private use under Article 62 of the Electric Utility Act;
10. Approval of a business plan under Article 15 of the Tourism Promotion Act, designation of a tourist destination and tourism complex under Article 52 of the same Act, approval of a development plan for a tourist destination and tourism complex under Article 54 of the same Act and permits to implement a development plan under Article 55 of the same Act;
11. Consultation with or approval (including public announcement on approval of routes under Article 17 of the Road Act and determination of road zones under Article 17 of the same Act) from a road management agency under Article 5 of the Road Act, permits to implement road works under Article 34 of the same Act and permits to occupy and use a road under Article 38 of the same Act;
12. Designation of an urban development zone under Article 3 of the Urban Development Act, formulation of an urban development project plan under Article 4 of the same Act, designation of a project implementer under Article 11 of the same Act and authorization of an implementation plan for an urban development project under Article 17 of the same Act;
13. Approval of an implementation plan for a housing site development project under Article 9 of the Housing Site Development Promotion Act;
14. Modification of designation of a rearrangement area under Article 4 of the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents and authorization to implement a project under Article 28 of the same Act;
15. Permits to open a private road under Article 4 of the Private Road Act;
16. Permits to cut trees under Article 14 of the Work against Land Erosion or Collapse Act and revocation of designation of land treated for erosion control under Article 20 of the same Act;
17. Permits to extract aggregates under Article 22 of the Aggregate Extraction Act;
18. Permits to use State property under Article 30 of the State Property Act;
19. Permits to use and make profits under Article 20 of the Public Property and Commodity Management Act;

Drafting and determination of a park development plan under Articles 16 and 16-2 of the Act on Urban Parks, Greenbelts, Etc., permits to occupy and use an urban park under Article 24 of the same Act, restrictions on acts in an urban natural park area under Article 27 of the same Act and permits to occupy and use a green area under Article 38 of the same Act;
24. Permits to exhume a grave having no surviving relatives and to bury remains from such grave in another place under Article 27 (1) of the Act on Funeral Services, etc.;
25. Reporting on dust clouds under Article 43 of the Clean Air Conservation Act;
26. Permits to install facilities discharging water pollutants and reporting thereon under Article 33 of the Water Quality and Ecosystem Conservation Act;
27. Prior reporting on specific construction works under the Noise and Vibration Control Act;
28. Permits to cut, etc. standing trees and reporting thereon under Article 36 (1) and (4) of the Forest Resources Creation and Management Act;
29. Permits to engage in, or reporting on acts in forest conservation zones under Article 9 (1) and (2) 1 and 2 of the Forest Protection Act (excluding conservation zones for forest genetic resources), and revocation of designation of a forest conservation zone under Article 11 (1) 1 of the same Act (excluding conservation zones for forest genetic resources);
30. Designation of an implementer under Article 4 of the Special Act on the Construction of Bogeumjari Housing, etc., designation of a housing zone under Article 6 of the same Act and approval of a housing zone development plan under Article 17 of the same Act;
31. Authorization of general waterworks business and industrial waterworks business under Articles 17 and 49 of the Water Supply and Waterworks Installation Act and authorization to install private-use waterworks and private-use industrial waterworks under Articles 52 and 54 of the same Act;
32. Reporting on the commencement, modification or completion of a project under Article 86 (1) of the Act on Land Survey, Waterway Survey and Cadastral Records;
33. Prior consultation on examinations of factors influencing disasters under Article 4 of the Countermeasures against Natural Disasters Act;
34. Consultation on strategic environmental impact assessment under Article 16 of the Environmental Impact Assessment Act;
35. Determination of an Urban/Gun management plan under Article 30 of the National Land Planning and Utilization Act, permits to engage in development acts under Article 56 of the same Act, designation of an implementer under Article 86 of the same Act, authorization of an implementation plan under Article 88 of the same Act and permits to enter into a land transaction contract under Article 118 of the same Act;
36. Designation of an urban renewal acceleration district under Article 5 of the Special Act on the Promotion of Urban Renewal and formulation and determination of an urban renewal acceleration plan under Article 12 of the same Act;
37. Permits to implement small river construction works under Article 10 of the Small River Maintenance Act and permits to occupy and use small rivers under Article 14 of the same Act;
(2) Where the Governor approves an implementer's project plan or approves a modified plan, he/she shall consult in advance with the head of the relevant administrative agency if such project plan includes matters falling under any subparagraph of paragraph (1), and the head of the relevant administrative agency shall submit his/her opinion within 30 days after receipt of a request for consultation.
(3) Where deemed especially necessary to establish Games-related facilities in consideration of the conditions of location, such facilities may be established in sports park, as prescribed by the Act on Urban Parks, Greenbelts, Etc.
(4) Games-related facilities shall be deemed infrastructure prescribed in the Act on Public-Private Partnerships in Infrastructure.

 Article 34 (Special Exceptions to the Forest Protection Act)   print
In order to install facilities falling under subparagraph 2 (a) and (b) of Article 2 among Games-related facilities in a conservation zone for forest genetic resources referred to in Article 7 (1) 5 of the Forest Protection Act, the Minister of the Korea Forest Service may revoke the designation of all, or a part of a conservation zone for forest genetic resources in consideration of opinions of relevant specialists after establishing a plan to revoke the conservation zone for forest genetic resources, and to protect, conserve and reinstate forests, which is to be deliberated on and determined by the Support Committee, notwithstanding Article 11 of the Forest Protection Act.

 Article 35 (Special Exceptions to the Subsidy Management Act)   print

 Article 36 (Reduction of and Exemption from Charges)   print
In order to support Games-related facility projects, the State or local governments may grant exemption or reduction of the following charges:
1. Development charges referred to in Article 3 of the Restitution of Development Gains Act;
2. Charges to occupy and use public waters imposed under Article 13 of the Public Waters Management and Reclamation Act;
3. Charges to occupy and use rivers imposed under Article 37 of the River Act;
4. Compensation for expenses incurred for land treated for erosion control imposed under Article 21 of the Work against Land Erosion or Collapse Act.

 Article 37 (Expropriations of Land, etc.)   print
(1) Where necessary to implement a project, the implementer thereof may use or expropriate land, articles or rights (hereafter referred to as "land, etc." in this Article) prescribed in Article 3 of the Act on Acquisition of and Compensation for Land, etc. for Public Works.
(2) When an implementer's project plan is approved and publicly announced, project approval and public notification thereof prescribed in Articles 20 and 22 of the Act on Acquisition of and Compensation for Land, etc. for Public Works shall be deemed granted and given, and an application for adjudication may be filed within the period for implementation stipulated in the implementer's project plan, notwithstanding Articles 23 and 28 of the same Act.
(3) Except as otherwise expressly prescribed by this Act concerning the expropriation or use of land, etc. provided in paragraph (1), the Act on Acquisition of and Compensation for Land, etc. for Public Works shall apply mutatis mutandis thereto.

 Article 38 (Verification of Completion of Construction Works)   print
(1) When an implementer completes construction works, he/she shall, without delay, submit a completion report on construction works and obtain verification of construction completion. In such cases, the Governor in receipt of an application for verifying the completion of construction works may request the heads of the relevant public institutions, research institutions and other specialized institutions to conduct inspections necessary for verifying construction completion.
(2) When the Governor receives an application for verifying the completion of construction works as prescribed in paragraph (1), he/she shall inspect the completion of construction works, as prescribed by Presidential Decree, and issue a certificate of construction completion if he/she deems that the construction works have been implemented as approved.
(3) When an implementer obtains a certificate of construction completion prescribed in paragraph (2), he/she shall be deemed to have undergone a completion inspection or obtained authorization of completion, which are deemed undergone or granted under Article 33 (1).

 Article 39 (Formulation of Special Transportation Measures)   print
(1) The Governor shall formulate special transportation measures. In such cases, Article 33 (2) of the National Transport System Efficiency Act shall apply mutatis mutandis to the details of the special transportation measures.
(2) The Governor shall organize and operate a Special Transportation Measures Center for the Olympic Winter Games.
(3) Where necessary to take the special transportation measures formulated under paragraph (1), the Governor may request the heads of public institutions to dispatch staff to the Special Transportation Measures Center for the Olympic Winter Games.

CHAPTER V DESIGNATION AND OPERATION OF OLYMPIC WINTER GAMES SPECIAL ZONES
SECTION 1 Designation of Special Zones, Establishment of Special Zone Comprehensive Plans, etc.

 Article 40 (Designation of Special Zones, etc.)   print
(1) The Governor may request the Minister of Culture, Sports and Tourism to designate a special zone.
(2) Where the Governor intends to request for the designation of a special zone under paragraph (1), he/she shall establish and submit a special zone comprehensive plan (hereinafter referred to as "special zone comprehensive plan").
(3) The Minister of Culture, Sports and Tourism in receipt of a request to designate a special zone under paragraph (1) shall designate a special zone after determining the relevant special zone comprehensive plan after consultation with the heads of the relevant central administrative agencies and deliberation thereon and determination by the Olympic Winter Games Special Zone Committee prescribed in Article 42. The same shall apply to any modification (excluding any modification to insignificant matters prescribed by Presidential Decree) to such special zone comprehensive plan.
(4) When the Minister of Culture, Sports and Tourism designates a special zone as prescribed in paragraph (3), he/she shall publish the details in the Official Gazette, as prescribed by Presidential Decree, and notify the heads of the relevant administrative agencies and the Governor thereof without delay. In such cases, Article 8 of the Framework Act on the Regulation of Land Use shall apply to hearing of residents' opinions and public notice of a topographic map: Provided, That a topographic map, etc. necessary for giving public notice under Article 8 (6) of the Framework Act on the Regulation of Land Use may be prepared and submitted by the head of the competent Si/Gun.
(5) The Governor in receipt of notification as prescribed in paragraph (4) shall make the details thereof available for public perusal for at least 14 days.

 Article 41 (Establishment of Special Zone Comprehensive Plans)   print
(1) A special zone comprehensive plan shall include the following details:
1. Name, location and scale of a special zone;
2. Necessity for designating a special zone;
3. Expected implementer of a special zone development project;
4. Method of implementing a special zone development project;
5. Funding methods;
6. Land utilization plan and main infrastructural plan;
7. Plan to accommodate population and plan to create residential facilities;
8. Transportation plan;
9. Plan to induce industries;
10. Plan to establish facilities for health, medical services, education and welfare;
11. Environmental conservation plan;
12. Plan to create an environment to induce foreign investment and dwelling of foreigners;
13. Other matters prescribed by Presidential Decree.
(2) Before filing an application for the designation of a special zone, the Governor shall prepare a draft special zone comprehensive plan which states matters referred to in paragraph (1) in advance, as prescribed by Presidential Decree, announce it for at least 20 days, hold a public hearing to hear opinions of residents, enterprises, relevant specialists, etc., and consult with the heads of the relevant local governments.

 Article 42 (Olympic Winter Games Special Zone Committee)   print
(1) There is hereby established an Olympic Winter Games Special Zone Committee (hereinafter referred to as "Special Zone Committee") under the jurisdiction of the Prime Minister to deliberate on and coordinate the following important policies on special zones:
1. Matters concerning basic policies and systems on special zones;
2. Matters concerning approval of the comprehensive special zone plans and any modification thereto;
3. Matters concerning financial support and training of human resources necessary for the promotion of special zones;
4. Matters concerning the coordination of opinions of the heads of the relevant central administrative agencies and the Governor;
5. Other matters concerning the promotion of special zones.
(2) The Prime Minister shall serve as the chairperson of the Special Zone Committee, the Minister of Strategy and Finance and the Minister of Culture, Sports and Tourism shall serve as vice chairpersons, and the following persons shall become its members:
1. The Governor;
2. The heads of central administrative agencies prescribed by Presidential Decree;
3. Persons entrusted by the chairperson from among persons with abundant experience and knowledge that can contribute to the development and operation of special zones.
(3) In order to manage administrative affairs of the Special Zone Committee, an Olympic Winter Games Special Zone Planning Body (hereinafter referred to as "Special Zone Planning Body") shall be established under the jurisdiction of the Ministry of Culture, Sports and Tourism. In such cases, the Vice Minister of Culture, Sports and Tourism shall serve as the head of the Special Zone Planning Body.
(4) Other matters necessary for the composition, operation, etc. of the Special Zone Committee and the Special Zone Planning Body shall be prescribed by Presidential Decree.

 Article 43 (Matters to be Considered for Deliberation on and Determination by Special Zone Committee)   print
Where the Special Zone Committee deliberates on and makes determinations as prescribed in Article 40 (3), it shall consider the following matters:
1. Accessibility to Games-related facilities and infrastructure;
2. Appropriateness of the locations of sports industry facilities and green industry facilities and relevant research facilities, etc.;
3. Cultural and tourism resources held and possibility of development of related fields;
4. Securing a residential environment for Koreans and foreigners and possibility of connection;
5. Possibility of inducing investment by Koreans and foreigners in special zone development projects;
6. Level of funds secured, etc. for implementing special zone development projects;
7. Opinions presented by local governments, residents, enterprises, etc. in special zones on the establishment of special zones and special zone development projects;
8. Influence on the sustainable development and invigoration of the regional economy;
9. Other matters to be considered in designating special zones and prescribed by Presidential Decree.

 Article 44 (Effects of Designation of Special Zones)   print
When a special zone is designated and publicly announced as prescribed in Article 40, the following designations, etc. shall be deemed made in accordance with the details of the comprehensive special zone plan:
1. Designation of an urban development zone under Article 3 of the Urban Development Act and establishment of an urban development project plan under Article 4 of the same Act;
2. Designation of a housing site development district under Article 3 of the Housing Site Development Promotion Act and establishment of a housing site development plan under Article 8 of the same Act;
3. Designation of a tourist destination and a tourism complex under Article 52 of the Tourism Promotion Act;
5. Modification to a reclamation master plan under Articles 23 and 27 of the Public Waters Management and Reclamation Act;
6. Modification to an integrated plan for costal management and a local plan for costal management under Article 12 of the Coast Management Act;
7. Designation of a sea water intake area under Article 9 of the Development and Management of Deep Sea Water Act;
8. Modification to a master plan for waterworks installation and management under Article 4 of the Water Supply and Waterworks Installation Act;
9. Modification to a sewerage maintenance master plan under Article 6 of the Sewerage Act;
10. Establishment and approval of a comprehensive plan for the maintenance of small rivers under Article 6 of the Small River Maintenance Act.

 Article 45 (Restrictions on Acts)   print
(1) Anyone who intends to do any act prescribed by Presidential Decree (excluding any act prescribed by Presidential Decree, such as acts done for emergency measures necessary for recovery from a disaster or control of accidents), such as changing the form and quality of land, constructing buildings, constructing temporary buildings, and building structures in a special zone shall obtain a permit from the Governor. The same shall apply to any modification to the permitted matters.
(2) The Governor may order to make reinstatement to a person who fails to obtain a permit or permit for modification, in violation of paragraph (1).
(3) Where a person subject to an order to make reinstatement as prescribed in paragraph (2) fails to comply with such order, the Governor may execute the order on behalf of the person, as prescribed by the Administrative Vicarious Execution Act.

 Article 46 (Revocation of Designation of Special Zones)   print
The Minister of Culture, Sports and Tourism may revoke the designation of a special zone after hearing the opinions of the relevant local governments, consulting with the heads of the relevant central administrative agencies and undergoing deliberation and determination by the Special Zone Committee. In such cases, Article 40 (4) and (5) shall apply mutatis mutandis.

 Article 47 (Installation of Responsible Organization)   print
Where necessary to efficiently implement projects for the promotion of special zones, the Governor may establish a responsible organization under his/her jurisdiction.
SECTION 2 Implementation, etc. of Special Zone Development Projects

 Article 48 (Implementers of Special Zone Development Projects)   print
(1) The Governor may directly implement special zone development projects or implement such projects upon designating one of the following persons as an implementer:
1. A local government, government-invested institution, local public enterprise or person entitled to implement industrial complex development projects pursuant to any other Act;
2. The Small and Medium Business Corporation under Article 68 of the Small and Medium Enterprises Promotion Act or the Korea Industrial Complex Corporation established under Article 45-9 of the Industrial Cluster Development and Factory Establishment Act;
3. A public institution provided in the Act on the Management of Public Institutions and prescribed by Presidential Decree;
4. A person who intends to establish facilities appropriate for a special zone development project and relocate to a special zone or is deemed capable of installing relevant facilities or creating sites and who meets the requirements prescribed by Presidential Decree;
5. A corporation established upon joint investment by two or more persons falling under any of subparagraphs 1 through 3 for the purpose of developing a special zone, who meets the requirements prescribed by Presidential Decree and ;
6. An association established by the owners of land in a special zone for the purpose of developing the special zone, who meets the requirements prescribed by Presidential Decree;
7. A constructor provided in Article 9 of the Framework Act on the Construction Industry, who meets the requirements prescribed by Presidential Decree;
8. A registered business operator deemed a constructor pursuant to Article 12 (1) of the Building Act, who meets the requirements prescribed by Presidential Decree.
(2) Where the implementer of a special zone development project prescribed in paragraph (1) 1 deems it necessary for efficiently implementing the special zone development project, he/she may authorize a person who will move in a special zone to implement partof the special zone development project on his/her behalf, as prescribed by Presidential Decree.

 Article 49 (Approval of Special Zone Implementation Plans)   print
(1) The implementer of a special zone development project (hereinafter referred to as "special zone project implementer") shall prepare an implementation plan for the special zone development project which states matters prescribed by Presidential Decree, such as the scale and details of the project, the period for implementation of the project and funding plan (hereinafter referred to as "special zone implementation plan"), and obtain approval from the Governor. The same shall apply to any modification to the approved matters.
(2) A special zone implementation plan shall include a district-unit plan prepared under Article 52 of the National Land Planning and Utilization Act.

 Article 50 (Public Announcement, etc. on Approval of Special Zone Implementation Plans)   print
(1) When the Governor approves a special zone implementation plan or any modification thereto as prescribed in Article 49 (1), he/she shall, without delay, publish the details thereof in the official bulletin and send a copy of relevant documents to the head of the competent Si/Gun.
(2) The head of the competent Si/Gun in receipt of a copy of relevant documents as prescribed in paragraph (1) shall make the details thereof available for public perusal for at least 14 days.

 Article 51 (Special Exceptions to the National Land Planning and Utilization Act)   print
Notwithstanding Article 77 or 78 of the National Land Planning and Utilization Act, the Si/Gun having jurisdiction over a special zone may otherwise determine the maximum building-to-land ratio and floor space index by municipal ordinance, as prescribed by Presidential Decree, if necessary for implementing the special zone development project,

Notwithstanding Article 11 of the Installation and Utilization of Sports Facilities Act, a special zone project implementer may implement a special zone development project in accordance with the installation of facilities and size of the site stipulated in the relevant special zone implementation plan.

 Article 53 (Devolvement of Public Facilities, Land, etc.)   print
Where a special zone project implementer establish a new public facility (excluding parking lots and playgrounds; hereafter the same shall apply in this Article) or facility replacing the existing public facility, Articles 65 and 99 of the National Land Planning and Utilization Act shall apply mutatis mutandis to the devolvement of such facility. In such cases, a special zone project implementer deemed an administrative agency shall be limited to an entity falling under any of Article 48 (1) 1 through 3.

 Article 54 (Restrictions on Disposal of State or Public Land)   print
No land in a special zone, which is owned by the State or a local government, shall be sold or transferred for purposes other than a special zone project.

 Article 55 (Methods, etc. of Disposal of Created Land)   print
(1) A special zone project implementer shall supply land created according to the special zone development project within the relevant special zone (hereinafter referred to as "created land"), as stipulated by the special zone implementation plan.
(2) Where a special zone project implementer supplies created land for a purpose prescribed by Presidential Decree, such as the inducement of foreign investment, he/she may supply it with conditions attached, such as the observance of the designated use, observance of a period for compulsory use, prohibition of resale, special terms and conditions for repurchase, and the supply price thereof may be set at or below the creation cost.
(3) Matters concerning procedures for and methods of supplying created land by use, price standards and other conditions of supply shall be prescribed by Presidential Decree.

 Article 56 (Re-Investment of Development Profits)   print
(1) A special zone project implementer shall expend some development profits accrued from special zone projects for the following purposes:
1. Decreasing the sale prices or rent of sites for industrial and distribution facilities in the relevant special zone;
2. Appropriating for costs for establishing infrastructure or public facilities.
(2) In order to ensure the smooth re-investment of the development profits prescribed in paragraph (1), a special zone project implementer shall take necessary measures, such as keeping separate accounts of accrued development profits.
(3) Articles 8 through 12 of the Restitution of Development Gains Act shall apply mutatis mutandis to the calculation of the development profits prescribed in paragraph (1).

 Article 57 (Permits, etc. Deemed Granted pursuant to other Acts)   print
(1) Where a special zone project implementer obtains approval of a special zone implementation plan or any modification thereto as prescribed in Article 49 (1), the following permits, licenses, authorization, designation, approval, consultation, reporting, etc. (hereinafter referred to as "permits, etc.") shall be deemed granted, performed or made and where approval of a special zone implementation plan is publicly announced as prescribed in Article 50 (1), the public notice or public announcement of permits, etc. under the following relevant Acts shall be deemed given or made:
1. Permits to change, etc. the form and quality of land under Article 21-2 of the Grassland Act and permits to convert grassland under Article 23 of the same Act;
2. Permits to convert a mountainous district and reporting thereon under Articles 14 and 15 of the Management of Mountainous Districts Act, and permits to temporarily use a mountainous district and reporting thereon under Article 15-2 of the same Act;
3. Permits to cut, etc. standing trees and reporting thereon under Article 36 (1) and (4) of the Forest Resources Creation and Management Act;
4. Permits to convert or farmland, and reporting thereon under Article 34 of the Farmland Act;
5. Approval to use agricultural infrastructure under Article 23 of the Rearrangement of Agricultural and Fishing Villages Act for purposes other than its original purpose and approval of a development project plan for a rural tourism and resort complex under Article 82 (2) of the same Act;
7. Permits to implement river works under Article 30 of the River Act and permits to occupy and use a river under Article 33 of the same Act;
8. Permits to occupy and use public waters under Article 8 of the Public Waters Management and Reclamation Act, approval of implementation plans to occupy and use under Article 17 of the same Act (excluding areas to be reclaimed for which a reclamation license is granted), a license to reclaim public waters under Article 28 of the same Act, public notice under Article 33 of the same Act, consultations on or approval for reclamation to be conducted by the State, etc. under Article 35 of the same Act, and approval and public notice of an implementation plan to reclaim public waters under Article 38 of the same Act;
9. Authorization to install public sewage systems (limited to night soil treatment facilities) under Article 11 of the Sewerage Act;
10. Approval for or reporting on the installation of waste disposal facilities under Article 29 of the Wastes Control Act;
11. Authorization of general waterworks business and industrial waterworks business under Articles 17 and 49 of the Water Supply and Waterworks Installation Act and authorization to install private-use waterworks and private-use industrial waterworks under Articles 52 and 54 of the same Act;
12. Permits to conduct electricity generation business, electric power transmission business, electric power distribution business and electricity sale business pursuant to Article 7 of the Electric Utility Act, and authorization of or reporting on a plan for works for setting up electric installations for private use pursuant to Article 62 of the same Act;
14. Approval of a business plan under Article 15 of the Tourism Promotion Act and approval of a development plan for a tourist destination and tourism complex under Article 54 of the same Act;
15. Consultation with or approval from a road management agency under Article 5 of the Road Act, permits to implement road works under Article 34 of the same Act and permits to occupy and use a roadunder Article 38 of the same Act;
16. Determination of an Urban/Gun management plan under Article 30 of the National Land Planning and Utilization Act, permits to engage in development acts under Article 56 of the same Act, designation of the implementer of an Urban/Gun planning facility project under Article 86 of the same Act, authorization of an implementation plan under Article 88 of the same Act and permits to enter into a land transaction contract under Article 118 of the same Act;
17. Preparation and public notice of a topographic map under Article 8 of the Framework Act on the Regulation of Land Use;
18. Permits to exhume a grave having no surviving relatives and to bury remains from such grave in another place under Article 27 (1) of the Act on Funeral Services, etc.;
19. Permits to implement harbor construction works under Article 9 (2) of the Harbor Act and approval of implementation plans under Article 10 (2) of the same Act;
20. Designation of an urban development project implementer under Article 11 of the same Act, authorization to establish an association under Article 13 of the same Act, and authorization and public notice of an implementation plan under Articles 17 and 18 of the same Act;
21. Approval of an implementation plan for a housing site development project under Article 9 of the Housing Site Development Promotion Act;
23. Permits to open a private road under Article 4 of the Private Road Act;
24. Permits to cut trees under Article 14 of the Work against Land Erosion or Collapse Act and revocation of designation of land treated for erosion control under Article 20 of the same Act;
25. Approval of a comprehensive plan to maintain small rivers under Article 6 of the Small River Maintenance Act, permits to implement small river construction works under Article 10 of and permits to occupy and use a small river under Article 14 of the same Act;
26. Permits to extract aggregates under Article 22 of the Aggregate Extraction Act;
27. Permits to use State property under Article 30 of the State Property Act;
28. Permits to use and make profits under Article 20 of the Public Property and Commodity Management Act;
29. Consultation on the feasibility of supply of integrated energy under Article 4 of the Integrated Energy Supply Act;
30. Consultation on an energy use plan under Article 10 of the Energy Use Rationalization Act;
31. Approval of an implementation plan to a develop logistics cluster under Article 28 of the Act on the Development and Management of Logistics Facilities;
32. Reporting on the commencement, modification or completion of projects under Article 86 (1) of the Act on Land Survey, Waterway Survey and Cadastral Records;
33. Deliberation by the Building Committee under Article 4 of the Building Act, a building permit granted under Article 11 of the same Act, building reporting under Article 14 of the same Act, permits to construct temporary buildings or reporting thereon under Article 20 of the same Act, consultation on construction under Article 29 of the same Act and reporting on the building of structures under Article 83 of the same Act;
34. Registration for the opening of a superstore under Article 8 of the Distribution Industry Development Act;
35. Designation of an implementer of a comprehensive regional development project under Article 38-4 of the Balanced Regional Development and Support for Local Small and Medium Enterprises Act and approval of an implementation plan pursuant to Article 38-5 of the same Act;
36. Approval of a project plan under Article 16 of the Housing Act.
(2) Where the Governor approves a special zone implementation plan or any modification thereto as prescribed in Article 49 (1) and such implementation plan includes matters referred to in any subparagraph of paragraph (1), he/she shall consult in advance with the heads of the relevant administrative agencies and the heads of the relevant administrative agencies shall present his/her opinion within 30 days after receipt of a request for consultation.

 Article 58 (Expropriation and Use of Land, etc.)   print
(1) Where necessary to implement a special zone development project, a special zone project implementer may expropriate land, articles or rights (hereinafter referred to as "land, etc.") prescribed in Article 3 of the Act on Acquisition of and Compensation for Land, etc. for Public Works.
(2) When approval of a special zone implementation plan under Article 50 (1) is publicly announced, project approval or public notice of project approval under Articles 20 and 22 of the Act on Acquisition of and Compensation for Land, etc. for Public Works shall be deemed granted or given, and an application for adjudication shall be filed within the period for implementation of the project stipulated in the special zone implementation plan pursuant to Article 50 (1), notwithstanding Articles 23 and 28 of the same Act: Provided, That if the details of land, etc. to be expropriated are included in the comprehensive special zone plan, public notice of the comprehensive special zone plan under Article 40 (4) shall be deemed project approval and public notice of project approval under Articles 20 and 22 of the Act on Acquisition of and Compensation for Land, etc. for Public Works, and an application for adjudication on such land, etc. shall be filed within the period stipulated by the comprehensive special zone plan.
(3) The Central Land Tribunal shall be the land tribunal having jurisdiction over adjudication of the expropriation of land, etc.
(4) The Act on Acquisition of and Compensation for Land, etc. for Public Works shall apply mutatis mutandis to the expropriation of land, etc. except as otherwise expressly prescribed by this Act.

 Article 59 (Completion Inspections of Special Zone Development Projects)   print
(1) When a special zone project implementer completes all or a part of a special zone development project, he/she shall, without delay, undergo a completion inspection from the Governor, as prescribed by Presidential Decree.
(2) When a special zone project implementer undergoes the completion inspection pursuant to paragraph (1), he/she shall be deemed to have undergone the completion inspection or to have obtained authorization of completion of the relevant project according to the permits, etc. prescribed in the subparagraphs of Article 57 (1).
(3) No created land or established facilities shall be used until the completion inspection under paragraph (1) is conducted: Provided, That this shall not apply if the Governor's approval to use such land or facilities is obtained, as prescribed by Presidential Decree.
(4) The head of the competent local government shall manage a district in which a special zone development project is completed, in accordance with the district-unit plan included in the special zone implementation plan publicly announced under Article 50 (1).

 Article 60 (Bearing Expenses for Special Zone Development Projects)   print
(1) Expenses incurred in implementing special zone development projects shall be borne by the implementer thereof: Provided, That in cases of projects implemented by local governments, the State may subsidize some of the expenses, as prescribed by Presidential Decree.
(2) The rate of subsidization by the State under paragraph (1) shall be as prescribed in the Subsidy Management Act.
(3) For the construction of infrastructure for developing the tourism industry in the special zone and for tourism publicity projects, etc., the Minister of Culture, Sports and Tourism may order the Tourism Promotion and Development Fund established under the Tourism Promotion and Development Fund Act to preferentially lend money or provide subsidies to a local government or special zone project implementer.
SECTION 3 Support for Special Zone Project Implementers and Enterprises Located in Special Zones

 Article 61 (Reduction of and Exemption from Taxes and Charges)   print
(1) Where necessary to efficiently implement a special zone development project, the State or a local government may grant reduction of or exemption from corporate taxes, income taxes, tariff, global real estate taxes, value-added taxes, acquisition taxes, registration and license taxes, property taxes, etc. as prescribed by relevant Acts, such as the Restriction of Special Taxation Act, the Customs Act, the Restriction of Special Local Taxation Act, etc. to special zone project implementers and the Korean or foreign enterprises that move into the special zone (hereinafter referred to as "enterprise located in the special zone").
(2) The State or a local government may reduce property taxes on heavily taxed items, such as membership golf clubs owned by public institutions, as prescribed by relevant Acts, such as the Restriction of Special Local Taxation Act.
(3) The State or a local government may reduce corporate taxes imposed on for corporations in relation to the purchase cost, which have purchased condominiums, hotels or villas in the special zone owned by public institutions, as prescribed by relevant Acts, such as the Restriction of Special Local Taxation Act.
(4) In order to support special zone development projects, the State or a local government may grant exemption from compensation for expenses incurred in implementing an erosion control project pursuant to Article 21 of the Work against Land Erosion or Collapse Act.

 Article 62 (Preferential Treatment to Local Enterprises)   print
Where the implementers of Games-related facility projects and special zone development projects conclude a contract for construction works, articles, services, etc. prescribed by Presidential Decree, they may accord preferential treatment to persons having their main business office in Gangwon Do, as prescribed by Presidential Decree.

 Article 63 (Financial Support to Enterprises, etc. Located in Special Zones)   print
(1) The State or a local government may finance funds for purchasing sites, grant reduction of or exemption from rental fees for land, etc. and subsidize funds needed for special zone projects to enterprises located in the special zone.
(2) The State or a local government may subsidize funds necessary for establishing convenience facilities, such as medical service facilities, educational facilities, houses, etc. to special zone project implementers and enterprises located in the special zone.
(3) Where necessary for accelerating investment in a special zone, the Governor may grant employment subsidies, education and training subsidies, etc. to enterprises investing in the special zone, as prescribed by municipal ordinance.
SECTION 4 Support for Acceleration of Investment, Improvement in Residential Environment, etc.

 Article 64 (Facility Support)   print
(1) The State, local governments or persons who supply infrastructure may give priority in giving support to infrastructure prescribed by Presidential Decree, such as roads, water supply facilities, communications facilities, and electric power supply facilities, all of which are necessary for efficiently implementing special zone development projects and inducing investment.
(2) The infrastructure eligible for support pursuant to paragraph (1) and the scope, scale and methods of support and other matters shall be prescribed by Presidential Decree.

 Article 65 (Giving Priority in Employing Local Residents)   print
Special zone project implementers and enterprises located in the special zone shall give priority in employing migrants due to the implementation of such projects and residents of special zone.

 Article 66 (Creation of Architectural Landscaping)   print
(1) In order to create beautiful architectural landscaping and a comfortable environment in a special zone, the construction of buildings (excluding buildings having a total floor space of less than 500 square meters) in the special zone shall be deliberated upon by the Building Committee referred to in Article 4 of the Building Act in accordance with ordinance prescribed by the relevant local government in consideration of its specific use district, the size of buildings, etc.
(2) The State or local governments may grant subsidies necessary for maintaining inferior facilities in each special zone.
(3) Where subsidies are granted as prescribed in paragraph (2), the subject matter, details and rate of subsidies, and other matters shall be prescribed by Presidential Decree.

 Article 67 (Special Exceptions to Establishment of Schools and Medical Facilities)   print
(1) Articles 35 and 36 of the Special Act on the Development of Enterprise Cities shall apply mutatis mutandis when a special zone project implementer intends to establish a private school in a special zone in accordance with the comprehensive special zone plan for nurturing human resources and improving an educational environment.
(2) Articles 37 of the Special Act on the Development of Enterprise Cities shall apply mutatis mutandis when a special zone project implementer intends to establish and operate a medical institution in a special zone in accordance with the comprehensive special zone plan for securing medical infrastructure.

 Article 68 (Special Exceptions to Supply of Housing)   print
(1) Where an enterprise located in a special zone intends to construct housing units for its employees or a newly-established educational institution or medical institution intends to construct housing units for teachers, doctors, nurses and other employees, the relevant special zone project implementer may preferentially supply land created for the construction of housing unit to such enterprise or institution.
(2) Where an enterprise located in a special zone supplies housing units to its employees or a newly-established educational institution or medical institution supplies housing units to teachers, doctors, nurses and other employees in the special zone, it may preferentially supply housing units to them, notwithstanding Article 38 of the Housing Act.
(3) A house purchase loan or a loan for the lease of a housing unit on a deposit basis from the National Housing Fund established under Article 60 of the Housing Act may be granted to persons eligible for preferential supply of housing units under paragraph (2).
SECTION 5 Support for Promoting, etc. Tourism and Culture Industry

 Article 69 (Special Zone Tourism Development Plans)   print
In order to efficiently develop and manage tourism resources in each special zone, the Governor shall formulate a special zone tourism development plan stating the following as part of the comprehensive special zone plan prescribed in Article 41 (1):
1. Matters concerning the circumstances and trends of tourism;
2. Matters concerning the supply of and demand for tourism;
3. Matters concerning the protection, development, use, management, etc. of tourism resources;
4. Matters concerning the creation, maintenance, supplementation, etc. of tourist destinations and tourism complexes;
5. Matters concerning connection among tourist destinations;
6. Matters concerning the promotion of tourism business;
7. Matters concerning the conservation of the environment;
8. Other matters necessary for the development and management of tourism resources.

 Article 70 (Special Exceptions to Fostering International Convention Industry)   print
(1) In order to foster and support the international convention industry, notwithstanding Article 4 of the International Conference Industry Promotion Act, the Minister of Culture, Sports and Tourism may designate and announce any special zone as an international convention city.
(2) The Governor shall prepare administrative and financial supporting measures for the following affairs so that the international convention industry contributes to national development and improves the regional economy by fostering and promoting the international convention industry:
1. Formulation of a plan for fostering the international convention industry;
2. Support for inducing and holding international conventions;
3. Facilitation of construction and operation of international convention facilities;
4. Nurturing specialized human resources in international conventions;
5. Creation and expansion of the foundations to foster the international convention industry;
6. Acceleration of international cooperation;
7. Expansion of the foundations for electronic international convention;
8. Other affairs necessary to foster and promote the international convention industry.
(3) The Governor may prescribe matters necessary for performing the affairs provided in paragraph (2) by ordinance.

 Article 71 (Special Exceptions to Value-Added Taxes on Tourists to Special Zones)   print
The State or local governments may refund value-added taxes on tourism-related goods and services purchased and consumed by tourists in the special zone, as prescribed by the Restriction of Special Taxation Act.

 Article 72 (Exemption from Taxes and Surcharges on Admission, etc. to Golf Clubs)   print
(1) The State or local governments may exempt individual consumption taxes, special taxes for rural area and education taxes on admission fees to golf clubs located in any special zone, as prescribed by the Restriction of Special Taxation Act.
(2) Surcharges imposed on admission fees to golf clubs (referring to membership golf clubs; hereafter the same shall apply in this paragraph) located in any special zone shall be exempt, as prescribed in Articles 20 and 23 of the National Sports Promotion Act.

 Article 73 (Support for Educational, Cultural and Tourism Facilities. etc.)   print
The heads of relevant administrative agencies shall endeavor to ensure that cultural facilities, including all levels of schools, art and literature centers, libraries and museums, and tourism facilities, lodging facilities, recreational facilities and sports facilities are preferentially established and induced in accordance with the comprehensive special zone plan.

 Article 74 (Designation and Operation of Exemplary Tourism Enterprises)   print
(1) In order to improve the quality of tourism business in any special zone and to enhance the service provided thereby, the Governor may operate a system of designating exemplary tourism enterprises.
(2) The Governor may prescribe matters necessary for the designation and operation of exemplary tourism enterprises pursuant to paragraph (1) by ordinance.

(1) The Governor shall prepare and implement measures necessary to promote the leisure industry and leisure activities.
(2) The State may provide support if necessary to promote the leisure industry and leisure activities prescribed in paragraph (1).

 Article 76 (Promotion of Local Culture and Arts)   print
(1) In order to improve the quality of residents' lives, succeed to traditional culture and arts, and develop local culture, the Governor shall establish and implement a medium and long-term promotion plan of local culture and arts.
(2) A promotion plan of local culture and arts prescribed in paragraph (1) shall include the following:
1. Basic policies and plans for the promotion of local culture and arts;
2. Matters concerning succession to and development of traditional culture and arts;
3. Matters concerning support for local cultural and arts organizations;
4. Matters concerning support for local cultural and arts activities and for fostering the cultural industry;
5. Matters concerning the expansion and maintenance of facilities relating to culture and arts;
6. Matters concerning expansion of exchanges in culture and arts and globalization thereof;
7. Other matters necessary to promote local culture and arts.
(3) A promotion plan of local culture and arts prescribed in paragraph (1) shall be deliberated upon by the Local Culture and Arts Committee prescribed in Article 4 of the Culture and Arts Promotion Act.
(4) Where the State or a local government deems it necessary for projects to promote local culture and arts, it may permit the relevant project operators to use State or public property and other property, profit therefrom, or lend such property to them.
SECTION 6 Support for Management Activities of Foreign-Invested Enterprises, Improvement, etc. of Habitats

 Article 77 (Support to Foreign-Invested Enterprises, etc.)   print
(1) Notwithstanding relevant Acts, such as the State Property Act, the Public Property and Commodity Management Act, the State or a local government may grant a reduction of or exemption from rental fees for State or public property to foreign-invested enterprises (hereinafter referred to as "foreign-invested enterprises located in a special zone") enterprises located in a special zone, as prescribed by Presidential Decree.
(2) Notwithstanding relevant Acts, such as the State Property Act, the Public Property and Commodity Management Act, the State or a local government may permit special zone project implementers or foreign-invested enterprises located in a special zone to use State or public property owned by the State or the local government or to profit therefrom, or to lend or sell such property by a negotiated contract.

 Article 78 (Granting Status of Sojourn to Foreign Investors)   print
Where a foreigner makes an investment in any special zone in accordance with the requirements prescribed by Presidential Decree, he/she may be granted a status of sojourn prescribed in Article 10 of the Immigration Control Act, as prescribed by Presidential Decree.

 Article 79 (Exclusion, etc. from Application of other Acts)   print
(1) Article 33-2 of the Act on the Honorable Treatment and Support of Persons, etc. of Distinguished Services to the State shall not apply to foreign-invested enterprises located in any special zone.
(2) Notwithstanding Articles 18 (1), 35 (1) and 46 (1) of the State Property Act and Articles 13, 21 (1) and 31 (1) of the Public Property and Commodity Management Act, a period for lease of State or public property to foreign-invested enterprises located in any special zone may not exceed 50 years and such enterprises may be permitted to construct permanent facilities.

 Article 80 (Provision of Foreign Language Services)   print
(1) For the convenience of foreign-invested enterprises located in any special zone and foreigners in any special zone, the Governor shall provide foreign language services, such as issuing official documents in foreign languages, and receiving and processing documents in foreign languages.
(2) Matters necessary for the scope, methods, etc. of providing services prescribed in paragraph (1) shall be prescribed by Presidential Decree.

 Article 81 (Payment for Ordinary Transactions)   print
Any payment for an ordinary transaction of a size prescribed by Presidential Decree or smaller conducted in any special zone may be directly made between parties to the transaction by means of foreign payment prescribed in Article 3 (1) 4 of the Foreign Exchange Transactions Act.

 Article 82 (Supply, etc. of Rental Housing Exclusively for Foreigners)   print
(1) A special zone project implementer may supply sites for the construction of rental housing for foreigners in the relevant special zone.
(2) Notwithstanding Article 16 (1) of the Rental Housing Act, no rental housing exclusively for foreigners shall be disposed of by sale until ten years have passed from the date it is rented out.
(3) Notwithstanding Articles 20 and 21 of the Rental Housing Act, matters concerning the methods of selecting tenants, deposits for rent, rental fees and conversion to purchase on a preferential basis concerning rental housing exclusively for foreigners shall be prescribed by Presidential Decree.
(4) The Rental Housing Act, the Housing Act and the Housing Lease Protection Act shall apply to the construction, supply and management of rental housing exclusively for foreigners, except as otherwise prescribed in paragraphs (1) through (3).

(1) For rapport between South and North Korea and peace of the Korean Peninsula prescribed in Article 83, the State or local governments may have a conference concerning the formation of a unified team of South and North Korea, as prescribed by the Development of Inter-Korean Relations Act.
(2) Where an agreement on the formation, etc. of a unified team of South and North Korea is reached under paragraph (1), the State or local governments may provide administrative and financial support therefor.

CHAPTER VII SUPPLEMENTARY PROVISIONS

 Article 86 (Public Announcement, etc. of Types of Business to be Expelled)   print
(1) The Minister of Culture, Sports and Tourism may publicly announce the types of business or facilities prescribed by Presidential Decree (hereafter referred to in this Article as "types of business, etc. to be expelled") among the types of business or facilities determined as inappropriate for being located in a special zone in view of the purpose of operation of the special zone.
(2) Where enterprises, etc. belonging to the types of business, etc. to be expelled exist in a special zone, the Minister of Culture, Sports and Tourism may order such enterprises to suspend its business or close its facilities. The same shall apply if an entity in the special zone changes its business or facilities into a type of business or facilities publicly announced under paragraph (1).
(3) When the Minister of Culture, Sports and Tourism intends to order closure as prescribed in paragraph (2), he/she shall hold a hearing.
(4) Where an entity ordered under paragraph (2) fails to comply with such order, the Minister of Culture, Sports and Tourism may execute it on behalf of the entity, as prescribed by the Administrative Vicarious Execution Act.
(5) Paragraphs (2) through (4) shall not apply to the types of business, etc. to be expelled, which already exist in the relevant special zone as at the date of public announcement made under paragraph (1).

 Article 87 (Delegation of Authority)   print
(1) The head of a central administrative agency may delegate part of his/her authority vested under this Act to the Governor, as prescribed by Presidential Decree.
(2) Where the Governor performs duties prescribed by Presidential Decree among the duties delegated under paragraph (1), he/she shall consult in advance with the heads of the relevant central administrative agencies.
(3) The Governor may delegate part of his/her authority vested under this Act to the heads of Sis/Guns, as prescribed by Presidential Decree.
(4) Where the heads of Sis/Guns perform duties delegated under paragraph (3), they shall consult in advance with the Governor.

 Article 88 (Persons Deemed Public Officials for Purposes of Penal Provisions)   print
The executives and employees of the Organizing Committee and the executives and employees dispatched to the Organizing Committee from corporations or organizations pursuant to Article 19 (1) shall be deemed a public official for the purposes of the penal provisions under Articles 127 and 129 through 132 of the Criminal Act.

 Article 91 (Joint Penal Provisions)   print
If the representative of a corporation, or an agent, employee or other servant of a corporation or individual violates Article 89 or 90 in connection with the duties of the corporation or individual, not only shall such violator be punished, but also the corporation or the individual shall be punished by a fine under the relevant provisions: Provided, That this shall not apply where such corporation or individual has not been negligent in giving due attention and supervision concerning the relevant duties to prevent such violation.

 Article 92 (Fines for Negligence)   print
(1) Any person who violates Article 24 shall be punished by a fine for negligence not exceeding five million won.

ADDENDA
Article 1 (Enforcement Date)
This Act shall enter into force on the date of its promulgation: Provided, That Articles 2 (limited to facilities prescribed by Presidential Decree), 7 (3), 8 (4), 12 (1) 5 and (2), 13 (3), 17 (limited to cases prescribed by Presidential Decree), 25, 26 (5), 27 (5) and (6), 28 (2) and (5), 30 (1) 2 and 5 and (2), 31 (1), 38 (2), 40 (3) and (4), 41 (1) 13 and (2), 42 (2) 2 and (4), subparagraph 9 of Article 43, Articles 45 (1) (limited to acts prescribed by Presidential Decree), 48, 49 (1), 51, 55 (2) and (3), 56 (1), 59 (1) and (3), 60 (1), 62, 64, 66 (3), 77 (1), 78, 80 (2), 81, 82 (3), 86 (1), 87 and 92 (2) shall enter into force six months after the date of its promulgation.
Article 2 (Period of Validity)
Articles 5 through 39, 83 through 85, 88, 90 and 92 shall remain in force through March 31, 2019.
Article 3 (Transitional Measures concerning Organizing Committee)
(1) The Organizing Committee foundation incorporated under Article 32 of the Civil Act as at the time this Act enters into force shall prepare articles of association within two months after this Act enters into force and obtain authorization from the Minister of Culture, Sports and Tourism.
(2) Where the Organizing Committee foundation incorporated under Article 32 of the Civil obtains authorization pursuant to paragraph (1), the establishment of the Organizing Committee pursuant to this Act shall be deemed registered.
(3) Where the Organizing Committee foundation incorporated under Article 32 of the Civil Act registers the establishment of the Organizing Committee as prescribed in paragraph (2), it shall be deemed dissolved, notwithstanding the provisions concerning dissolution and liquidation prescribed by the Civil Act.
(4) The Organizing Committee shall succeed to all rights, obligations and property of the Organizing Committee foundation incorporated under Article 32 of the Civil Act on the date of registration for its establishment.
(5) Executives and employees of the Organizing Committee foundation incorporated under Article 32 of the Civil Act shall be deemed executives and employees of the Organizing Committee under this Act.
Article 4 (Transitional Measures concerning Property, etc. Contributed to Organizing Committee)
Money and other property contributed, subsidized or donated by the State, local governments, individuals, corporations or other organizations for the establishment and operation of the Organizing Committee foundation incorporated under Article 32 of the Civil Act as at the time this Act enters into force shall be deemed a contribution, subsidy or donation referred to in Article 8 (2).
Article 5 (Transitional Measures concerning Public Officials, Executives and Employees Dispatched to Organizing Committee)
Public officials, executives and employees dispatched by the State, local governments, individuals, corporations or other organizations as at the time this Act enters into force to the Organizing Committee foundation incorporated under Article 32 of the Civil Act shall be deemed public officials, executives and employees dispatched under Article 19 (1).
Article 6 (Transitional Measures concerning Special Zone Committee)
While the Support Committee referred to in Article 26 remains in existence, the Support Committee shall perform the functions of the Special Zone Committee pursuant to Article 42.
Article 7 (Transitional Measures concerning Urban Management Plans, etc.)
The term "an Urban/Gun management plan" prescribed in Articles 27 (1), 33 (1) 35 and 57 (1) 16 shall be construed as "an urban management plan" until April 14, 2012, and "the implementer of an Urban/Gun planning facility project" prescribed in Article 57 (1) 16 shall be construed as "the implementer of an urban planning facility project" until April 14, 2012.
Article 8 (Transitional Measures concerning Prior Environmental Examination)
Article 33 (1) 34 shall be deemed as follows until July 21, 2012:
34. Consultation on prior environmental examination under Article 25-3 of the Framework Act on Environmental Policy.
Article 9 (Transitional Measures concerning Penal Provisions)
The previous penal provisions shall apply to offenses committed before this Act enters into force.

Article 1 (Enforcement Date)
