Radio Equipment (Jersey) Order 1999

THE ECONOMIC DEVELOPMENT COMMITTEE, being satisfied –

(a)     that it is expedient to do so for the purpose of preventing or reducing the risk of interference with wireless telegraphy; and

(b)     as required by Article 2(6) of the Radio Equipment (Jersey) Law 1997,[1] that it is compatible with the international obligations of the United Kingdom which extend to Jersey,

in pursuance of Article 2 of the Radio Equipment (Jersey) Law 1997, orders as follows –

The following actions, namely –

(a)     manufacture (whether or not for sale);

(b)     selling or offering for sale, letting on hire or offering to let on hire, or indicating, (whether by display of the apparatus or by any form of advertisement) one’s willingness to sell or let on hire;

(c)     having in one’s custody or control; and

(d)     importation,

are restricted in respect of the radio equipment of the class or description set out in the Schedule.

In this Order, “connected”, “convey” and “telecommunications system” shall be construed in accordance with section 4 of the Telecommunications Act 1984 of the United Kingdom.

This Order may be cited as the Radio Equipment (Jersey) Order 1999.

SCHEDULE

Radio equipment

1.      Wireless telegraphy apparatus which is designed or adapted, or has facilities permitting its adaptation, for the purpose of transmitting spoken messages on the frequency band 26.1MHz to 28MHz.

2.      Wireless telegraphy apparatus designed or adapted for the purpose of transmitting messages in the frequency band 28MHz to 29MHz and in no other frequency band.

3.      Cordless telephone apparatus consisting in a base station and one or more mobile stations where –

(a)     each of such stations is designed or adapted to be used –

(i)     to send verbal messages to be conveyed over a telecommunications system, and

(ii)    to receive verbal messages conveyed over a telecommunications system; and

(b)     the base station only is capable of being connected to a telecommunications system.
