Weights and Measures (Prescribed Quantities No. 1) (Jersey) Order 1977

THE ENVIRONMENT AND PUBLIC SERVICES COMMITTEE, in pursuance of Articles 20 and 38 of the Weights and Measures (Jersey) Law 1967,[1] in the terms of a draft approved by the States on the 15th day of March 1977, orders as follows –

1      Interpretation

In this Order, unless the context otherwise requires –

“cereal breakfast foods and oat products” means –

(a)     cereal breakfast foods in flake form, other than cereal biscuit breakfast foods;

(b)     flour of oats; and

(c)     oatflakes and oatmeal;

“dried fruits” means dried fruits of any one or more of the following descriptions, that is to say, apples (including dried apple rings), apricots, currants, dates, figs, muscatels, nectarines, peaches, pears (including dried pear rings), prunes, raisins, sultanas and dried fruit salad;

“dried vegetables” means dried vegetables of any of the following descriptions that is to say, beans, lentils and peas (including split peas);

“edible fats” means –

(a)     butter, margarine, any mixture of butter and margarine, and low fat spreads (butter or margarine substitutes);

(b)     dripping and shredded suet;

(c)     lard and compound cooking fats and substitutes thereof;

(d)     solidified edible oil (except in gel form);

“flour and flour products” means –

(a)     flour of bean, maize, pea, rice, rye, soya bean or wheat; and

(b)     flour products of any of the following descriptions that is to say –

(i)     cake flour, other than cake mixtures and sponge mixtures,

(ii)    cornflour, other than blancmange powders and custard powders,

(iii)   self-raising flour.

“Law” means the Weights and Measures (Jersey) Law 1967;[2]

“pasta” means flour products described in paragraph 1(l)(iii) of Part 8 of Schedule 3 to the Law as macaroni and similar products;

“tea” includes tea in a tea bag;

“tea bag” means a permeable sealed bag containing tea, which is intended to be immersed in water in the course of the preparation of tea to drink.

(2)    References in this Order to any enactment shall be construed as references to that enactment as amended by any subsequent enactment or to any other enactment repealing and re-enacting that enactment with or without further amendments.

2      Application

This Order applies to the following foodstuffs –

(a)     cereal breakfast foods and oat products;

(b)     dried fruits;

(c)     dried vegetables;

(d)     edible fats;

(e)     flour and flour products;

(f)     pasta;

(g)     salt;

(h)     sugar;

(i)     tea,

and Parts 8 and 9 of Schedule 3 to the Law shall cease to apply to these foodstuffs.

3      Retail sale of non pre-packed foodstuffs

Foodstuffs to which this Order applies and which are not pre-packed shall be sold by retail only by net weight.

4      Marking of containers of pre-packed foodstuffs

(1)    Subject to paragraph (2), foodstuffs to which this Order applies shall be pre-packed, or otherwise made up for sale, only if the container is marked with an indication of quantity by net weight.

(2)    This Article shall not apply to  –

(a)     sugar in a quantity less than 50 g.;

(b)     dried fruits, butter, margarine, any mixture of butter and margarine, and low fat spreads (butter or margarine substitutes) in a quantity not exceeding 25 g.; and

(c)     cereal breakfast foods and oat products in a quantity not exceeding 15 g.

5      Marking of containers of foodstuffs made up in prescribed quantities by metric units

Where foodstuffs to which this Order applies are required by or under this Order to be made up in prescribed quantities by metric units, the marking shall include the words “metric pack” in capital letters, of at least the height referred to in the Schedule to the Weights and Measures (Marking) (Jersey) Order 1975,[3] and within a surrounding line or on a panel which is clearly distinguished in colour from its surroundings and within which or on which there is no other written and no pictorial matter.

6      Prescribed quantities

(1)    Cereal breakfast foods and oat products, except when made up in a quantity not exceeding 50 g. or exceeding 10 kg, shall be pre-packed only if they are made up in one of the following quantities by net weight, that is to say –

(a)     4 oz., 8 oz., 12 oz., 1 lb, 1½ lb, and multiples of 1 lb; or

(b)     125 g., 250 g., 375 g., 500 g., 750 g., 1 kg, 1.5 kg, and multiples of 1 kg

(2)    Dried fruits, except when made up in a quantity not exceeding 75 g. or exceeding 10 kg, shall be pre-packed only if they are made up in one of the following quantities by net weight, that is to say –

(a)     4 oz., 8 oz., 12 oz., 1 lb, 1½ lb, and multiples of 1 lb; or

(b)     125 g., 250 g., 375 g., 500 g., 1 kg, and multiples of 1 kg

(3)    Dried vegetables, except when made up in a quantity not exceeding 100 g. or exceeding 10 kg, shall be pre-packed only if they are made up in one of the following quantities by net weight, that is to say –

(a)     4 oz., 8 oz., 12 oz., 1 lb, 1½ lb, and multiples of 1 lb, or

(b)     125 g., 250 g., 375 g., 500 g., 1 kg, and multiples of 1 kg

(4)    Edible fats, except when made up –

(a)     in a quantity exceeding 10 kg; and

(b)     in the case of butter, margarine, any mixture of butter and margarine, and low fat spreads (butter or margarine substitutes), in a quantity not exceeding 25 g.,

shall be pre-packed only if they are made up in one of the following quantities by net weight, that is to say –

(i)     2 oz., 4 oz., 8 oz., 12 oz., 1 lb, 1½ lb, and multiples of 1 lb, or

(ii)    50 g., 125 g., 250 g., 500 g., and multiples of 500 g. up to and including 4 kg, and, thereafter, multiples of 1 kg

(5)    Flour and flour products, except when made up in a quantity not exceeding 50 g. or exceeding 10 kg, shall be pre-packed only if they are made up in one of the following quantities by net weight, that is to say –

(a)     4 oz., 8 oz., 12 oz., 1 lb, 1½ lb, and multiples of 1 lb, or

(b)     125 g., 250 g., 500 g., and multiples of 500 g. and, in the case of cornflour, 375 g. and 750 g.

(6)    Pasta, except when made up in a quantity not exceeding 50 g., shall be pre-packed only if it is made up in one of the following quantities by net weight, that is to say –

(a)     4 oz., 8 oz., 12 oz., 1 lb, 1½ lb, and multiples of 1 lb; or

(b)     125 g., 250 g., 375 g., 500 g., and multiples of 500 g.

(7)    Salt (other than cut lump salt), except when made up in a quantity not exceeding 100 g., shall be pre-packed only if it is made up in one of the following quantities by net weight, that is to say –

(a)     4 oz., 8 oz., 12 oz., 1 lb, 1½ lb, and multiples of 1 lb; or

(b)     125 g., 250 g., 500 g., 750 g., 1kg, 1.5 kg, and multiples of 1 kg, up to and including 10 kg, and, also 12.5 kg, 25 kg and 50 kg

(8)    Sugar, except when made up in a quantity not exceeding 100 g. or in a quantity exceeding 5 kg, shall be pre-packed only if it is made up in one of the following quantities by net weight, that is to say –

(a)     12 oz., 1 lb, 1½ lb, and multiples of 1 lb; or

(b)     125 g., 250 g., 500 g., 750 g., 1 kg, 1.5 kg, 2 kg, 2.5 kg, 3 kg, 4 kg, or 5 kg

(9)    Tea, except when made up in a quantity not exceeding 25 g. or exceeding 5 kg, shall be pre-packed only if it is made up in one of the following quantities by net weight, that is to say –

(a)     2 oz., 4 oz., 8 oz., 12 oz., 1 lb, 1½ lb, or a multiple of 1 lb, or

(b)     50 g., 125 g., 250 g., 500 g., 750 g., 1 kg, 1.5 kg, 2 kg, 2.5 kg, 3 kg, 4 kg, or 5 kg

7      Citation

This Order may be cited as the Weights and Measures (Prescribed Quantities No. 1) (Jersey) Order 1977.
