Aerodromes (Jersey) Regulations 1965[1]

THE STATES in pursuance of Article 4 of the Aerodromes (Administration) (Jersey) Law 1952,[2] have made the following Regulations –

PART 1

PRELIMINARY

1      Interpretation

In these Regulations, unless the context otherwise requires –

“captain”, in relation to any aircraft, means the person having the command or charge of the aircraft for the time being;

“contravention” includes non-compliance and the expression “contravene” shall be construed accordingly;

“owner”, when used in relation to goods, includes any consignor, consignee, shipper or agent for sale or custody of such goods, as well as the owner thereof.

PART 2

POWERS OF minister

2      Power of Minister to restrict access to aerodromes

(1)    Where it appears to the Minister necessary or expedient so to do, the Minister may issue directions restricting access to any part of any aerodrome and may issue such further directions in connection therewith as the Minister deems appropriate.

(2)    The Minister may from time to time direct that certain areas of any aerodrome shall be reserved for special purposes under such conditions and in such manner as the Minister deems appropriate.

(3)    If any person contravenes any direction issued by the Minister under this Regulation, he or she shall be liable to a fine of level 4 on the standard scale.[3]

3      Circulation and parking of vehicles[4]

(1)    The Minister may from time to time issue such directions as the Minister thinks fit regarding the circulation and parking of vehicles on any aerodrome, and may make such charges as the Minister thinks fit for the use of any part of an aerodrome set aside for the parking of vehicles.

(2)    If any person contravenes any direction issued by the Minister under this Regulation he or she shall be liable to a fine of level 2 on the standard scale.[5]

4      Posting of notices

The Minister shall cause to be posted in prominent positions on aerodromes to which directions issued under this Part relate, notices indicating the requirements of such directions and, for the purpose of indicating the requirements of directions under Regulation 3, use may be made of traffic signs prescribed under the Road Traffic (Jersey) Law 1956.[6]

PART 3

POWERS OF AIRPORT DIRECTOR[7]

5      General

The Airport Director and any person so authorized by the Airport Director may give such directions and such orders as may be considered necessary to maintain order on an aerodrome and to control the movement of aircraft and vehicles and the embarkation and disembarkation of passengers, freight and livestock.[8]

6      Power to board aircraft

The Airport Director and any person authorized by the Airport Director shall, on production if so required of evidence of the Airport Director’s authority, have the right to board any aircraft at any time.[9]

7      Removal of objects and vehicles[10]

(1)    The Airport Director shall have the right to remove, or cause to be removed from an aerodrome, or, as the case may be, from any part of an aerodrome set aside for the parking of vehicles –

(a)     any object which he or she considers to be interfering with the normal working of the aerodrome;

(b)     any vehicle which –

(i)     is parked in contravention of a direction issued under Regulation 3,

(ii)    is so placed or parked as to contravene Regulation 10(m) or (o),

(iii)   having been required to be removed from an aerodrome or any parking place, has not been so removed within the time limited by the requirement, in contravention of Regulation 10(p).[11]

(2)    Any person removing a vehicle under this Regulation –

(a)     may do so by towing or driving the vehicle, or in such other manner as he or she may think necessary, and may take such measures in relation to the vehicle as he or she may think necessary to enable him or her to remove it;

(b)     shall make such arrangements as may be reasonably necessary for the custody of the vehicle.

(3)    Any expenses incurred in removing or storing any object or vehicle under this Regulation shall be recoverable as a civil debt from the owner of the object or vehicle so removed.

(4)    No claim in damages shall lie against the Minister, any officer in an administration of the States for which the Minister is assigned responsibility or any servant of the Minister, in connection with the removal or storage of any object or vehicle under this Regulation.

PART 4

DUTIES OF CAPTAIN OF AIRCRAFT ETC.

8      Captains to comply with directions of Airport Director

The captain of every aircraft on an aerodrome shall comply with any directions given by the Airport Director in pursuance of these Regulations and any captain of an aircraft who fails to carry out such directions shall be liable to a fine of level 3 on the standard scale.[12]

9      Damage by aircraft or vehicle

(1)    The owner of an aircraft or vehicle on an aerodrome shall be answerable to the Minister for any damage done by such aircraft or vehicle to the aerodrome or any buildings or equipment connected therewith.

(2)    The captain of an aircraft or driver of a vehicle through whose wilful act or negligence any such damage as is referred to in paragraph (1) has been done shall be liable to make good the same, and the Minister may detain any such aircraft or vehicle until sufficient security has been given for the amount of damage done.

PART 5

GENERAL

10    Prohibited acts

No person shall on any aerodrome –

(a)     obstruct or interfere with the proper use of an aerodrome;

(b)     obstruct, impede, resist or assault any person in the execution of his or her duty in relation to an aerodrome;

(c)     remain on an aerodrome after having been required to leave it;

(d)     allow any vehicle or animal to be on an aerodrome after having been required to remove it or after its presence on an aerodrome has been forbidden;

(e)     allow any animal to stray onto an aerodrome or fail to keep any animal under control whilst on an aerodrome;

(f)     board or attempt to board any aircraft without the authority of the person in charge of it;

(g)     tamper or interfere with any aircraft or anything used in connection with an aircraft;

(h)     smoke in, or otherwise bring into or light any naked light in –

(i)     any place where any such act is prohibited by notice, or

(ii)    any place within 50 feet of an aircraft or a store of liquid fuel or explosives;

(i)     do any act which might cause or tend to cause an outbreak of fire;

(j)     throw or discharge any stone or missile;

(k)     climb any wall, fence, barrier, railing or post;

(l)     wilfully give a false fire or ambulance alarm;

(m)     drive or place a vehicle carelessly or dangerously or without due consideration for persons using the aerodrome;

(n)     fail to stop a vehicle when required by an official so to do;

(o)     park a vehicle elsewhere than in a place provided for that purpose or fail to pay any relevant charge for parking a vehicle in such a place;

(p)     fail to remove a vehicle from an aerodrome or from any parking place when required so to do;

(q)     wilfully and unreasonably interfere with the convenience of, or cause annoyance to, any other person;

(r)     behave in a manner reasonably likely to offend against public decency;

(s)     be in an intoxicated condition;

(t)     remove, displace, damage, deface or alter any marker, light, signal, or notice used in connection with an aerodrome;

(u)     throw down, deposit, put or leave, otherwise than in a receptacle provided for the purpose, any refuse of any nature whatsoever.[13]

11    Acts for which written permission of the Minister is required

(1)    Subject to the provisions of these Regulations, no person shall on any aerodrome, except with the written permission previously obtained of the Minister –

(a)     exhibit any notice, sign or advertisement, except on premises which the person exhibiting it is authorized to occupy and in accordance with the terms of his or her occupation;

(b)     deliver any public address or give or take part in any public performance, reception, display or exhibition.

(2)    Any permission under this Regulation may be granted subject to such conditions as the Minister may think fit to impose and may at any time be withdrawn by the Minister.

12    Acts for which written permission of Airport Director is required

(1)    Subject to the provisions of these Regulations, no person shall on any aerodrome, except with the written permission previously obtained of the Airport Director –

(a)     enter thereon or leave therefrom otherwise than through a gate or entrance for the time being provided for that purpose;

(b)     enter any part thereof to which members of the public are not for the time being admitted;

(c)     remove, displace, damage, deface or alter any building, structure or other property, whether movable or immovable (including any notice), forming part of or provided for in connection with the aerodrome;

(d)     dig soil or cut or remove turf;

(e)     graze animals;

(f)     engage in trading;

(g)     leave a vehicle thereon longer than is reasonably necessary for the transaction of the business for the purpose for which it was brought there;

(h)     drive a vehicle elsewhere than in a place provided for the passage or accommodation of such a vehicle;

(i)     drive a motor vehicle into a hangar used for the maintenance or storage of aircraft;

(j)     run an aircraft engine in a hangar;

(k)     run an aircraft engine when an aerodrome is closed to air traffic;

(l)     fill or discharge from any container (including any part of a vehicle) liquid fuel elsewhere than in a place approved for that purpose;

(m)     light a fire elsewhere than in a place constructed for that purpose;

(n)     proceed onto any part thereof which is not a part set aside for use by the public or passengers;

(o)     use any wireless or electrical apparatus;

(p)     solicit or collect alms, donations or contributions;

(q)     discharge any oil or waste oil, otherwise than into a container approved for that purpose;

®discharge any firearm.[14]

(2)    Any permission under this Regulation may be granted subject to such conditions as the Airport Director may think fit to impose and may at any time be withdrawn by the Airport Director.[15]

13    Penalties

If any person contravenes any of the provisions of these Regulations, or any directions issued or given under these Regulations, in relation to which no special penalty is provided, he or she shall be guilty of an offence and shall be liable to a fine of level 3 on the standard scale.[16]

14    Citation

These Regulations may be cited as the Aerodromes (Jersey) Regulations 1965.
