Diseases of Animals (Rabies) (Jersey) Law 1976[1]

A LAW to make further provision for the prevention and control of rabies and for connected purposes

1      Infected areas–destruction of wild animals

(1)    An Order under Article 6 of the Diseases of Animals (Jersey) Law 1956[2] (hereafter referred to as the “Law”) making provision for areas to be declared to be infected with rabies may include provision for the destruction in such an area, by persons authorized in accordance with the Order, of such wild animals (not being animals held in captivity) as may be prescribed by the Order.

(2)    An Order made under paragraph (1) may provide for –

(a)     authorizing any person to enter any land (other than a dwelling-house) for the purpose of carrying out, or of deciding whether to carry out, the destruction there of animals in accordance with the Order;

(b)     authorizing the erection of fences or other obstacles to restrict the movement of animals into and out of an area where destruction is carried out;

(c)     regulating the ownership and disposal of the carcases of animals destroyed in accordance with the Order;

(d)     prohibiting any person from obstructing the destruction of animals in accordance with the Order and from interfering with the carcases of animals destroyed;

(e)     authorizing the use of methods of destruction which would otherwise be unlawful.

(3)    An Order made under paragraph (1) shall include provision for the steps to be taken to inform the occupier of any land where it is proposed that animals should be destroyed, and other persons who may be there, of the proposal and of the methods of destruction to be used.

2      Infected areas–additional powers

An Order under Article 6 of the Law making provision for areas to be declared to be infected with rabies may include provision for –

(a)     requiring notice to be given, in such circumstances as may be prescribed by the Order, of the death in such an area of such domestic or wild animals as may be prescribed;

(b)     regulating the ownership and disposal of the carcases of animals whose deaths are required to be notified by virtue of sub-paragraph (a);

(c)     requiring and regulating the vaccination, confinement and control in such an area of such domestic animals and animals held in captivity as may be prescribed by the Order;

(d)     authorizing the seizure and detention and the disposal or destruction of any animal in respect of which any provision made by virtue of sub-paragraph (c) is not complied with;

(e)     authorizing any person to enter any land for the purpose of seizing or destroying any animal in pursuance of the Order.

3      Powers as to quarantine and control of rabies virus

The provision which may be made by Order under Article 3 of the Law shall include provision –

(a)     for requiring animals which may be carriers of rabies to be kept in quarantine in such cases, for such periods and under such conditions as may be prescribed by the Order;

(b)     for prohibiting or regulating the keeping or importation, or both, of rabies virus in any form and the deliberate introduction of the virus into animals.

4      Notice of animals affected with rabies

Any person who knows or suspects that an animal (whether in captivity or not) is affected with rabies shall immediately give notice of that fact to the Minister for Planning and Environment and, if the animal is in the person’s possession or under the person’s charge, shall as far as practicable keep the animal separate from other animals.

5      Restriction of carriage of animals by sea

An Order under Article 11 of the Law which is expressed to be made for the purpose of preventing the introduction of rabies into Jersey may include provision for prohibiting, for such time as the Minister for Planning and Environment may consider expedient, the conveyance of such animals as may be prescribed by vessels of a prescribed class or description, or by all vessels, to or from any place in Jersey.

6      Destruction of imported animals

An Order under Article 13 of the Law prohibiting the importation of animals which is expressed to be made for the purpose of preventing the introduction of rabies into Jersey may empower the Minister for Planning and Environment to arrange for the destruction of animals in respect of which the Order or any licence granted under it is contravened.

7      Increase of penalties for offences connected with importation

Notwithstanding Article 39 of the Law, an Order under Article 13 of the Law which is expressed to be made for the purpose of preventing the introduction of rabies into Jersey may provide that a person who is guilty of an offence which consists of  –

(a)     contravening, or failing to comply with, any provision of that Order; or

(b)     failing to observe any conditions to which a licence issued in accordance with the Order is subject,

shall be liable to imprisonment for a term not exceeding 12 months, or a fine, or both.

8      Citation

This Law may be cited as the Diseases of Animals (Rabies) (Jersey) Law 1976.

This Law has been amended by the States of Jersey (Amendments and Construction Provisions No. 3) (Jersey) Regulations 2005. The amendments replace all references to a Committee of the States of Jersey with a reference to a Minister of the States of Jersey, and remove and add defined terms appropriately, consequentially upon the move from a committee system of government to a ministerial system of government
