Psittacosis (Jersey) Order 1958[1]

THE ECONOMIC DEVELOPMENT COMMITTEE, in pursuance of Articles 3, 10, 23 and 42 of the Diseases of Animals (Jersey) Law 1956,[2] orders as follows –

1      Interpretation

In this Order –

“approved disinfectant” has the meaning assigned to it in the Diseases of Animals (Approved Disinfectants) (Jersey) Order 1958;[3]

“disease” means psittacosis or ornithosis;

“disinfect” means disinfect with an approved disinfectant;

“premises” includes land.

2      Detention and isolation of poultry and precautions to be adopted to prevent the spreading of disease

(1)    Where the Minister has reason to believe that there are diseased or suspected poultry on any premises, the Minister may cause to be served on the occupier of those premises a notice requiring the occupier to detain the poultry and the eggs of any poultry on those premises and to keep the poultry isolated, as far as practicable, from other poultry and to take such other precautions, for the purpose of preventing the spreading of disease, as may be specified in the notice.

(2)    Where a notice has been served on the occupier of any premises under paragraph (1), the Minister may, by a subsequent notice served on that occupier, direct that –

(a)     such additional precautions as may be specified in such subsequent notice shall be taken; or

(b)     any requirement specified in any notice served under this Article shall cease to apply or shall be modified to the extent, or in the manner, specified in that subsequent notice.

(3)    It shall be the duty of the occupier of any premises on whom a notice has been served under this Article to comply with the terms of the notice.

(4)    A notice under this Article shall remain in force until withdrawn by or on behalf of the Minister.

(5)    Except under and in accordance with a permit in writing granted by or on behalf of the Minister, no poultry and no eggs of any poultry shall be permitted to enter any premises in respect of which a notice under this Article is in force.

3      Cleansing and disinfection

(1)    The occupier of any premises in respect of which a notice under Article 2 has been served shall, if so required by or on behalf of the Minister, cleanse and disinfect, or cause to be cleansed and disinfected, under the supervision of an inspector, any part of those premises in which poultry have been placed or kept, and any utensil, appliance or other thing used for or about the poultry.

(2)    Where the occupier of any premises fails to comply with any requirement under this Article within such time as may be specified in the requirement, the Minister may, without prejudice to any proceedings for an offence in respect of such default, cause to be carried out the cleansing and disinfection so required and, in such a case, may recover from the occupier, as a civil debt, the expenses of such cleansing and disinfection.

4      Citation

This Order may be cited as the Psittacosis (Jersey) Order 1958.

This Order has been amended by the States of Jersey (Amendments and construction Provisions No. 3) (Jersey) Regulations 2005. The amendments replace all reference to a Committee of the States of Jersey with a reference to a Minister of the States of Jersey, and remove and add defined terms appropriately, consequentially upon the move from a committee system of government to a ministerial system of government
